EU passenger rules and travel insurance protect you in different ways. Depending on your route and operating airline, EU rules may give you a right to a refund or rerouting, airport care, or fixed compensation for a disrupted flight. Insurance pays only for losses and events covered by your specific policy, which may include medical care, repatriation, trip cancellation, or baggage. They are not alternatives: check whether you can claim from the airline and insurer separately, and follow each process without assuming you can recover the same loss twice.
Start with who is responsible
Airline passenger protections arise under rules that apply to an eligible flight. Insurance benefits arise under the contract between you and your insurer. A package organiser may have separate responsibilities if you booked a package holiday; those rights are distinct from both airline claims and cancellation insurance.

EU air-passenger rules apply to flights within the EU operated by an EU or non-EU airline; flights departing the EU for a non-EU country operated by either; and flights arriving in the EU from outside when operated by an EU airline. The rules also extend to Iceland, Norway and Switzerland. A caveat may apply if you have already received benefits under relevant non-EU law. The route and operating carrier matter—not your citizenship or simply whether your trip is “in Europe.” See the European Commission’s Your Europe guidance on air passenger rights for the applicable scope and claim routes.
What EU flight protections can provide
Cancellation
For a cancellation, eligible passengers generally choose between reimbursement of the ticket, rerouting at the earliest opportunity, or rerouting at a later convenient date, subject to comparable conditions and seat availability. Airport assistance may also be due. If the airline gives less than 14 days’ notice, fixed compensation may apply, unless the carrier establishes qualifying extraordinary circumstances that could not have been avoided even with reasonable measures.

Delay
Arrival at the final destination at least three hours late may qualify for fixed compensation, subject to exceptions. Assistance during a departure delay depends on the delay’s duration and flight distance. At a departure delay of at least five hours, the rules described by Your Europe include ticket reimbursement and a return flight where applicable. Keep these remedies distinct: extraordinary circumstances may remove the right to compensation without necessarily removing the airline’s obligations to provide care.
Fixed compensation is not an insurance limit
The European Commission describes these compensation bands, subject to the rules’ conditions and permitted reductions:

- ESSENTIAL Car Auto Insurance Registration BLACK Document Wallet Holders 2 Pieces
| Flight distance | EU compensation band |
|---|---|
| 1,500 km or less | €250 |
| Over 1,500 km within the EU, and other flights between 1,500 and 3,500 km | €400 |
| Over 3,500 km | €600 |
These are statutory passenger-compensation amounts, not sums insured by a travel policy. Eligibility depends on the itinerary, operating carrier, disruption and applicable exceptions. The Council of the EU’s summary of air passenger rights also describes the bands and relevant disruption conditions.

Insurance can address risks that airline passenger rules do not generally insure, particularly emergency medical expenses and transport home. A policy may also cover cancellation or curtailment for listed reasons, baggage loss, damage or delay, and other specified events. The exact cover, limits and exclusions depend on the policy; a “comprehensive” label is not enough to establish what is insured.

UK government FCDO travel-insurance guidance advises UK travellers to check destination and transit cover, trip length, emergency care, evacuation or repatriation, existing physical or mental health conditions, and planned activities. It also says an EHIC or GHIC is not a substitute for travel insurance: those cards do not cover private healthcare, repatriation, or additional costs such as mountain rescue. This is UK guidance, not EU legislation or tailored advice for every country; check the rules and policy terms relevant to your residence and cover.
Be precise about pre-existing conditions
EIOPA’s 2019 thematic review reported that around 70% of respondents to that review excluded pre-existing medical conditions from the cover offered. This is a dated result for that review’s respondents, not a current estimate for all insurers or countries; the report notes that exceptions and limited emergency cover varied. EIOPA’s 2019 review says: “When it comes to travelling with pre-existing medical conditions, it is very important that consumers are aware of the coverage they have and understand the limits of their travel insurance policy.”
Independent reader supportYour contribution helps us test, update, and keep practical guides available for everyone.Compare baggage protection carefully
Under the Your Europe guidance, an airline is liable for checked baggage that is lost, damaged or delayed, with compensation capped at approximately €1,300. That is a liability ceiling, not an automatic payout: actual recovery depends on the circumstances, applicable rules and evidence. The guidance says you can arrange a higher airline liability limit for a fee in advance, no later than check-in. For expensive items, private insurance may be advisable if the airline limit is insufficient.
For a written complaint, the page gives a deadline of seven days for lost or damaged baggage and 21 days after receiving delayed baggage. Hand luggage is treated separately; the airline is liable for damage if it was responsible. Follow the airline’s process and keep receipts, baggage reports and correspondence.
Make the relevant claims separately
- Record what happened. Save your flight number, scheduled and actual arrival times, airline notices, receipts for reasonable expenses, and relevant communications.
- Contact the operating airline. Make the passenger-rights or baggage claim that applies. For baggage, observe the written complaint deadlines and retain the property irregularity report and purchase evidence.
- Escalate if needed. If the airline’s response is unsatisfactory, consult Your Europe’s claim routes, including the relevant national enforcement body or available dispute-resolution process.
- Notify your insurer separately. Use the policy’s deadline and ask what documents, approvals or assistance arrangements it requires. Keep the airline and insurer claims distinct, and check policy coordination rules rather than assuming duplicate recovery.
Check the timing of the revised EU rules
As of 4 October 2026, the European Commission said revised air-passenger rules had been adopted in July 2026 and “should enter into force next summer.” Until commencement, the Commission said the existing rules remained applicable. Expected changes include clearer baggage-allowance information, faster claim procedures, improved rerouting and support for cancellations or significant delays, and better protection for connecting journeys. These are future changes, not protections to assume are already in force. Check the effective date and implementing details before relying on them. See the Commission’s 28 July 2026 update and the Council’s 13 July 2026 announcement.
