A later GST rate cut does not automatically entitle a buyer to a refund of tax correctly charged on an earlier purchase. In India, a consumer who believes a seller failed to pass on a rate reduction should use the anti-profiteering complaint route; a statutory GST refund is a separate claim available only when the claimant and transaction fit a defined refund category. GST rules differ by country, so the steps below apply to India, not to every GST system.
The first question is not simply, “Did the GST rate go down?” It is: which GST system applies, when was the supply made, was the tax charged correctly at that time, and are you asking for a price benefit from a supplier or a statutory refund from the government? Those answers determine the route—and whether a claim is available at all.

First identify which GST system applies
GST is jurisdiction-specific. The procedure in this guide concerns India. Do not use it for a purchase made under another country’s GST rules. For example, Singapore has its own transitional rules for supplies affected by its 2024 rate increase: IRAS transitional rules for a GST rate change.

In India, two different issues can sound like a “GST refund” but follow different routes: a supplier may have failed to pass on the benefit of a rate reduction, or a claimant may qualify for a statutory refund under a defined category. Identify which one describes your situation before filing anything. A consumer does not have a general right to file for a government refund just because the rate on a product fell after the consumer bought it.

This distinction matters because an anti-profiteering complaint concerns a supplier’s price treatment, while a refund application concerns a statutory entitlement under the relevant GST rules. A consumer asking why a seller’s price did not reflect a rate cut is not automatically a business refund claimant. Conversely, the fact that a business has a GST registration does not by itself make every amount of tax or input tax credit refundable.
Choose the route that fits your situation
| Situation | Relevant route | What the route does |
|---|---|---|
| A consumer believes a supplier kept the price unchanged instead of passing on a GST rate reduction. | Anti-profiteering application or complaint under the prescribed process. | Raises the question of whether the supplier passed on the rate-reduction benefit through a commensurate price reduction. It is not automatically a claim for a government tax refund. |
| A business or other eligible claimant has a refund covered by a statutory category, such as eligible accumulated input tax credit (ITC), exports, certain supplies to special economic zones, or deemed exports. | FORM GST RFD-01, filed electronically through the Common Portal, with evidence for the relevant category. | Seeks a refund under the applicable statutory provisions and rules. Eligibility and supporting documents depend on the claim. |
| A purchase was correctly taxed before a later rate change. | Apply the rate relevant to the date of supply; do not treat the later rate as a refund category by itself. | A later rate cut does not by itself reverse correctly charged earlier tax or create a general consumer refund. |
The GST Council describes the anti-profiteering principle as requiring suppliers to pass on “the benefit of any reduction in the rate of tax or the benefit of input tax credit to the recipients by way of commensurate reduction in prices.” The complaint concerns that price benefit, while a statutory refund is governed by separate eligibility and filing rules. See the Council’s FAQ on anti-profiteering provisions.
A useful way to classify your case is to ask four questions:
Free tools Windows power users keep installed
One-click scans. No signup required.
- Who is seeking relief? A consumer alleging a seller did not pass through a benefit, or an eligible claimant with a statutory refund category?
- What is the legal basis? A commensurate price reduction under the anti-profiteering framework, or a refund category under the CGST Act and Rules?
- Was the rate applied correctly? The answer depends on the supply date and the rate applicable to that supply, not merely on when you placed an order or made payment.
- What evidence can you provide? The relevant records differ by route: transaction and pricing information may help explain a consumer complaint, while an RFD-01 claim requires documents tied to its statutory category.
If the facts do not fit either route, do not assume that a rate change creates a third, general-purpose refund process. Check the applicable rules or seek advice about the particular transaction.
Check the supply date and the rate that applied
Start by establishing when the supply took place and which rate applied to it. The Government of India’s FAQ for the 2025 rate revision says, “GST is charged on the date of supply, not on the date of purchase.” It says the revised rates for covered supplies took effect on 22 September 2025; specified tobacco-related goods were excluded pending a separately notified date. Do not assume that a rate revision applies to every item or service on the same date. Check the applicable official rate information for the product or service and transaction in question.
The 22 September 2025 date is specific to the covered changes described in that FAQ, not a general effective date for future changes or every GST item. The FAQ also says correctly charged ITC on earlier purchases remains available subject to applicable rules. That concerns claimants eligible to take ITC; it does not mean a consumer is entitled to a cash refund. Read the Government of India FAQ on the 2025 GST rate revision alongside the relevant rate information for your transaction.
“Date of supply” and “date of purchase” can be different in an ordinary transaction. A buyer may order or pay on one date and receive the goods or service on another. The cited government FAQ gives the governing answer at a high level: the rate is charged on the date of supply. Do not decide that an invoice is wrong solely because it shows a rate that differs from the rate in effect on the day you placed the order. First determine the supply date under the applicable rules and whether the item was among the supplies covered by the rate revision.
Do these 3 things before closing this tab:
1Clear out junk files and repair common Windows errors2Fix the driver behind crashes, sound loss and screen glitches3Repair Windows errors before they cause bigger problemsFor the 2025 revision, the government FAQ addresses readers asking whether GST is charged on the date of supply or purchase and what happens to ITC on purchases made before the change. Its answer is not that every item automatically receives a reduced rate on 22 September 2025. The revised rates applied to covered supplies; the named tobacco-related exclusions demonstrate why checking the product-specific effective date matters. For another rate change, use that change’s official notification and transition guidance rather than carrying forward the 2025 date.

If you are a registered business, distinguish the rate charged by your supplier from your own later entitlement to use ITC. The government FAQ says correctly charged ITC on earlier purchases remains available subject to applicable rules; it does not say that a later rate cut rewrites the earlier invoice or makes the ITC payable in cash. ITC is a credit mechanism, and eligibility, use, and any refund of unutilized credit depend on the relevant rules.
If you are a consumer: prepare an anti-profiteering complaint
1. Compare the rate change with the price charged
Establish whether the relevant supply was affected by a rate reduction and whether the supplier passed on the benefit through a commensurate price reduction. A lower tax rate does not necessarily mean that the total price must fall by the same percentage as the rate change: the comparison concerns the rate and the price charged for the supply, and the applicable facts matter. The official anti-profiteering guidance explains the principle, but this article cannot determine whether a particular seller’s pricing complied with it.
Begin with the specific product or service and transaction, rather than a general claim that “GST went down.” Check whether the rate applicable to that supply actually changed, when the change took effect, and whether the supplier’s charge reflects the benefit. The GST Council describes the obligation as a “commensurate reduction in prices”; it does not make every change in the final price an automatic calculation of a refund owed to an individual buyer. The price comparison and supporting facts are important.
Where available, compare the invoice with a relevant price list, advertisement, quotation, or written communication from the seller. An unchanged advertised price may be useful context, but by itself it may not establish how the tax reduction was handled in the transaction. Keep the comparison factual: identify the item or service, the relevant dates, the rate information you relied on, and what the supplier charged.
2. Keep records that explain the transaction
Gather the invoice or receipt and note the supplier, item or service, taxable value, GST rate and amount shown, total paid, and the purchase and supply or delivery dates if available. Retain relevant advertisements, price lists, and messages with the supplier. These records help explain your allegation; they are practical preparation, not a universal statutory checklist for every consumer complaint.
It can also help to preserve the exact product description or service details, since a rate revision may cover some supplies but not others. Keep the original invoice or receipt rather than relying only on a typed summary. If the invoice does not show a supply or delivery date, retain any order confirmation, delivery record, or correspondence that may help establish the timing. These are sensible records to gather, not a statement that every item is formally required in every complaint.
If you contact the supplier before making an application, retain the response and record when you raised the issue. A supplier’s explanation may clarify the price or the date it treated as the supply date. It may also help you decide whether the issue is a possible failure to pass on the benefit or instead a misunderstanding about the applicable rate. The reviewed guidance does not establish that you must contact the seller first, so do not treat this as a mandatory prerequisite.

3. Use the complaint route for the scope of the allegation
GST Council guidance routes local matters to the relevant State Screening Committee and matters with an all-India character to the Standing Committee. The appropriate route depends on the scope of the allegation. Confirm the currently accepted application form and receiving office with the relevant official authority; a state, transaction, and allegation are needed to identify the correct local contact. The Council’s GST Help page provides the central guidance on routing.

Do not assume that a form or address found in an older article is still the correct one. The reviewed central guidance distinguishes local allegations from matters with an all-India character, but it does not provide a reader-specific current state contact. Before sending records, confirm the accepted process with the relevant official authority for the location and scope of your matter. That step avoids sending a complaint to the wrong committee or relying on outdated contact information.
In your description, explain what supply is involved, what rate change you believe applied, the dates and price charged, and why you believe the rate-reduction benefit was not passed on. Attach or refer to relevant supporting material as the currently accepted process requires. Keep a copy of what you submit and any acknowledgement or follow-up communication. These points help make an allegation understandable; they do not replace the official form’s instructions.
Do not file FORM GST RFD-01 merely because you are a consumer who believes a seller did not reduce a price after a rate cut. That form is for statutory refund claims, not a universal consumer channel for recovering the price difference. Nor should you assume the anti-profiteering process will result in a particular payment to you without the matter being considered under the prescribed process.
If you have a statutory refund claim: use FORM GST RFD-01
Confirm that the claim fits a refund category
CBIC’s refund rules cover defined situations, including eligible accumulated ITC, exports, certain supplies to special economic zones, deemed exports, and other specified cases. A claimant must meet the applicable conditions. A rate change alone does not establish eligibility, and ITC is not the same thing as a cash refund. Check the relevant statutory category and its requirements before applying.
For example, an exporter or a business with eligible accumulated credit may need to meet conditions particular to that category. Merely having paid GST on a purchase, or having a credit balance, does not establish that the balance qualifies for refund. The category determines who may claim, what period or supplies are covered, and what evidence is needed. The examples above are not a complete list of all statutory refund grounds.
Before filing, identify the category precisely and check the current version of the relevant Section 54 provisions and CGST Rules. If you cannot identify a category that covers the facts, do not label the request “rate-change refund” and assume it qualifies. A business’s claim is not automatically valid simply because the tax rate changed after an input purchase; the rule must allow the refund in that circumstance and the claimant must satisfy its conditions.
File through the Common Portal with category-specific evidence
CBIC states that an applicant “may file an application in FORM GST RFD-01 electronically through the Common Portal.” The evidence varies by claim. Examples in the rules include a copy or reference to an adjudication or appeal order; export documentation; invoices and bank-realisation documents for exported services; and invoice statements for specified accumulated-credit claims. The application must be supported by evidence appropriate to its category rather than a generic bundle of documents.
Use the instructions for the exact refund category when assembling the electronic application. A document that supports one kind of claim may not support another. For instance, export-related claims may call for export documents, while a claim based on an order may require the relevant adjudication or appeal order. The examples show why there is no single universal document list that can be given for every claimant. Check CBIC’s rules and the portal requirements for the category before submitting.

Keep copies of the application and supporting evidence, and ensure that the amounts, period, invoices, and stated legal basis agree across the materials. Incomplete or inconsistent information can prompt a deficiency communication. This is a practical filing precaution, not a substitute for the formal requirements or a guarantee that a complete-looking application will be sanctioned.
For certain claims concerning whether the incidence of tax has been passed on, the rules describe a declaration for claims up to ₹2 lakh and a chartered accountant or cost accountant certificate above ₹2 lakh, subject to statutory exceptions. This threshold and documentation apply in the circumstances described by the rules, not to every refund claim or consumer complaint. Consult the current rule and the requirements for your claim category in CBIC’s GST refund rules.
The ₹2 lakh threshold should not be read as a general cap on refunds, a universal minimum, or a document rule for every kind of claim. It relates to the described declaration or professional certificate about whether the incidence of tax has been passed on, and the rules include exceptions. Check whether that requirement applies to your particular claim before relying on the threshold.

For applications other than those made from the electronic cash ledger, the rules provide for scrutiny of completeness within 15 days. A complete application receives an acknowledgement; a deficient one receives a deficiency communication. This is a completeness-scrutiny period, not a promise that a refund will be sanctioned or paid within 15 days. Follow the notice or acknowledgement for the next step in the application process.
In practical terms, filing and payment are separate stages. The 15-day period described in the rules concerns whether the non-cash-ledger application is complete; it does not mean that a qualifying amount will necessarily be approved or credited within that period. If the application is deficient, read the communication carefully and follow the process applicable to the stated deficiency. If it is acknowledged as complete, continue to monitor the application and any later decision or request through the prescribed channel.
Do not infer approval from the fact that an application was submitted or acknowledged. The rules provide for subsequent sanction or rejection procedures, and the authority considers the claim under its applicable legal requirements. Keep copies of notices and responses, and make sure any further submission addresses the issue raised rather than simply resending the original bundle.

- Assuming a lower rate creates an automatic refund. The later rate does not by itself make correctly charged tax on an earlier supply refundable to a consumer.
- Using the purchase or payment date without checking the supply date. The 2025 government FAQ says GST is charged on the date of supply. The applicable effective date is also supply-specific.
- Confusing price relief with a tax refund. A complaint about a supplier’s failure to pass on a rate benefit follows the anti-profiteering route; RFD-01 is a statutory refund application.
- Treating ITC as cash. ITC on earlier purchases may remain available to an eligible business subject to the rules, but that does not give a consumer a cash refund or make every credit balance refundable.
- Assuming the same documents apply to every claim. Refund evidence depends on the statutory category. Orders, invoices, export records, bank-realisation evidence, or declarations may apply in different circumstances.
- Relying on old contact details. Confirm the current form and receiving office for a consumer complaint with the relevant official authority; the correct route depends on whether the matter is local or has an all-India character.
Keep the two dates and two kinds of benefit separate
Two distinctions prevent common errors. First, the relevant rate depends on the date of supply for the transaction, not simply on when a consumer bought or paid for something. Second, a supplier’s price-reduction obligation and a claimant’s statutory right to a refund are different legal questions. A correct answer depends on the transaction date, rate, claimant, and legal basis for the claim.

Use the date and rate to test the underlying facts, then select the process by the relief you are seeking. Frequently Asked Questions
Can I claim a refund because GST fell after I bought something?
Not automatically. In India, a later rate cut does not by itself create a general consumer right to recover tax correctly charged on an earlier supply. If you believe the supplier failed to pass on a rate reduction, the relevant route is an anti-profiteering application or complaint. A statutory refund is available only when the claimant and transaction meet a defined refund category.
Is GST charged on the date of supply or the date of purchase?
The Government of India FAQ for the 2025 rate revision says GST is charged on the date of supply, not the date of purchase. Check the supply date and the official effective date for the particular product or service; the FAQ’s 22 September 2025 date applies to covered revisions, not every supply or future change.

The 2025 government FAQ says correctly charged ITC on earlier purchases remains available subject to applicable rules. This concerns eligible claimants and is not a promise of a cash refund. Eligibility and use of ITC remain subject to the rules.
How do I complain if a seller did not pass on a rate reduction?
Use the prescribed anti-profiteering application route rather than treating the matter as an RFD-01 refund. GST Council guidance routes local matters to the relevant State Screening Committee and matters with an all-India character to the Standing Committee. Confirm the current accepted form and receiving office with the relevant official authority.
Who can file FORM GST RFD-01?
An eligible claimant with a refund covered by a statutory category may apply electronically through the Common Portal using FORM GST RFD-01. Examples of categories include eligible accumulated ITC, exports, certain supplies to special economic zones, and deemed exports. The category’s requirements and supporting documents determine eligibility; a rate change alone is not enough.
Does the 15-day period mean my refund will be paid within 15 days?
No. CBIC’s rules provide for scrutiny of completeness within 15 days for applications other than those made from the electronic cash ledger. A complete application receives an acknowledgement and a deficient application receives a deficiency communication. This is not a guarantee of sanction or payment within 15 days.
When do I need a chartered accountant or cost accountant certificate?
For certain claims concerning whether the incidence of tax has been passed on, the rules describe a declaration for claims up to ₹2 lakh and a chartered accountant or cost accountant certificate above ₹2 lakh, subject to statutory exceptions. This is not a universal requirement for every refund or consumer complaint; check the current rule for your category.
The Bottom Line
Bottom line: First confirm the jurisdiction, supply date, and applicable rate. In India, a consumer alleging that a seller did not pass on a rate reduction should use the prescribed anti-profiteering complaint route—not assume an automatic tax refund or file RFD-01 for a price difference. A statutory refund through RFD-01 is for an eligible claimant whose claim fits a defined category and whose evidence satisfies the rules. The 2025 revised rates for covered supplies took effect on 22 September 2025, and correctly charged earlier ITC remains subject to applicable rules.
