How to Choose the Right Car Accident Attorney: Questions to Ask Before You Hire

Use these questions to compare car accident attorneys, understand the fee and expense arrangement, and set expectations before you hire.

There is no universally “best” car accident attorney. The right choice is a lawyer whose experience, working style, fees, and case strategy fit your situation—and who explains those things clearly before you sign. Use the first meeting to compare candidates, understand who will handle the work, and get the costs and possible case paths in writing.

How to compare car accident attorneys

Ask each lawyer the same core questions and compare the answers, not just the confidence of the sales pitch. The American Bar Association’s consumer guidance puts the hiring decision in the client’s hands: “Remember, you are the one doing the hiring.”

What to compare What to ask A useful answer should explain
Relevant experience How much of your practice involves cases like mine? What experience do you have with the issues in my case? The lawyer’s role, relevant case types, and any limits on what their experience demonstrates.
Who does the work Who will investigate and prepare my case, and who supervises that work? Which lawyer and staff members will be involved, how supervision works, and whether staff work is billed separately.
Fees and expenses How is your fee calculated, and which expenses might I owe? The fee basis, possible additional charges, and what happens to costs if there is no recovery.
Case assessment and strategy What are the strengths and weaknesses? Is settlement or trial more likely, and why? A reasoned assessment with uncertainties and trade-offs, rather than a guaranteed outcome.
Communication Who will answer my questions, how will you update me, and how are disagreements handled? Clear expectations for contact and a practical way to address concerns.

These are comparison prompts, not a scoring system. An attorney’s predictions are opinions based on the facts available at the time, not promises about what a claim will recover.

Ask about experience that matches your case

Ask how long the lawyer and firm have practiced, what kinds of matters they handle most often, and whether they have experience with the particular circumstances that make your case different. A lawyer who regularly handles personal-injury claims may still need to explain how their background fits the specific facts of your collision.

You can also ask whether the lawyer has a formal concentration or certification relevant to your matter. Certification programs vary by state; where a program does not exist, ask about the lawyer’s areas of concentration and how they developed that experience. A title or credential is only useful if the lawyer can explain its relevance to your case.

Find out who will handle the case day to day

The lawyer you meet may not personally perform every task. Ask which attorney will be responsible for your matter, what work paralegals or other staff may do, and who reviews and supervises that work. Clarify whether staff time creates a separate charge or is included in the fee arrangement.

It is reasonable to ask how you will reach the person handling your case and what kinds of questions should go to the supervising lawyer. The point is not that every task must be done by the lead attorney; it is that you should know who is doing the work and who is accountable for it.

Understand the fee and the expenses separately

Many personal-injury lawyers use a contingent fee: the lawyer’s fee is tied to a successful recovery. The ABA describes a fixed percentage of the recovery as common and gives “often one third” as an example. That is a general illustration, not a universal rate or a guarantee of what a particular lawyer will charge. Ask for the actual terms in your proposed agreement.

Do not treat “no fee unless we win” as proof that you cannot owe anything if the case is unsuccessful. Depending on the agreement, a client may still be responsible for case expenses such as court filing fees or deposition costs. Ask for a written explanation of:

  • How the lawyer’s fee is calculated, including the amount or percentage and what sum it applies to.
  • Whether that percentage changes if the case settles before a lawsuit, after litigation begins, or at another stage.
  • Which expenses the firm advances and which are deducted from a recovery.
  • Which expenses, if any, you would owe if there is no recovery.
  • Whether any charges for staff, records, experts, or other services are separate from the lawyer’s fee.

Ask for an estimate of likely costs and an explanation of any contract language you do not understand before signing. The ABA notes that some lawyers offer an introductory meeting without charge, but not all do; ask whether a consultation has a fee before scheduling it.

Discuss strengths, weaknesses, settlement, and trial

Ask the lawyer what appears strong in your case, what could make it harder, and what information is still needed to assess it. A useful answer should identify uncertainties and explain how they could affect the next steps, rather than presenting a best-case scenario as a likely result.

Ask whether the lawyer expects to pursue settlement, prepare for trial, or keep both paths open. Discuss the trade-offs and the lawyer’s experience with trial work. A prediction that one path is more likely should come with reasons; it should not be treated as a guarantee. The ABA advises consumers to be wary of a lawyer who “guarantees a big settlement or assures a victory in court.”

Set expectations for updates and problems

Before hiring, agree on how often you should expect updates, how quickly routine questions are usually answered, and whom to contact if the lead lawyer is unavailable. Ask what happens if you disagree about a recommendation or have a concern about the representation. The ABA recommends raising potential problems at the first meeting and asking how lawyer-client disputes may be resolved.

Check local rules and credentials
