There is no universally safest crypto exchange for perpetuals. Before depositing, verify that the specific legal entity and contract are available to you and permitted in your jurisdiction; then assess the contract’s margin, liquidation, funding, pricing and settlement terms, along with custody and withdrawal risks. A familiar brand name or the word “perpetual” does not establish authorization or suitability.
1. Verify the exact entity, contract and jurisdiction
Start with the legal entity named in the account agreement, not just the exchange brand. Find the contract’s legal description and determine whether residents of your jurisdiction may open that account and trade that product. Check the relevant regulator’s current registers, product lists and customer disclosures, then compare them with the agreement you would accept. If the entity, product or eligibility terms are unclear, do not assume the venue is authorized for you.

For U.S. customers
The CFTC distinguishes designated contract markets (DCMs), which are exchanges under its oversight, from futures commission merchants (FCMs), which handle customer futures transactions. Introducing brokers may also have registration and National Futures Association membership requirements, subject to exceptions. These are U.S.-specific categories, not a worldwide test of safety. Read the required risk disclosures and understand the obligations for the particular contract. The CFTC’s product listing has included products labeled “perpetual futures” with certified status; a listing is not an endorsement, does not establish availability to a particular retail customer, and should be checked again alongside the customer agreement.
For EU customers
Do not assume every product marketed as a crypto perpetual is—or is not—a contract for difference (CFD). In a statement dated 24 February 2026, ESMA said firms must assess whether a derivative they offer meets the CFD definition. Where it does, applicable national CFD product-intervention measures include leverage limits, a mandatory risk warning, margin close-out, negative balance protection, and a ban on monetary and non-monetary benefits. The statement is conditional on the product meeting that definition; check how the rules apply to the specific offering and your location.

2. Know how leverage, margin and liquidation can affect you
Leverage lets a position have a notional value greater than the margin posted. As a result, a relatively small adverse price move can have a large effect compared with the funds committed. The CFTC warns that leverage amplifies futures risk: customers may need to add margin or close positions when markets move against them, and under some futures arrangements losses can exceed the initial investment. Do not assume that all crypto perpetuals have the same loss limit. Whether losses can exceed posted collateral depends on the contract and applicable protections, including any negative-balance protection.

- What are the initial-margin and maintenance-margin requirements?
- What triggers liquidation or margin close-out, and which price—mark, index or another measure—is used to calculate it?
- If isolated and shared collateral options are offered, what assets can be used to support the position, and which positions can draw on them?
- Does the contract provide negative-balance protection, and what are its conditions?
- What do the terms say happens during abrupt price moves or a platform outage?
If you cannot explain how a position can be closed and what funds may be at risk, you do not yet have enough information to judge the product.

“Perpetual” does not tell you how a contract is funded, priced or settled. Use the current contract specification and fee schedule for the exact product, rather than relying on a general description of the platform.

| What to check | Details to verify |
|---|---|
| Trading charges | Maker and taker fees, plus any other transaction charges that apply to your account or activity. |
| Funding | The funding-rate formula, payment interval, any caps, and historical rates. Historical rates are not a promise about future costs. |
| Collateral and settlement | The collateral and settlement currencies, and any conversion implications. Confirm whether settlement is cash-based and how the amount due is determined. |
| Reference and mark prices | The index constituents or other reference source, how the mark price is calculated, and what the contract provides for disruptions or fallback pricing. |
| Margin schedule and liquidation | Leverage tiers, maintenance-margin schedule, liquidation procedure, and any stated liquidation fees or insurance-fund rules. |
The CFTC notes that futures may be cash-settled and that an index or auction price can determine the amount paid or received; volatility in cash markets can also affect futures. Read the actual settlement and pricing provisions. A venue’s headline fee alone cannot show the full cost of holding or closing a position.
4. Separate trading access from custody and failure risk
A venue may provide trade execution while leaving a separate question unanswered: what happens to customer assets if the company fails? Review the custody entity, withdrawal policy, asset-segregation statements, lending or reuse disclosures, financial reporting, and the process for customer claims. Look for the actual terms and evidence behind each statement rather than treating marketing language as a guarantee.

Proof of reserves is limited evidence, not a complete picture of solvency or customer recovery rights. Investor.gov warns that such assessments may be point-in-time snapshots, may omit liabilities and activity between snapshots, and cannot prevent assets from moving after an assessment. Its 27 July 2023 investor bulletin also distinguishes proof-of-reserves, valuation and calculation reports from financial-statement audits under SEC and PCAOB standards: these reports may not provide complete statements or a full picture of liabilities, may offer no assurance, and fall outside PCAOB oversight. As Investor.gov puts it, “investors should exercise extreme caution when relying on proof of reserves to conclude that a crypto asset entity has sufficient reserve assets to meet customer liabilities.”
Crypto-asset accounts also do not carry the same protections as bank deposits or registered securities held at broker-dealers. Do not assume ordinary exchange balances have FDIC insurance, SIPC coverage or equivalent protection.

5. Check operational controls and fraud warning signs
Review the venue’s account-security settings, withdrawal controls, incident notices, support channels and contract terms for service interruptions. The CFTC identifies safeguards, flash crashes, manipulation, hacking, phishing and conflicts of interest—including platforms trading from their own accounts—as risks in virtual-currency cash markets. These are risk categories to investigate, not evidence that a particular venue has suffered a specific incident.
Be wary of anyone promising guaranteed high returns, using confusing jargon to support outsized claims, pressuring you to act quickly, or making unsolicited offers. An unlicensed seller or a demand for extra fees to release supposed profits is another warning sign. A joint SEC/CFTC investor alert dated 24 April 2019 recommends investigating firms and checking registration and disciplinary information. Verify through official sources rather than links or contact details provided by a promoter.
6. Compare venues using the same evidence and date
For each option, record what you checked and when. Use the same contract where possible; comparisons across different products can disguise differences in risk and cost. Give more weight to verifiable terms and customer protections than to marketing claims or a single reserve snapshot.

Official materials reviewed for this guide do not establish a comparable current exchange-safety statistic, loss rate or synchronized dataset that identifies a winning venue. A checklist can expose unanswered questions; it cannot eliminate market, platform or insolvency risk.
