To check whether an employer has sponsored H-1B workers before, search its name in the USCIS H-1B Employer Data Hub, then cross-check the result against the Department of Labor’s OFLC disclosure files for Labor Condition Applications (LCAs). USCIS records show historical petition activity and decisions; DOL records show activity at an earlier labor-condition stage. Neither database confirms that the employer will sponsor this particular job or candidate. For that, ask the recruiter or HR contact about the role, worksite, and your circumstances.
Which records answer which question?
The USCIS H-1B Employer Data Hub is the most direct public source for an employer’s historical H-1B petitions and petition decisions. The DOL Office of Foreign Labor Certification (OFLC) LCA disclosure files provide a separate view: they show employer filings and related labor-condition information. These databases cover different steps, so finding a company in one does not establish what happened at the other.
| What you want to know | USCIS H-1B Employer Data Hub | DOL OFLC LCA disclosure files |
|---|---|---|
| Agency and stage | U.S. Citizenship and Immigration Services (USCIS); petition data and decisions. | Department of Labor (DOL); employer LCA applications and attestations. |
| Best use | Look for historical employer petitions and outcomes. | Look for LCA filings and details included in the disclosure files. |
| Scope documented in the cited material | USCIS’s FY 2024 characteristics report, published in 2026, describes Hub data covering FY 2009–2024 and quarterly updates. | DOL’s Performance Data page lists quarterly files. As of October 9, 2026, the page included FY 2025 files and FY 2026 Q3 data. |
| What a record cannot establish | That the employer will sponsor a future vacancy, or that a particular job or candidate qualifies under its current policy. | That USCIS received or approved an H-1B petition. An LCA is not a petition approval. |
Use both sources as historical clues, not as a yes-or-no test for a job offer. A past filing can show that an employer took a step in an earlier case; it cannot establish the employer’s current intentions for your position.

The agencies’ records are useful for different questions. USCIS is the place to look for historical petition activity and recorded decisions. DOL’s LCA files help you find activity at the labor-condition application stage. A result in one source does not automatically imply a corresponding result in the other, and neither source is a live statement of company policy.
How to search the USCIS H-1B Employer Data Hub
- Search the employer’s name. Open the USCIS H-1B Employer Data Hub and enter the employer name you know. If the search offers filters, narrow the results by fiscal year, NAICS code, city, state, or ZIP code.
- Try the legal entity name and plausible variants. A public-facing brand, a shortened name, and the legal employer named in an offer or corporate record may differ. Search more than one form when appropriate, but do not treat a similar-sounding result as a match.
- Compare the location and available identifiers. Look for a location that makes sense for the hiring entity, and compare any identifiers the Hub makes available. USCIS identifies employers using the last four digits of their tax identification numbers, so a name alone may not be enough to confirm identity.
- Check the relevant fiscal years and outcomes. The Hub’s historical results can help establish whether petitions associated with a matching employer appear in the covered years and what decisions are recorded. Keep the year and recorded outcome attached to your notes; an old result is not evidence of a current sponsorship policy.
- Record uncertainty rather than forcing a match. If the name, location, identifier, or corporate relationship does not line up, label the result uncertain and ask the employer which legal entity would employ and sponsor you.
USCIS’s Characteristics of H-1B Specialty Occupation Workers, Fiscal Year 2024, published in 2026, describes Hub coverage from FY 2009 through FY 2024 and says it is updated quarterly. That range is a description of the data available in the report, not a promise that every employer, year, or record will appear in a search. Check the Hub for the period and results it currently provides rather than assuming that a missing result means no petition activity ever occurred.

Take care to identify the employer that would actually hire you, not just the organization whose name is most familiar. If an offer, recruiter communication, or job posting uses a brand name, compare it with the legal name shown for the employing entity where you have that information. Search plausible abbreviations and name variants, but keep each possible match separate in your notes until the entity and available identifiers support a connection.
The Hub can help answer, “Can I find out whether an employer has sponsored H-1B workers before?” It cannot by itself answer, “Does this job offer include H-1B sponsorship?” The first is a question about past records; the second is about a current vacancy and employer decision. Write down the period and outcome shown in a result, and avoid turning historical data into a prediction about your individual case.

- Open DOL OFLC’s Performance Data page. Find the LCA disclosure files and the associated record layouts. The layouts matter because they explain the fields in each file; do not infer the meaning of a field from its label alone.
- Choose the relevant year or quarter. The page provides quarterly data. As of October 9, 2026, the inventory included FY 2025 files and FY 2026 Q3 data. The available inventory changes, so check the page for the period you need.
- Search for the employer, including name variants. Use the same care with legal names, abbreviations, subsidiaries, and locations as you did with USCIS results. A record for a similarly named business or related entity is not automatically a record for your prospective employer.
- Read the record’s category and fields. Pay attention to whether the record is filed, certified, withdrawn, or otherwise categorized in the file. Use the record layout to understand the specific fields and what they represent; a filing’s presence alone is not evidence of a USCIS petition decision.
- Compare the employer and period with the USCIS result. Note whether the entity and time period appear consistent across the two sources. A mismatch can reflect different entities, naming, or stages rather than a definitive answer about sponsorship.
DOL explains that an employer submits an LCA and that a certified LCA allows it to proceed with the USCIS and Department of State process. Certification is therefore a step in the process, not proof that a petition was filed with USCIS or approved. Treat the LCA file and the USCIS Hub as separate records answering separate questions.
In practical terms, seeing an LCA tells you that an employer-related record appears in a DOL disclosure file at the LCA stage. The status category matters: a filed, certified, withdrawn, or otherwise categorized record should be described using the category shown, not summarized as an approved H-1B case. The record layouts on DOL’s Performance Data page are there to help interpret the fields accurately.
Keep the exact file period with any result you find. DOL lists quarterly files, and its inventory changes over time. If you cannot locate a result in one quarter or year, do not silently treat that as a search of every period. Check the relevant available files and describe the scope of what you reviewed.
How to interpret the results without overreading them
If you find USCIS petition history
A matching USCIS record is evidence of historical petition activity associated with the employer identity shown in the data. Review the year and decision information rather than reducing the result to “this company sponsors.” The record does not tell you whether the employer will sponsor this vacancy, whether the same policy applies to your worksite or job family, or whether your personal circumstances fit the employer’s process.

Do not use the number of historical petitions as a personal probability estimate. The public datasets do not establish that a company will sponsor a particular applicant, that the same practice continues, or that the employer applies one policy to every role. Even a record with a decision shown describes a past petition and outcome, not a commitment about a new offer.
If you find an LCA but no matching USCIS record
Report what you found precisely: an LCA record exists for the apparent employer and period, but you have not established a corresponding USCIS petition or approval. An LCA belongs to the labor-condition stage. It is not interchangeable with a petition record, and the two data sources need not produce identical search results.
Use the certified status accurately if that is what the DOL file shows: DOL says certification allows the employer to proceed with the USCIS and Department of State process. It does not establish that the next step was taken. Likewise, a filed or withdrawn status should not be described as a USCIS petition result.
If you find no records
A blank search does not prove that an employer has never sponsored anyone or will not sponsor you. Names may differ, the hiring entity may be a subsidiary or affiliate, and the available record coverage is limited by the data and period described by each agency. Check the legal entity and relevant names and periods before drawing a conclusion. Then ask the employer directly.
Be specific about what you searched: which employer names, which agency source, and which years or quarters. This makes a negative search result more useful without overstating it. For example, “I did not find a matching result under this name in the periods I checked” is more accurate than “the company has never sponsored.” If the company operates through multiple entities, ask which one would employ you and repeat the identity check accordingly.
If you find records for a related company
Do not automatically attribute a parent company’s or affiliate’s filing to the entity that would hire you. Compare legal names and available identifiers, and ask which entity would employ you and handle sponsorship. An acquisition, subsidiary relationship, or abbreviated name can make a search look more conclusive than it is.
A shared brand or corporate relationship may explain why names look connected, but it does not by itself establish which entity filed a petition or would sponsor your position. Keep the distinction between “a related company appears in the records” and “the hiring entity has a matching record.” If the employer confirms that a different legal entity would handle the process, use that name to clarify the public-record search and your role-specific question.

If the two databases seem inconsistent
First confirm that you are comparing the same legal entity and an appropriate time period. Then check the category and fields in the DOL file and the petition information in USCIS separately. The data describe different stages, and a difference between them is not, by itself, proof of an error or a current employer policy. If the connection remains unclear, ask the employer to identify the relevant employing entity and explain whether it sponsors the role.
Before drawing a conclusion, check whether the result is for the same employer name, location, and period; check the DOL record layout and status; and distinguish an LCA from a USCIS petition decision. Differences can arise because the sources represent different stages or because the names do not identify the same entity. The public records alone may not resolve that question.
Do E-Verify records or third-party sponsor lists answer the same question?
No. E-Verify is a separate employment-verification program, not evidence that an employer sponsors H-1B workers. Similarly, third-party lists may be convenient starting points, but they are not official USCIS or DOL records. For a historical check, use the government sources described above and verify the employer identity. For a current answer about a specific opening, ask the employer.
Ask whether this specific job offer includes sponsorship
Once you have checked the public records, get a direct answer from recruiting or HR. Ask about the job in hand, not only whether the company has ever filed an H-1B case. The useful distinctions are whether the position supports a new H-1B petition or a transfer, whether the employer sponsors this job family and worksite, and what timing or candidate conditions apply.
- Would the legal entity hiring me sponsor H-1B status for this specific role and worksite?
- Does the answer differ for a new H-1B petition and a transfer?
- Does the employer sponsor this job family, or is sponsorship considered role by role?
- Are there timing requirements or conditions based on my circumstances that could affect sponsorship?
- Which team or contact can confirm the employer’s current process for this offer?
You can ask before accepting an offer if sponsorship affects your decision. A concise written question helps make clear that you mean the specific position, location, and type of sponsorship rather than the employer’s history in general.

Make the question concrete enough to avoid a general answer that does not fit your situation. Include the position or job family, the worksite or location, and whether you are asking about a new H-1B petition or a transfer. If the answer depends on timing or your circumstances, ask what condition applies and which person or team can confirm it. The public databases cannot provide those details for your offer.
It is reasonable to distinguish between “Has this employer filed H-1B petitions in the past?” and “Will this employer sponsor me for this job?” A recruiter may answer the first from general company history without having answered the second. If sponsorship is important to your decision, follow up until you have a response tied to the employing legal entity and the position you are considering.
Independent reader supportYour contribution helps us test, update, and keep practical guides available for everyone. What to do if the public record and employer answer differ
A historical filing and a recruiter’s answer may appear to conflict because one concerns a past case and the other concerns a particular vacancy. Ask the employer to clarify the legal entity, the role and worksite, and whether the answer applies to a new petition, a transfer, or both. Keep the response tied to the offer rather than treating an unrelated affiliate’s record as a commitment.
If an employer says it does not sponsor this role despite historical records, those statements can both be true: the records concern earlier activity, while the employer’s answer concerns a current vacancy. If recruiting says it does sponsor but you find no matching public result, the absence of a result is not conclusive. Confirm the legal entity and ask the employer to explain its current process for the offer rather than trying to make old data settle a current-policy question.
DOL’s public-access rules also provide a way to inspect LCA materials: a worker or member of the public may inspect them at the employer’s principal place of business or the worksite within one working day of filing. This concerns access to LCA materials; it does not turn an LCA into proof of USCIS petition approval or resolve whether a particular offer will be sponsored.
This access rule is relevant if you want to inspect LCA materials, but it does not replace the two database searches or the direct question to the employer. It is about access to the LCA materials at the listed location and timeframe; it does not establish that a petition followed, that USCIS approved one, or that a future role is covered by the employer’s policy.

A practical decision checklist
- USCIS match: Does the Hub result correspond to the legal employer, not merely a similar name?
- Time period: Which fiscal year or years does the result cover, and what decision information is shown?
- DOL match: Does the LCA file show activity for the same apparent entity, and what category does the record carry?
- Stage: Are you distinguishing an LCA filing or certification from a USCIS petition and decision?
- Current offer: Has recruiting or HR answered about the exact job, worksite, new petition or transfer, and applicable conditions?
Before you summarize what you found, separate three points in your notes: the identity of the employer in the record, the agency and stage represented, and the period or outcome shown. If one of those is uncertain, say so. That simple discipline helps prevent a result for a related company, a DOL-stage filing, or an old petition from being mistaken for a current promise.
The strongest practical answer combines a careful identity match, accurate interpretation of both agencies’ records, and a direct confirmation from the employer about the offer. The public data can establish historical activity; only the employer can confirm its present policy for the job you are considering.

How do I check if a company sponsors H-1B visas?
Search the company in USCIS’s H-1B Employer Data Hub for historical petitions and decisions, then cross-check the legal entity and period in DOL OFLC’s LCA disclosure files. Treat both as historical records, not confirmation of current policy. Ask recruiting or HR whether the specific role, worksite, and your circumstances are eligible for sponsorship.
Does an LCA mean the employer sponsored or approved an H-1B?
No. An LCA is a Department of Labor filing at an earlier stage. DOL says a certified LCA allows the employer to proceed with the USCIS and Department of State process; it does not prove that a petition was filed with USCIS or approved.
What if I cannot find the employer in the USCIS Hub or DOL files?
A missing result is not proof that the employer has never sponsored workers or will not sponsor you. Try plausible legal names and variants, confirm which entity would hire you, and check the periods available in each source. Then ask the employer directly about the specific offer.
Can a parent company’s H-1B record count as a record for its subsidiary?
Do not assume so. Compare legal entity names and available identifiers, and ask which entity would employ and sponsor you. A parent, affiliate, or similarly named business may be related without being the hiring entity.
What’s actually slowing this PC down?
Pick the symptom - the matching free tool is one click away.
Should I ask about sponsorship before accepting a job offer?
If sponsorship affects your decision, ask recruiting or HR about the exact role and worksite before accepting. Specify whether you mean a new H-1B petition or a transfer, and ask about any timing or candidate conditions that apply.
Does E-Verify enrollment show that a company sponsors H-1B workers?
No. E-Verify is a separate employment-verification program and should not be treated as evidence of H-1B sponsorship.
The Bottom Line
Use the USCIS H-1B Employer Data Hub to check historical petition activity and DOL OFLC files to check LCA-stage records, taking care to match the legal employer and interpret each record at the right stage. Neither source guarantees sponsorship for a particular vacancy. Ask recruiting or HR for a current answer about the exact role, worksite, and whether a new petition or transfer is supported.
