How to Check Whether a Mortgage Lender Is Licensed and Reputable

Check a mortgage lender’s company and loan officer in NMLS, verify state records, interpret complaints carefully and compare loan terms separately.

To check a U.S. mortgage lender, verify the company and the individual loan officer in NMLS Consumer Access, confirm the relevant state authorization and regulatory record with the state regulator, and review complaint patterns with care. Then evaluate the loan offer separately: a lender can be authorized and still offer terms that are not right for you. No single search result or complaint count answers all three questions.

What you are checking: authorization, conduct and loan terms

These are related but distinct checks. Authorization asks whether the company or professional is permitted to conduct the relevant mortgage business in your state. Conduct is assessed through public regulatory records, enforcement actions and complaints. Offer quality is about whether the specific loan’s costs and terms suit you and compare well with other offers.

A positive result in one category does not settle the others. A license does not guarantee that a lender is reputable or that its offer is competitive. A complaint, in turn, is not by itself proof of misconduct. Keep each check separate so that you do not treat a license lookup as an endorsement—or a complaint search as a verdict.

The applicable rules and regulator depend on your state and on the provider’s legal category. A mortgage company, broker and individual loan originator may have different records or requirements. The process below is a starting point for U.S. consumers, not a determination about any particular lender.

Before searching, get the exact company and loan officer identities

Ask the lender for its legal business name and company NMLS ID, and ask the loan officer for their full name and individual NMLS ID. Use both the name and ID when searching, if available. A name alone may match a different person or legal entity, especially when businesses have similar names.

Compare the information the lender gave you with what appears in public records. Check that the record belongs to the same company or person, not merely an entity with a similar name. Also note the contact details and state information shown in the record, then compare them with the lender’s communications. A mismatch deserves clarification before you move forward.

The Consumer Financial Protection Bureau (CFPB) says consumers can look up a loan officer by name or NMLS ID in its Loan Estimate explainer. That makes the ID useful as an identity check, but it does not replace checking the company, state authorization or regulatory history.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Ask separately for the company ID and the officer ID: they identify different records. If a loan officer works for a lender or broker, the individual record does not by itself establish that the business is authorized, and the company record does not confirm that the person contacting you is the officer named in the public record. Write down both identifiers and the exact legal name before searching.

Search NMLS Consumer Access for the company and the individual

NMLS Consumer Access is a free public service for checking whether a financial-services company or professional is authorized to conduct business in a state. The CFPB’s answer to “Is there any way I can check to see if the company or person I contact is permitted to make or broker mortgage loans?” describes it as a way to see whether a company or professional is authorized in your state. The CFPB says the lookup provides this information “in most cases,” so treat it as a starting point rather than a guarantee that every relevant detail or action will appear.

  1. Open NMLS Consumer Access. Search for the mortgage company using the legal business name or company NMLS ID.
  2. Confirm the company record. Check that the legal name and identifying details correspond to the lender or broker you are dealing with.
  3. Check the state authorization. Look for authorization relevant to the state where the mortgage is being offered. Do not assume that authorization in one state covers business in another.
  4. Repeat the search for the loan officer. Use the officer’s full name or individual NMLS ID, and verify the identity and state information against what the lender provided.
  5. Read the record details. Review employment history and any publicly displayed disciplinary or enforcement information rather than relying only on a headline status.

Federal regulation describes NMLS public-access objectives that include employment history and publicly adjudicated disciplinary and enforcement actions. That does not mean the NMLS record will show every state action or tell you everything needed to judge a company’s conduct. The CFPB’s 12 CFR § 1008.301 page describes those objectives; the CFPB’s consumer guidance also directs borrowers to state regulators for disciplinary orders.

When checking an NMLS number, enter it as supplied and make sure the returned record is for the right type of registrant—the company or the individual. Then compare the legal name, state information and employment details. If the number returns no result, returns a different person or company, or appears inconsistent with the lender’s materials, do not assume that a close name match resolves the discrepancy. Move to the state regulator check and ask the lender to clarify.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Authorization information is tied to the state and relevant business activity. A record that appears valid for one state does not establish permission to make or broker a mortgage in another. Similarly, a record’s existence is not an assessment of the interest rate, fees, service quality or suitability of the loan being offered.

Check the state regulator for license status and disciplinary orders

After the NMLS search, find the appropriate state banking or mortgage regulator and search its records for both the company and the individual. The regulator may provide license information, orders, enforcement actions and instructions for submitting a complaint. Which agency is relevant depends on the state and provider type; use the CFPB’s “How do I find my state’s bank regulator?” directory to identify a state regulator contact.

  1. Find the official regulator contact. Use the CFPB state regulator directory or locate the relevant state agency’s official website independently.
  2. Search both identities. Look up the company and the loan officer by name and, where the site supports it, by license or NMLS ID.
  3. Review the substance of any record. Look for license status, disciplinary orders and enforcement actions. Read the record itself instead of drawing conclusions from a search-result label.
  4. Check the regulator’s complaint instructions. If you need to report a concern, follow that agency’s process and keep copies of relevant documents and communications.

The CFPB advises consumers to check with the appropriate state regulator for disciplinary orders. Its guidance notes that NMLS may show some broker actions, but that is not a reason to skip the state source. Use the two sources together: NMLS helps establish identity and authorization, while state records may add action history or state-specific information.

Do not limit the state search to the company if the concern involves a particular loan officer, or vice versa. Review what the regulator says about the record and its status; a search result or order title may not tell the whole story. If the regulator offers a complaint process, follow its instructions for what to submit and how to contact the agency rather than assuming the CFPB database replaces a state complaint channel.

Interpret a missing license result in context

A missing state-license result is a reason to pause and understand the person’s role and applicable rules; it is not enough on its own to conclude that the person is operating illegally. Some loan originators may be exempt from SAFE Act licensing requirements, including certain employees of depository institutions. The CFPB’s 12 CFR § 1026.36 page, in its January 1, 2024 version, is relevant to mortgage originator requirements, but the applicable regulator and treatment depend on the facts.

Ask the company to explain the person’s legal role and the basis for any claimed exemption. Then verify that explanation with the relevant regulator’s official information. Do not accept a vague assurance as a substitute for checking the identity and regulatory category. If the company cannot explain why a result is absent or inconsistent, contact the regulator using contact details from its official website before proceeding.

The distinction matters because a search is not a complete legal determination. Requirements can vary with the provider’s category and the person’s role; a result that is not displayed in the way you expected needs context. At the same time, an explanation of an exemption should be specific enough that you can ask the relevant regulator whether it fits the situation.

Use CFPB complaint data as a signal, not a score

The CFPB Consumer Complaint Database can help you find complaints about a company and read the consumers’ descriptions and company responses. Search the relevant company name, taking care to distinguish it from similarly named businesses. Read individual entries and look for themes that matter to your situation rather than treating a total count as a quality ranking.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

The CFPB warns that the database is not a statistical sample of consumers’ experiences and that complaints are not necessarily representative of all consumers’ experiences with a financial product or company. The number of complaints can also be affected by company size. A low count does not establish that consumer harm is absent; a high count alone does not establish that a lender acted improperly. Complaint data is most useful as a prompt to investigate recurring issues and how the company responds.

  • Read descriptions and responses: Identify what the consumer says happened and whether the company’s response addresses the issue.
  • Look for patterns: Repeated concerns about a relevant part of the mortgage process may warrant questions or additional checking, but do not assume every entry is verified wrongdoing.
  • Keep scale in mind: Complaint totals are not directly comparable without context such as lender size or market share.
  • Do not infer a clean bill of health: Few or no published complaints do not prove that a lender has no consumer-harm issues.

Complaint counts are not a dependable league table. A larger lender may naturally appear more often in a database than a smaller one, and raw counts do not show how many customers each served or whether the cases are similar. The CFPB cautions that the database is not a representative sample, so neither a low count nor a high count should be used as a stand-alone pass or fail.

Instead, read the complaint narrative and the company response, then ask whether the issue is relevant to your decision. A cluster of similar descriptions can be a reason to ask the lender for an explanation or look for related public regulatory records. One entry should not be treated as a finding that wrongdoing occurred, and a company response is not by itself proof that the concern was resolved to the consumer’s satisfaction.

Assess reputation from multiple kinds of evidence

There is no universal complaint-count threshold or single pass/fail formula for deciding whether a mortgage lender is reputable. Build a view from evidence that answers different questions: whether the identities match, whether the provider is authorized in the relevant state, whether regulators have taken public action, and whether complaints show a pattern that merits follow-up.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

For provider due diligence, compare the same categories across any lenders you are considering:

  • Identity match: Do the legal company name, company NMLS ID, loan officer name and individual NMLS ID agree across the lender’s information and public records?
  • State authorization: Do NMLS and the relevant state regulator show authorization appropriate to the business and location?
  • Regulatory history: Are public disciplinary or enforcement records available, and what do the underlying records say?
  • Complaint context: What issues do consumers describe, how does the company respond, and are there themes that need an explanation?

These checks can help you identify discrepancies and questions; they do not promise future conduct or replace reviewing the loan documents. Keep notes of the records you checked and the date, since public information can change.

Apply the same checks to each provider rather than comparing one lender’s raw complaint count with another’s as if it were a rating. The useful comparison is whether identities match, authorization covers the state and activity, public orders raise questions, and complaint descriptions reveal themes worth investigating. There is no universal weighting that can turn those different kinds of evidence into one reputation score.

Compare Loan Estimates separately from the license check

Once you have checked the provider, compare the actual offers. Request Loan Estimates for the same type of loan from the lenders you are considering. The CFPB’s Loan Estimate explainer points consumers to the form’s Comparisons section to help compare offers and notes that costs differ by lender and loan type.

  1. Make the offers comparable. Compare estimates for the same loan type rather than treating different products as equivalent.
  2. Review the Loan Estimate’s Comparisons section. Use it to evaluate the offers’ costs and terms, as the CFPB recommends.
  3. Ask about differences you do not understand. Have the lender explain a cost or term rather than assuming a lower number means a better overall fit.
  4. Choose based on both checks. Consider authorization and conduct evidence alongside the terms of the specific offer. A favorable regulatory record does not make a loan inexpensive, and a competitive offer does not establish authorization.

Due diligence and offer comparison are separate decisions. The official sources support reviewing identity, authorization, regulatory actions and complaint patterns for provider checks, and comparing Loan Estimates for the loan itself. They do not establish a single weighting formula that determines which lender is best for every borrower.

Keep the offer comparison focused on estimates for the same loan type: otherwise, differences may reflect different products rather than lender pricing. The CFPB specifically points to the Loan Estimate’s Comparisons section as a useful place to compare. If a fee or term is unclear, ask the lender to explain it in the context of that estimate. A lower apparent cost does not automatically mean that the full offer is the best fit, just as a clean authorization check does not tell you whether the offer is competitive.

What to do when information does not match

If a name, NMLS ID, state authorization or contact detail conflicts across the lender’s materials and official records, stop treating the match as verified. Ask the lender for an explanation and confirm the issue with the regulator through contact information found independently on the regulator’s official website. This is a cautious response to an identity or authorization discrepancy; the CFPB sources describe the checks but do not prescribe a specific pause procedure.

Do not rely on a phone number or link in a message that is itself part of the discrepancy. Use official regulator contact details you locate separately. Keep the lender’s explanation and the records you reviewed, so you can describe the mismatch clearly when asking the regulator or submitting a complaint.

Frequently asked questions

How do I check whether my mortgage lender is licensed?

Search the lender’s legal business name or company NMLS ID in NMLS Consumer Access, then check the relevant state regulator’s records for the company and the loan officer. Confirm that the authorization relates to the state where the mortgage is being offered. NMLS is a free starting point; the CFPB says it shows authorization in most cases, and the appropriate state regulator can provide additional state-specific information.

How can I check a loan officer’s NMLS number?

Ask for the officer’s full name and individual NMLS ID, then search using the ID or name in NMLS Consumer Access. Confirm that the returned record belongs to that person and compare its state and employment information with what the lender provided. Also check the company separately; an individual record does not answer whether the business is authorized.

Is NMLS Consumer Access free?

Yes. The CFPB describes NMLS Consumer Access as a free service where consumers can see whether a financial-services company or professional is authorized to conduct business in their state. Use the exact company and individual identities, and confirm details with the state regulator when needed.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

What if a loan officer does not appear to have a state license?

Do not treat a missing result alone as proof that the person is operating illegally. Some originators may be exempt from SAFE Act licensing requirements, including certain employees of depository institutions. Ask the company to explain the person’s role and claimed exemption, then verify the applicable requirements with the relevant regulator.

How do I find complaints or disciplinary actions against a mortgage lender?

Use the CFPB Consumer Complaint Database to read complaint descriptions and company responses, and search the appropriate state banking or mortgage regulator’s records for license status, orders and enforcement actions. NMLS may display some public disciplinary or enforcement history, but it may not show every state action, so check the state source too.

Does a low complaint count mean a lender is reputable?

No. The CFPB says its complaint database is not a statistical sample and may not represent all consumers’ experiences. Company size affects counts, and few or no published complaints do not prove that consumer harm is absent. Read complaints in context and consider them alongside identity, authorization and regulatory records.

Can a licensed lender still offer a bad or expensive loan?

Yes. Authorization and reputation checks do not determine whether an offer is competitive or right for your circumstances. Request Loan Estimates for the same loan type and compare their costs and terms, using the Comparisons section as the CFPB recommends.

The Bottom Line

Verify both the mortgage company and loan officer in NMLS, confirm relevant state records, and read complaints as contextual signals—not as a rating. Then compare Loan Estimates for the same loan type. Licensing, reputation and offer quality are separate questions, and none should substitute for the others.
