For a first appeal under section 107 of the CGST Act against an order demanding penalty but no tax, the amended proviso requires a pre-deposit equal to 10% of the penalty. Multiply the penalty amount in the order by 0.10: a ₹1,00,000 penalty gives a basic pre-deposit of ₹10,000. The Delhi High Court has described this rule as effective from 1 October 2025. The date and type of order matter, however, especially where the show-cause notice was issued before that date.
This is a filing condition, not a requirement to pay the entire penalty before appealing. After the applicable deposit is paid, section 107(7) provides that recovery of the balance is deemed stayed. The practical sequence is therefore to classify the order, identify the statutory rule that applies, calculate the correct base, complete the payment as a pre-deposit, and file within the applicable time.

Calculate the deposit for a penalty-only order
The calculation is:
Pre-deposit = penalty demanded × 10%
Use the penalty amount stated in the order as the percentage base. Do not calculate 10% of the disputed tax for an order that falls under the penalty-only proviso, and do not treat the deposit as payment of the full penalty. It is the statutory amount required to file the appeal.
| Penalty in the order | Calculation | Basic pre-deposit |
|---|---|---|
| ₹50,000 | ₹50,000 × 10% | ₹5,000 |
| ₹1,00,000 | ₹1,00,000 × 10% | ₹10,000 |
| ₹10,00,000 | ₹10,00,000 × 10% | ₹1,00,000 |
These examples show the arithmetic only. First establish that the order is within the penalty-only rule and that this statutory version applies to your case. If the order also demands tax, or the case began before the amendment took effect, the correct route may require a different analysis.

For example, if the operative order demands a penalty of ₹2,40,000 and no tax, the arithmetic under the amended penalty-only proviso is ₹2,40,000 × 0.10, or ₹24,000. The figure is not 10% of an amount of tax that may have been discussed earlier in the proceedings, nor is it automatically 10% of the amount the taxpayer believes is disputed. The order and the applicable statutory version determine the base.
Also distinguish the deposit from the penalty liability itself. Paying ₹10,000 against a ₹1,00,000 penalty is not a settlement of the penalty and does not mean the remaining ₹90,000 has been cancelled. It satisfies the stated pre-deposit condition for the appeal if the penalty-only proviso applies and the payment has been completed in the required manner. The appeal continues to challenge the underlying order.
What counts as penalty-only
The amended proviso applies to an order demanding penalty without involving a demand of any tax. Read the operative order and its demand carefully: the label on the case or the fact that the dispute began with a penalty notice does not by itself settle what the order demands. If the order includes a tax demand as well as a penalty, do not use the penalty-only formula without checking the provision applicable to that mixed demand.
The Tool Desk
Outbyte Driver Updater FREEScan for outdated or missing drivers - takes under a minuteDriver Scan →Outbyte PC Repair FREERepair Windows errors before they cause bigger problemsFix Now →A useful first question is not simply, “Is there a penalty?” but, “What does the appealable order require the taxpayer to pay?” Separate the components that the order actually demands. An order that imposes a penalty alone presents a different calculation question from one that demands tax and also imposes a penalty. Where the document or its operative directions are unclear, do not infer the category from a short heading or from a description used elsewhere in the case file.
The distinction matters because the percentage base changes. In the penalty-only path, the amended proviso measures the deposit against the penalty. In the former general path, the calculation involved admitted dues and the remaining disputed tax. Applying one base to the other category can produce a materially different figure, so classification should come before arithmetic.
Is there a ceiling?
The Delhi High Court’s 2026 judgment describes the substituted penalty-only proviso as prescribing 10% of the penalty without a ceiling. That contrasts with the former general rule’s capped percentage of disputed tax. Because this point depends on the operative statutory text and any subsequent amendment, verify the provision in force when you file rather than assuming that the tax-demand cap also limits a penalty-only deposit.
Do not treat the absence of a ceiling described by the court as a reason to skip checking the current text. It means the judgment distinguishes the penalty-only percentage from the capped disputed-tax calculation; it does not remove the need to confirm that the penalty-only proviso governs the particular order. The larger the penalty, the more important it is to verify both the applicable provision and the amount in the operative demand before making payment.

Choose the right statutory calculation
The central distinction is the amount on which the percentage is calculated. For the penalty-only category, the base is the penalty. Under the former general pre-deposit rule, the calculation was structured around admitted dues and disputed tax. Those are not interchangeable formulas.
| What the order involves | Calculation approach | Practical caution |
|---|---|---|
| Penalty demanded, with no tax demand, and amended proviso applies | 10% of the penalty amount | Check the effective date and whether the notice-to-order timeline raises a transition issue. |
| Tax demand is also involved | Do not automatically apply 10% of penalty. The former general rule described in the authorities required admitted tax, interest, fine, fee and penalty in full, plus 10% of the remaining disputed tax, subject to the statutory ceiling. | Confirm the operative law for the specific order and appeal; the older formula should not be assumed to state the current rule for every mixed-demand case. |
| Order under the earlier penalty-specific provision | The earlier penalty-specific proviso concerned orders under section 129(3). | Do not assume that this earlier provision and the substituted penalty-only proviso cover the same orders or dates. |
The table is a decision aid, not a substitute for reading the order and applicable statutory text. In particular, the legacy formula is included to explain why a penalty-only calculation should not be confused with a tax-demand calculation; it should not be treated as a blanket statement of current law for mixed orders.
For a mixed order, the facts supplied here do not support simply adding the new 10% penalty-only formula to the old disputed-tax formula or assuming that the older approach remains unchanged. The amended penalty-only proviso is a distinct route, and the earlier general rule had its own components and ceiling. It does not establish a universal current calculation for every combination of tax and penalty. Check the operative statutory text as it stands for the filing and the relevant order rather than constructing a hybrid calculation.
This is also why the earlier section 129(3) penalty-specific proviso should not be treated as a synonym for the substituted penalty-only rule. The fact that both concern penalties does not establish that they cover the same kind of order, share the same effective date, or use the same calculation. Identify the provision under which the order was made and the pre-deposit language that applies before relying on a formula.

Check whether the 1 October 2025 amendment applies
The Delhi High Court describes the substituted proviso as having come into force on 1 October 2025. That date is important, but a case with a pre-amendment show-cause notice and a later penalty order cannot necessarily be resolved by looking at the order date alone.
In Gaurav Jain & Anr v Joint Commissioner (Appeals-II) CGST, the show-cause notice was issued on 25 June 2025 and the penalty order followed on 16 December 2025. The court held on those petitioners’ facts that the substituted proviso did not govern their appeals because the adjudicatory proceedings had begun before the amendment. It left the constitutional challenge open and did not decide the merits of the penalties. This is a fact-specific High Court ruling, not a nationwide resolution of every transition dispute.
The judgment matters because the dates point in different directions: the notice preceded the effective date, while the penalty order came after it. The court’s treatment of that sequence shows why “the order is dated after 1 October 2025” is not, by itself, a complete answer to which pre-deposit rule applies. It does not mean every case with an earlier notice must be treated identically; jurisdiction, procedural history and later binding law may matter.

The decision also did not decide whether the challenged penalties were substantively correct. Its transition holding should not be read as a ruling on the merits of any penalty, nor as a conclusion that the constitutional challenge was accepted or rejected. The challenge was left open. Keep the question of which pre-deposit rule governs separate from the question of whether the penalty order itself is valid.
Make a three-date timeline
- Find the show-cause notice date. This shows when the adjudicatory proceedings began and whether that date precedes 1 October 2025.
- Record the order date. Compare it with the effective date, but do not assume a later order alone determines which pre-deposit rule applies.
- Record the date the appeal will be filed. The transition arguments discussed in the judgment include whether the relevant date is commencement of proceedings or the date of appeal.
- Compare the facts with current authority in the relevant jurisdiction. Where the notice predates 1 October 2025 but the order or appeal comes later, get qualified advice on the transition issue before settling the deposit calculation.
This date check is especially important where applying the amended 10% penalty formula or the earlier treatment would materially change the amount required to appeal. The cited judgment does not establish a universal answer for every combination of notice, order and appeal dates.
A practical way to use the timeline is to write the dates next to each other rather than relying on memory: notice issued, order communicated or made, and intended appeal filing. The effective date falls between some taxpayers’ notice and order dates, as it did in Gaurav Jain. Keep the notice and order available when seeking advice so the issue can be assessed against the actual sequence, not just a general statement that the case is “old” or “new.”
Do not delay the appeal deadline while the transition question is being examined. The applicable deposit and the date by which the appeal must be filed are distinct issues. If there is uncertainty about which calculation to use, obtain advice promptly enough to resolve it while preserving the ordinary filing period.
Complete the appeal payment correctly
Calculating the right figure is only part of the filing condition. Section 107(6) makes payment of the applicable pre-deposit a condition for filing the first appeal. Section 107(7) provides that, once the applicable deposit is paid, recovery of the balance is deemed stayed. The deposit is therefore not the same as paying the whole penalty, but it must be completed in the required manner.

- Use the prescribed payment process for the appeal. Follow the current GST portal and payment instructions applicable to your filing. The authority cited here does not establish a current portal menu path, so do not rely on an assumed label or an outdated walkthrough.
- Check the ledger transaction itself. A balance appearing in the electronic cash ledger may not be enough if it has not been debited as the appeal pre-deposit.
- Verify the appeal record before submission. Confirm that the pre-deposit is reflected as paid for the appeal, retain the payment details, and check for any portal or filing acknowledgement showing completion.
In Ssukrit Forwarding Agency, the Jharkhand High Court considered a case in which the amount was visible in the electronic cash ledger but had not been debited. In the circumstances before it, the court said the taxpayer should have been notified of the defect and given reasonable time to cure it. That is a procedural lesson from that case, not permission to leave the required amount undebited or a guarantee that a defect will always be curable.
The distinction is between funds being present in a ledger and the appeal pre-deposit being completed. A ledger balance may show that money is available, but the Jharkhand case concerned an amount that had not been debited as required. Do not assume that the authority will infer or apply the balance automatically. Check the transaction record for the actual debit or other record that identifies the amount as the pre-deposit for the appeal.

If the record does not show the intended payment, address the discrepancy promptly. The court’s observation that the taxpayer in Ssukrit Forwarding Agency should have received notice and reasonable time to cure the defect arose in the circumstances of that case. It is not a substitute for completing the payment correctly at the outset. Retaining the transaction details and checking the appeal record before submission can help identify a problem while there is still time to act.
No specific portal menu sequence can be stated here. GST portal interfaces and instructions can change, and the authority discussed here does not verify a current screen-by-screen process. Use current portal directions for the actual filing, then verify that the pre-deposit is attached to or recorded for the appeal rather than relying only on a cash-ledger balance.

1Clear out junk files and repair common Windows errors2Scan for outdated or missing drivers - takes under a minute3Repair Windows errors before they cause bigger problemsMeet the first-appeal deadline
Section 107 provides an ordinary period of three months from communication of the decision or order to file the appeal. The Appellate Authority may allow a further period of one month if sufficient cause is shown. The possible extension is not automatic: plan to file within the ordinary period and keep evidence of when the decision or order was communicated.
Do not wait until the deadline is close to resolve a disputed transition date, calculate the pre-deposit, or correct a payment-record issue. A filing deadline and the pre-deposit condition are separate requirements: an extension of time to appeal does not itself establish that the deposit is correct, while paying the deposit does not itself extend the filing period.
Start the time calculation from communication of the decision or order, not merely from the date printed on it. Record when and how it was communicated and retain evidence of that date. The ordinary period is three months; the further month is a possible allowance by the Appellate Authority where sufficient cause is shown, not an extra month that every appellant can assume is available.
The deadline calculation is especially important if an appellant is deciding which statutory deposit applies. The transition issue may require checking the notice date and relevant authority, but that inquiry does not pause the appeal period. Likewise, a payment made within the period does not by itself amount to filing an appeal. Treat the payment, the appeal submission and the evidence of communication as separate items to verify.
Pre-filing checks
- Read the demand, not just the case heading. Verify whether the order demands penalty alone or also includes tax.
- Use the right percentage base. The amended penalty-only rule uses the penalty amount; the former general approach was based on admitted dues and disputed tax.
- Check the transition timeline. Note the notice date, order date and intended appeal date, particularly when the notice predates 1 October 2025.
- Confirm payment completion. Ensure the amount has been debited or otherwise recorded as the required appeal pre-deposit, rather than merely remaining as an electronic cash ledger balance.
- Track the communication date. Calculate the ordinary three-month period from communication of the order and treat any further month as discretionary relief for sufficient cause.
- Verify current law before relying on an older summary. The CBIC Act page and FAQ identified in the source record reflect earlier general pre-deposit language and predate the penalty-only amendment. Check the operative statutory text and current binding law before filing or advising on a case.

When to seek case-specific advice
Professional GST appellate advice is particularly useful if the order includes both tax and penalty, the show-cause notice was issued before 1 October 2025 but the order or appeal is later, or the payment is shown in a ledger without a clear pre-deposit debit. The Delhi High Court left the constitutional challenge open, and its transition ruling turned on the facts before it. A substantial penalty or a jurisdiction-specific dispute warrants checking the current statutory text and binding authority rather than relying on a general percentage calculation alone.
There is no single provider or product that follows from these rules. Where advice is needed, the relevant category is qualified Indian GST appellate representation or tax-law consultation, particularly for a contested effective-date question or a substantial penalty. Any choice of adviser should be made on the basis of the specific matter and applicable jurisdiction; a generic calculator or software recommendation does not resolve which statutory path applies.
The official CBIC Act page and FAQ located for the earlier general rule predate the penalty-only amendment and reflect earlier language. The current percentage and effective date are described in the 2026 Delhi High Court judgment quoting and interpreting the substituted proviso. Before relying on either an older summary or a case-specific transition conclusion, check the operative statutory text and current binding law in the relevant jurisdiction. The court left the constitutional challenge open.

Frequently Asked Questions
How much is the pre-deposit for a GST penalty-only appeal?
If the amended penalty-only proviso applies, the pre-deposit is 10% of the penalty demanded in the order. For example, a ₹1,00,000 penalty produces a basic deposit of ₹10,000. This is a filing condition, not payment of the entire penalty.
Do I calculate 10% of the tax or 10% of the penalty?
For an order demanding penalty without any tax demand under the amended proviso, calculate 10% of the penalty. Do not use that formula automatically for a mixed order involving tax; the relevant statutory route and percentage base need to be checked.
When did the 10% penalty-only rule take effect?
The Delhi High Court’s 2026 judgment describes the substituted proviso as effective from 1 October 2025. A notice issued before that date followed by a later order or appeal can raise a transition issue, so the date alone may not settle the applicable rule.
What did the Delhi High Court decide in Gaurav Jain?
The show-cause notice in that case was issued on 25 June 2025 and the penalty order followed on 16 December 2025. On those petitioners’ facts, the court held that the substituted proviso did not govern their appeals because proceedings began before the amendment. It left the constitutional challenge open and did not decide the merits of the penalties; the ruling is not a nationwide answer to every transition case.

Is money in the electronic cash ledger enough to count as the appeal pre-deposit?
Not necessarily. In Ssukrit Forwarding Agency, the amount appeared in the ledger but had not been debited as the pre-deposit. The Jharkhand High Court said, in that case’s circumstances, the taxpayer should have been notified and given reasonable time to cure the defect. Do not rely on that as permission to leave the payment undebited; verify that the transaction is recorded for the appeal.
How long do I have to file a first appeal under section 107?
The ordinary period is three months from communication of the decision or order. The Appellate Authority may allow a further month where sufficient cause is shown, but that extension is not automatic. Keep evidence of the communication date and do not treat payment of the deposit as an extension of the filing period.
The Bottom Line
For a first appeal against an order demanding penalty without tax, the amended section 107 proviso sets the pre-deposit at 10% of the penalty if that rule applies to the case. First check the order’s demands and the applicable statutory version, especially where the show-cause notice predates 1 October 2025. Then make sure the amount is recorded as the appeal pre-deposit and file within three months of communication; a further month is discretionary relief for sufficient cause.
