Build trust in a yacht purchase by verifying each part of the deal independently: who the broker represents, what condition the vessel is in, whether the seller can transfer clear title, what the contract requires, and how the deposit and closing funds will be handled. A broker can coordinate the transaction, but a buyer-selected surveyor and buyer-side maritime lawyer provide separate checks. The rules and documents depend on the yacht’s flag and the transaction’s jurisdiction.
Start by verifying the people and the vessel
Before making an offer, establish who is involved and what, exactly, is being sold. Ask the broker for their legal name and business, their role in the transaction, and whom they represent. Ask about relevant yacht-sale experience and professional affiliations, then verify any required licence or registration with the applicable regulator. Memberships and credentials can help you assess a professional, but do not guarantee the yacht’s condition or the safety of the deal.
Rules are local, not universal. For example, California State Parks directs consumers to a state yacht-broker directory. That is a California resource, not a way to verify brokers everywhere. Check the regulator for the location where the broker is required to be licensed or registered, and ask a lawyer familiar with the transaction’s jurisdiction if you are unsure which rules apply.
Request the yacht’s identifying and ownership details early: its name, hailing port, hull identification number, registration or documentation number, and current owner. These are among the identifying details the American Boat & Yacht Council (ABYC) says a condition-and-valuation survey should include. Compare the information across the listing, registration or documentation records, survey, contract, and closing papers. A mismatch is a reason to pause and get an explanation before sending money.

Choose your own surveyor and agree on the inspection scope
Hire an independent marine surveyor selected by you—not simply the person recommended by the seller or broker. ABYC says marine surveyors are not licensed or regulated as an industry. It also says surveyors are, by industry standards, “supposed to be impartial and unbiased.” Treat that as a professional expectation, not a guarantee: check relevant credentials, references, experience with the yacht’s type and systems, and any requirements set by your lender or insurer.
Ask the lender and insurer about their surveyor requirements before commissioning the work. ABYC notes that many lenders and insurers require a credentialed member of the National Association of Marine Surveyors (NAMS) or the Society of Accredited Marine Surveyors (SAMS). An association credential can be useful screening evidence, but it does not replace checking the individual surveyor’s fit for the assignment.
Be clear about the kind of report you need. ABYC describes a prepurchase survey as typically a comprehensive condition-and-valuation survey, often including operational testing and a sea trial. An insurance-only survey may be more limited and may not provide enough information for a purchase decision. A useful written report should identify the vessel, describe its construction and systems, explain overall and detailed condition, record needed repairs or corrections, include relevant photographs, and state fair market value when applicable.

California State Parks recommends a sea trial or survey before finalizing a sale. Whether a sea trial is possible and what it covers depend on the yacht, the contract, and the practical arrangements. Put inspection access and scope in writing before the survey begins.

- Define access, testing, haul-out or other inspection arrangements, and whether a sea trial is included.
- Set the survey-report delivery date and the deadline for exercising any survey contingency.
- Specify who pays for the survey, haul-out, and any corrective work. Do not assume the seller will pay for repairs simply because the report identifies them.
- Ask the surveyor to distinguish safety-critical findings from deferred maintenance and cosmetic work, and to explain technical terms you do not understand.
Make the contract say what happens when the survey finds problems
A survey is useful only if the agreement gives you a clear way to act on its findings. Have independent buyer-side counsel review the purchase agreement and closing documents; do not assume a standard form fits every vessel, flag, seller structure, or jurisdiction.
Before signing, make sure the agreement addresses the price, deposit holder, release conditions, inspection and sea-trial rights, acceptance or rejection, delivery, title, liens, closing documents, and deadlines. In particular, read the survey contingency closely: it should make clear how and when you may accept, reject, or seek an agreed change after inspection. The available choices and consequences are contract-specific; do not rely on an informal assurance that you can “walk away” or that the seller will fix defects.

If the report identifies a problem, compare it with the contract and deadline, then ask your lawyer how to give any required notice. You may negotiate a repair, price adjustment, or other written change if the parties agree. Record any agreement in a signed amendment rather than relying on a conversation. If a finding is serious or the remedy is unclear, do not waive the contingency or authorize release of funds until you understand your contractual position.
Check title and liens with advice suited to the vessel
Ask buyer-side maritime counsel what title search is appropriate for the yacht’s flag and registration system. A transcript or abstract of title can show recorded ownership interests, mortgages, or liens, but it may not reveal every claim. The International Yacht Brokers Association (IYBA), in a 2017 article on warranties of title, explains that unrecorded maritime liens can arise from claims such as unpaid crew wages, repairs or materials, or personal injury.
That limit matters: a clean-looking record search is not proof that no unrecorded claim exists. Ask counsel and the closing agent what additional evidence is appropriate for the circumstances, such as written confirmations or releases from crew, managers, yards, or refit contractors where relevant. The right checks depend on the vessel and its history; a search or document that works in one flag system may not resolve the same question in another.

Require a clear warranty of title and a documented plan to satisfy recorded liens at or before closing. If the seller is a company or another entity, have counsel verify that it owns the yacht and identify who has authority to sign. Ask whether the warranty gives you meaningful recourse if it proves false and whether additional protections, such as a beneficial-owner guarantee, are appropriate. Stephanie Kline, writing for IYBA, advises buyers to obtain their own independent legal representation when purchasing from an entity seller.

Before transferring a deposit, identify who will hold it, where it will be held, and the exact written instructions governing release or return. The agreement should explain what happens if survey, sea-trial, title, or documentation conditions are not met, and who must authorize a release. Confirm the holder and instructions directly with the named closing professional using independently verified contact details; do not rely only on changed payment instructions sent by email.
Check the rules that apply to the broker and the funds. As a jurisdiction-specific example, Florida Statutes section 326.005 addresses trust accounts for covered broker-held transaction funds and itemized closing statements. It is not a global rule, and it does not establish the requirements for a transaction governed elsewhere. Have local counsel or a qualified closing professional confirm whether the proposed arrangement complies with the governing law and the actual escrow agreement.

Use a controlled closing, not a last-minute promise
Before authorizing release of closing funds, reconcile the closing statement against the contract and confirm that the agreed documents and signatures are in order. Depending on the transaction, these may include the bill of sale, lien releases, title or ownership-transfer documents, registration or documentation transfer, and any required certificates. The International Maritime Organization explains that vessel surveys and certification operate under flag-state and relevant convention frameworks; ask a specialist to identify which requirements apply to this yacht rather than assuming every vessel has the same certificates.
Keep the closing sequence explicit: determine which documents must be signed or delivered, which liens must be paid or released, who confirms satisfaction of each condition, and when the escrow holder may disburse funds. The closing statement should show the agreed amounts and disbursements. If a document is missing, a signature is unauthorized, or a lien release is not available as required, stop and ask the closing professional and your lawyer how to proceed under the agreement.
