How to Appeal a Social Security Overpayment Notice and Request a Lower Withholding Rate

A Social Security overpayment appeal, waiver, and lower withholding request solve different problems. Choose the right SSA form and understand the separate collection and appeal timelines.

If you got a Social Security overpayment notice, first decide whether you dispute the debt, want SSA to excuse recovery, or accept repayment but need smaller deductions. Those are different requests: use Form SSA-561 to challenge whether an overpayment occurred or its amount, Form SSA-632-BK to ask for a waiver, and Form SSA-634 to request a lower recovery rate. Pay close attention to two separate timing rules: SSA says a waiver or appeal filed within 30 days can pause collection while it decides the request, while an appeal is generally due within 60 days after you receive the notice.

Choose the request that matches your situation

An overpayment notice can raise three different problems. The right form depends on which one you are asking Social Security Administration (SSA) to address. A lower withholding rate does not challenge or erase the debt; an appeal does not, by itself, explain that you cannot afford repayment. If more than one issue applies, state each request separately and use the form for each one.

Your concern What to request SSA form What it addresses
You believe you were not overpaid, or the amount is wrong. Reconsideration, also called an appeal. SSA-561, Request for Reconsideration Whether SSA’s overpayment decision or calculation is correct.
You accept that SSA says there is a debt, but believe it should not collect it. Waiver of recovery. SSA-632-BK, Request for Waiver of Overpayment Recovery Whether you were at fault and whether repayment would be unaffordable or otherwise unfair.
You accept repayment but cannot manage the proposed monthly deduction. Change in recovery rate. SSA-634, Request for Change in Overpayment Recovery Rate How much SSA should recover from your benefits each month.

Think of the options as answering different questions. Reconsideration asks whether SSA’s finding or calculation is right. A waiver asks whether recovery should be excused based on fault and the effect or fairness of repayment. A rate-change request accepts repayment but asks SSA to collect it at a more manageable pace. Selecting a form that addresses only one question may leave your other concern unaddressed.

Appeal a decision or amount you think is wrong

Use SSA-561 if your disagreement is about the underlying overpayment determination: for example, you believe SSA has counted the wrong period, used incorrect information, or arrived at the wrong total. Explain the specific part you believe is inaccurate and why. The point of this request is to have SSA reconsider its determination, not simply to negotiate a more manageable deduction.

Be direct about whether you challenge the existence of an overpayment, its amount, or both. If the notice includes a period and reason, refer to the part you think is mistaken. A general statement that the bill is too high may not make clear whether you dispute the calculation or simply need a lower monthly recovery amount.

Ask SSA to waive recovery

Use SSA-632-BK if you are asking SSA not to recover the overpayment. SSA’s guidance describes waiver as an option when you believe you were not at fault and cannot afford repayment, or when recovery would be unfair for another reason. Explain both why you believe you were not at fault and the financial or other circumstances that make recovery unaffordable or unfair. If your objection is instead that SSA made a mistake about whether you were overpaid or how much you owe, the current waiver form directs you to use SSA-561 for that dispute.

A waiver request is not the same as an admission that every detail of the notice is correct. It is the request for SSA to excuse recovery. If you also believe SSA calculated the debt incorrectly, make that disagreement clear through reconsideration as well, rather than relying on the waiver form to resolve it.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Ask to lower the monthly withholding

Use SSA-634 if you accept repayment but need SSA to take less from your benefits each month than the proposed rate. Describe the monthly amount you believe you can pay and the circumstances behind that amount. SSA treats this as a request to change the repayment rate, not as a challenge to whether the debt exists. SSA says you can submit the request through a my Social Security account and that it will send a decision notice.

For example, if you agree that SSA overpaid you but the proposed deduction would be difficult to manage, explain the amount you believe you can pay each month. Do not call that request an appeal unless you also dispute the overpayment finding or amount. SSA will decide whether to change the rate; requesting a particular amount does not guarantee approval or cancel the balance.

Read the notice and record the facts before filing

Keep the complete notice, including any pages with appeal, waiver, repayment, or withholding instructions. The notice is the best place to confirm what kind of benefit is involved, the dates SSA is using, the proposed collection method, and how to send your request. Federal regulations require an overpayment notice to explain the amount and how it arose, recovery options, and the person’s appeal and waiver rights. If something is unclear or missing, contact SSA rather than guessing at the agency’s calculation.

  • Notice date and receipt date: Record both if you can. The collection window is described in relation to the notice date, while SSA’s general appeal period is described in relation to receipt.
  • Program and benefit: Note whether the notice concerns Social Security benefits under Title II or Supplemental Security Income (SSI). Do not assume the same withholding percentage applies to both.
  • Overpayment period and reason: Write down the months involved and SSA’s explanation of why it says the payments were too high.
  • Amount and recovery proposal: Record the stated debt, how SSA proposes to recover it, and the monthly withholding or other collection method mentioned.
  • Instructions and deadlines: Mark any filing directions and dates printed on the notice. Keep those instructions with your copy of any form you submit.

Organizing these details helps you identify whether your request concerns the facts, fairness of recovery, or affordability of the monthly deduction. It also gives you a focused way to explain the problem instead of sending an unlabelled statement that leaves SSA to infer what decision you want reviewed.

Use the notice as the starting point, not a substitute for your own records. Compare its stated period and amount with the information you have, and note any point you cannot verify. The notice is required to explain how the overpayment arose and what options are available, but you should not assume an unclear item means SSA has already resolved a question you meant to raise. Keep the original and work from a copy if you need to mark it.

Understand the 30-day collection window and 60-day appeal period

There are two different clocks, and one does not replace the other. SSA’s general overpayment guidance says it waits at least 30 days after sending a notice before collection begins. If you file a waiver or appeal within that 30-day period, SSA says it will not collect while it decides the request. Separately, SSA’s May 2024 Overpayments Fact Sheet says an appeal is generally due within 60 days after you receive the original notice.

That means a person appealing an overpayment should not treat the 60-day appeal period as permission to wait 60 days without consequences for collection. The 30-day period concerns whether collection is paused during review; the 60-day period is SSA’s general deadline for appealing. If you are close to either date, act as quickly as possible, follow the instructions on your own notice, and retain evidence of when and how you submitted the request. The 30-day pause described by SSA applies to timely waiver or appeal requests; the available guidance does not state that a rate-change request alone creates the same pause.

If you are deciding between a waiver and an appeal, do not let that decision consume the time available for a request. Identify the issue as clearly as you can, use the corresponding form, and follow the notice’s filing directions. The general figures are useful for understanding the different timelines, but the notice for your case contains the specific instructions to follow.

Complete the form and make your request specific

SSA’s forms directory lists SSA-561, SSA-632-BK, and SSA-634. Start with the form that matches your goal, then use the notice and your records to make the explanation precise. Use plain language. Identify the determination or deduction you are responding to, say what you want SSA to do, and explain the facts supporting that request.

For an appeal using SSA-561

  • Identify the overpayment decision you are challenging.
  • State whether you dispute that an overpayment occurred, the amount, or both.
  • Point to the period, information, or calculation you believe is wrong and explain the correction you believe SSA should consider.
  • Attach or provide relevant records if you have them, and keep a copy of everything sent.

Do not use SSA-634 as a substitute if you believe SSA has no valid debt or calculated the wrong amount. A request for a smaller deduction addresses repayment pace, not the accuracy of the overpayment determination.

For a waiver using SSA-632-BK

  • Explain why you believe you were not at fault for the overpayment.
  • Describe why repayment would be unaffordable or, if applicable, what makes recovery unfair for another reason.
  • Give a clear account of your circumstances and answer the form’s questions with the information it requests.
  • If you also dispute whether the debt exists or its amount, make that a separate reconsideration request on SSA-561.

SSA says a waiver may be requested at any time. That does not mean a waiver is automatically granted: SSA reviews the request and makes a decision. If you need a collection pause while the request is considered, the timing rule SSA describes is tied to filing within 30 days.

For a lower rate using SSA-634

  • Say clearly that you accept repayment but are asking SSA to reduce the recovery rate.
  • Identify the monthly amount you believe you can manage and explain the circumstances behind it.
  • Submit through my Social Security if you use the online option, or follow the submission instructions available from SSA or on your notice.
  • Watch for SSA’s decision notice; submitting the request is not a guarantee that SSA will approve the amount you proposed.

Keep the purpose of your explanation consistent with the form. For a reconsideration, explain the alleged error. For a waiver, explain fault and why recovery should be excused. For a rate change, explain what monthly amount you believe you can manage. Mixing these arguments without clearly stating what decision you want can make it harder to tell which action you are asking SSA to take.

Submit the request through an official SSA channel

SSA provides online submission options for these forms, including completing a form online or uploading a completed PDF where that option is offered. Its waiver guidance also describes mailing or faxing the completed waiver form to a local Social Security office and making an appointment. Available channels can vary by form and case, so confirm the current option on SSA’s official form or service page, or use the directions on your notice. Do not send sensitive personal information through an unverified channel.

  1. Check the form and route: Confirm that you have the correct form and that the online, upload, mail, or fax method is available for your request.
  2. Review the completed request: Make sure it identifies the specific outcome you want and includes the information requested on the form.
  3. Keep a complete copy: Save the notice, the submitted form, attachments, and any confirmation or other proof of submission.
  4. Follow up using SSA’s directions: If you need help completing or submitting an appeal or waiver request, SSA offices can assist. Use the contact or appointment instructions provided by SSA.

When you have more than one concern, label each request rather than assuming one form covers everything. For instance, someone who disputes the amount and also cannot afford the proposed withholding may need to explain the dispute on SSA-561 and separately request a manageable recovery rate on SSA-634. Someone who believes recovery should be excused may need SSA-632-BK, with a separate SSA-561 if the underlying amount is also contested. Preserve submission proof for each request.

SSA’s official pages and your notice are the places to verify the current form and submission route. The online option may allow you to complete a form or upload a completed PDF when offered; mailing or faxing is described for waiver requests through the local office. Do not assume that every route applies to every form. If you are uncertain, use SSA’s office assistance or the contact information on your notice to confirm how to submit it.

Know what may happen if you do not respond

SSA’s general “Resolve an Overpayment” guidance says that if a person does not repay within 30 days, SSA automatically withholds 50% of a Social Security benefit or 10% of an SSI payment each month until repayment. These are SSA’s general published descriptions, not a prediction of what will happen in every case. The program involved and the terms of the individual notice matter, and SSA also publishes SSI-specific recovery guidance.

For people no longer receiving benefits, SSA says collection may involve tax refunds, certain state payments, or wage garnishment. The notice and applicable program rules determine what collection options apply to a particular debt. If you received a notice and cannot repay as proposed, use the relevant SSA request rather than assuming that inaction will produce a lower amount.

Not receiving benefits now does not make the notice irrelevant. SSA’s general guidance describes collection methods beyond deductions from a current benefit, including tax refunds, certain state payments, or wage garnishment. Check the notice for the method SSA says may apply to your case, and contact SSA if you need to understand which request addresses your situation. Do not treat the general list as a statement that every method will be used in every case.

Social Security and SSI withholding are not interchangeable

SSA’s general resolve page describes a 50% withholding rate for Social Security benefits and a 10% rate for SSI payments in its explanation of what can happen when an overpayment is not repaid. Those figures are not a universal rate to apply to every notice or a substitute for reading the notice. The same agency maintains separate SSI-specific recovery guidance. Confirm whether the overpayment is for Title II Social Security or SSI, and follow the program-specific directions that apply to your case.

If you need lower deductions, Form SSA-634 is the identified request for a change in overpayment recovery rate for a person currently receiving benefits. Describe what monthly payment you can manage; do not assume that a rate published in general guidance is the amount SSA will withhold in your particular case.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

This distinction matters even when both notices use the word “overpayment.” The general recovery percentages are SSA’s descriptions for Social Security benefits and SSI, respectively; they should not be combined into one rule. Read the benefit program identified on your notice and use its instructions. If the notice or your records leave the program unclear, ask SSA to clarify before relying on a percentage you saw elsewhere.

Quick decision checklist

  • Wrong debt or wrong total? File SSA-561 to request reconsideration.
  • Debt accepted, but recovery should be excused? File SSA-632-BK and explain why you were not at fault and why recovery would be unaffordable or unfair.
  • Debt accepted, but proposed monthly deductions are too high? File SSA-634 and explain the lower monthly amount you can manage.
  • Need a collection pause during review? SSA says a waiver or appeal filed within 30 days prevents collection while it decides that request; the general appeal period is 60 days from receipt.

Frequently Asked Questions

How do I appeal a Social Security overpayment notice?

Use Form SSA-561, Request for Reconsideration, if you believe SSA did not overpay you or calculated the amount incorrectly. Explain what part of the determination you dispute and why. SSA’s May 2024 Overpayments Fact Sheet says an appeal is generally due within 60 days after you receive the original notice; follow the directions on your notice.

Can I ask SSA to waive an overpayment?

Yes. SSA identifies Form SSA-632-BK for requesting a waiver of recovery and says a waiver may be requested at any time. Explain why you believe you were not at fault and why repayment would be unaffordable or recovery otherwise unfair. SSA reviews the request and makes a decision; a waiver is not automatic.

Can Social Security take less from my check?

If you accept repayment but cannot manage the proposed monthly deduction, request a change in recovery rate using Form SSA-634. Explain the monthly amount you believe you can pay and your circumstances. SSA says the request can be submitted through my Social Security and that it will send a decision notice.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Does filing within 30 days give me 60 days to appeal?

No. They are separate timing rules. SSA says a waiver or appeal filed within 30 days can stop collection while it decides the request. Separately, SSA’s general appeal period is 60 days after receipt of the notice. The 30-day collection window does not replace the appeal deadline.

Will a lower withholding request erase the overpayment?

No. SSA-634 asks SSA to change the recovery rate, or how much it collects each month. It does not challenge whether the debt exists or its amount, and it does not itself erase the balance. Use SSA-561 for a dispute about the overpayment finding or calculation.

Are the same withholding percentages used for Social Security and SSI?

Do not assume so. SSA’s general resolve page describes 50% withholding for Social Security benefits and 10% for SSI payments, and SSA also provides separate SSI recovery guidance. Check the program and instructions in your own notice.

The Bottom Line

Match your request to the issue: SSA-561 challenges whether you were overpaid or the amount, SSA-632-BK asks SSA to waive recovery, and SSA-634 asks for a lower monthly recovery rate. Keep the 30-day collection pause and general 60-day appeal period separate, follow the instructions on your notice, and save proof of every submission.
