How to Appeal a Social Security Overpayment Decision and Request a Waiver

Dispute the overpayment decision with reconsideration, ask SSA to excuse repayment with a waiver, or request a lower recovery rate if the amount is unaffordable.

If you think Social Security got the overpayment decision or amount wrong, request reconsideration, generally within 60 days of receiving the notice. If you agree that you were overpaid but believe you should not have to repay the money, request a waiver. If you accept the debt but cannot afford the current recovery rate, ask SSA to change that rate. These are different requests, and choosing the one that matches your problem is the first step.

The key distinction is whether you dispute the debt itself, want SSA to excuse recovery, or need a more manageable repayment amount. The notice explains why SSA believes you were overpaid and how to repay. Read it closely, note its deadline and instructions, and contact SSA promptly if you are unsure which route fits or if recovery has begun.

Choose the request that addresses your problem

Read the notice and decide what you are challenging: whether an overpayment exists, the amount SSA says you owe, or recovery of a debt you accept. The forms are not interchangeable.

Your position Request Form or route
“I was not overpaid,” or “the amount is wrong.” Reconsideration appeal Form SSA-561; SSA also describes an online non-medical appeal and ways to submit the form to a local office.
“I was overpaid, but I should not have to repay it.” Waiver of recovery Form SSA-632-BK in most cases; SSA describes online completion and upload, as well as mail, fax, and appointment options.
“I agree I owe it, but the current recovery amount is unaffordable.” Request to change the recovery rate Form SSA-634.

SSA’s waiver form is for someone who believes they were not at fault and cannot afford repayment, or believes repayment would be unfair for another reason. If you dispute that an overpayment occurred or disagree with the calculation, the form directs you to use SSA-561 instead.

One way to choose is to ask three questions in order: Do I believe SSA made an error about whether I was overpaid or how much I owe? If yes, reconsideration addresses that decision. If I accept that the overpayment occurred, do I believe I should not have to repay it because I was not at fault and repayment would cause hardship, or because recovery would otherwise be unfair? If yes, consider a waiver. If I accept the debt and am not asking SSA to excuse it, is the current rate too high for me to manage? Ask about a change in recovery rate. These routes focus on different issues, even though the circumstances behind them may overlap.

Reconsideration challenges the decision

Use reconsideration when the issue is the underlying overpayment decision: for example, whether SSA counted the right payments, used the correct amount, or had the facts wrong. State exactly what you believe is incorrect and why. A request for reconsideration asks SSA to review its decision; it is not the same as asking SSA to excuse collection of a debt you accept.

Keep the explanation tied to the decision you received. Identify whether you believe there was no overpayment or whether you disagree with the amount. Then explain the facts that support that position. A bare statement that you disagree may not explain what SSA should review. If there is more than one disputed issue, make each one clear rather than treating the notice as a single unexplained total.

A waiver asks SSA to excuse repayment

A waiver does not primarily argue that the overpayment calculation is wrong. It asks SSA not to recover the debt. Explain the circumstances that led to the overpayment, what you knew or reported, and why you believe recovery should be excused. The SSA-632-BK asks about fault and financial circumstances. SSA describes its purpose this way: “We will use your answers to decide if you have to pay the money back.”

A waiver request should tell a clear, accurate story: what happened, what you understood at the time, what information you gave SSA, and why repayment should be excused. If your reason is financial hardship, answer the form’s financial questions completely. If you believe recovery would be unfair for another reason, explain that reason rather than leaving SSA to infer it. A waiver is a request for a decision, not a guarantee that SSA will excuse repayment.

A lower recovery rate addresses affordability

If you accept that you owe the money but cannot manage the amount SSA is currently seeking, request a change in recovery rate using SSA-634. This is different from a waiver: asking for a lower rate does not itself dispute the debt or ask SSA to forgive it.

SSA’s 2024 Overpayments Fact Sheet gives “payments as low as $10 per month” as an example. Treat that as a published example, not a promise that SSA will set your rate at that amount. Ask SSA about the options available in your case and confirm what information it needs to consider a rate change.

Know the deadlines and collection protections

For reconsideration, SSA generally gives you 60 days from receipt of the decision or notice. Follow the deadline and instructions printed on your own notice, and act promptly if you are unsure when the period ends. SSA’s overpayment guidance says there is no time limit to request a waiver, but that does not mean you should delay: collection timing can make a prompt request important.

The 30-day collection protection is separate from the 60-day appeal period. SSA says it waits at least 30 days after sending an overpayment notice before collection begins. It also says that if you request an appeal or waiver within 30 days, it will not collect while it decides that request. Do not assume a request made after that 30-day window automatically pauses recovery. If withholding has started or the deadline may have passed, contact SSA promptly and follow the instructions on the notice.

  • Reconsideration: generally file within 60 days of receiving the decision.
  • Waiver: SSA says there is no filing time limit, but filing within 30 days is relevant to the stated collection pause.
  • Collection: SSA says collection starts no earlier than 30 days after it sends the notice, and a request within that period prevents collection while SSA decides the request.

These periods answer different questions. The 60-day period is the general reconsideration deadline. The 30-day period is the point SSA identifies for avoiding collection while it decides an appeal or waiver. A waiver may still be requested after 30 days, but you should not assume that a later request will stop an existing or imminent recovery. The notice and the facts of your case matter, so contact SSA if you are uncertain about timing.

A reconsideration and a waiver address different questions. If you dispute whether you were overpaid or the amount and also believe recovery should be excused if SSA upholds the decision, you may have reason to pursue both. Make clear which issue each request addresses, and ask SSA how to submit them in your circumstances.

For example, someone who says “SSA calculated the amount incorrectly” is challenging the decision and should look at reconsideration. Someone who says “I understand the amount, but I believe I should not have to repay it” is asking for a waiver. Someone who says “I accept the debt but cannot afford the proposed amount” is asking about the recovery rate. If more than one statement describes your situation, tell SSA which requests you are making rather than assuming one form automatically covers every issue.

How to appeal with Form SSA-561

  1. Read the notice. Identify SSA’s stated reason for the overpayment, the amount, and the filing instructions and deadline. Keep the notice available while preparing your request.
  2. Get Form SSA-561 or use SSA’s online non-medical appeal route. SSA describes online submission and form upload for reconsideration. If submitting the form, follow the directions for sending it to your local Social Security office.
  3. Explain the specific error. Say whether you dispute that an overpayment occurred, the calculation, or another part of the decision. Give the facts that support your position rather than only writing that you disagree.
  4. Include relevant supporting information. Use documents or details that help explain why the notice is inaccurate. Keep copies of what you send and any delivery confirmation.
  5. Submit promptly and retain a record. Note when and how you filed. If the deadline may already have passed, contact SSA rather than assuming the request will be accepted or that collection will stop.

Before you submit, check that your explanation answers the basic question: what exactly do you believe SSA got wrong? Make sure the request identifies the notice or decision at issue and states the reason for review in understandable terms. The goal is not to write a long argument for its own sake; it is to make the disputed decision and your position clear.

How to request a waiver with Form SSA-632-BK

  1. Confirm that a waiver fits your position. A waiver is for asking SSA to excuse recovery, not for correcting an overpayment decision or amount. If you also dispute the decision, consider the separate reconsideration route.
  2. Complete the waiver form or use SSA’s online process. SSA provides an online process to complete and upload SSA-632-BK. Its public guidance also describes faxing or mailing the form to a local office, and appointment options.
  3. Describe what happened. Explain what caused the overpayment, what you knew at the time, and what you reported to SSA. Be specific about the events and your actions that are relevant to whether you were at fault.
  4. Explain why repayment should be excused. Describe your financial circumstances if you cannot afford repayment, or explain the other reason you believe recovery would be unfair. Answer the form’s questions fully and accurately.
  5. Keep copies and proof of submission. Retain the completed form, any evidence you included, and confirmation of how and when you sent it.

Take care to distinguish the explanation of how the overpayment happened from the explanation of why recovery should be excused. The first helps SSA understand the circumstances and what you knew or reported; the second explains your basis for asking it not to collect. The form asks about both fault-related circumstances and financial hardship. Complete it truthfully and do not omit information because you think one part of your explanation is more important than another.

Special rules for overpayments of $2,000 or less

For an overpayment of $2,000 or less, newer SSA materials describe a simplified waiver route. SSA’s 2024 Overpayments Fact Sheet says a person may request a waiver by phone or through a local office. SSA’s Program Operations Manual System (POMS), dated June 11, 2026, says a person need not complete SSA-632-BK for an overpayment at or below $2,000 and that SSA presumes a waiver request when reconsideration is requested for that amount.

Because those instructions involve both waiver and reconsideration, tell SSA clearly what you are asking it to review and confirm the procedure for your case. Use the current notice and SSA guidance rather than relying on older material that gives a different threshold. The $2,000 figure is the threshold stated in the cited 2024 fact sheet and June 2026 POMS; it is not a general rule about every overpayment procedure.

For this small-overpayment route, do not assume that requesting reconsideration will communicate every position you want SSA to consider. The June 11, 2026 POMS says SSA presumes a waiver request when reconsideration is requested for an overpayment at or below the threshold, but it remains sensible to make your position plain and confirm the handling with SSA. Older SSA material may show a $1,000 amount; the Social Security Administration’s 2024 fact sheet and June 2026 POMS support the $2,000 threshold described here.

What to prepare before contacting SSA

A clear, organized account makes it easier to explain the issue you are asking SSA to decide. Set aside the notice, your proposed request, and information relevant to your position.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.
  • For an appeal: identify the part of the decision you dispute and the facts or records that show why you believe it is wrong.
  • For a waiver: prepare a timeline of what happened, what you knew or reported, and why you believe you were not at fault or repayment would be unaffordable or unfair.
  • For any submission: keep copies of forms and supporting material together with proof of delivery or upload.

These recordkeeping steps are practical safeguards, not a special product or a stated SSA requirement. The overpayment notice itself is important because SSA says it explains why it believes you were overpaid and how to repay.

A simple file can help you keep the process straight: put the notice together with the completed form, copies of anything submitted, and the confirmation showing when and how it was sent. If you contact SSA to clarify a deadline or submission route, keep a note of the date and what you were told. This is practical organization, not a requirement that SSA specifies, but it can help you avoid confusing a reconsideration request with a waiver or rate-change request.

Where and how to submit

SSA describes online submission and form upload for reconsideration. For a waiver, SSA describes an online process to complete and upload Form SSA-632-BK, as well as mail or fax to the local office and appointment options. Follow the instructions that apply to your form and location, and retain a record of how you submitted it.

If you live outside the United States, including in a territory or commonwealth, SSA’s public guidance directs you to contact a Federal Benefits Unit for an appointment. If you are unsure which local office or route applies, use the instructions on your notice or contact SSA rather than sending a request to an unverified address.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

The forms and online routes are provided by SSA. You do not need to buy a product to pursue an administrative appeal, waiver, or request to change the recovery rate. For difficult cases, a qualified Social Security benefits attorney or legal-aid provider may be relevant, but professional help is separate from the SSA forms and is not a guarantee of a particular result.

What to do if recovery has started or you missed a deadline

If money is already being withheld, or you think the reconsideration period has expired, contact SSA promptly using the contact route in your notice or the relevant SSA office. Explain whether you are disputing the decision, seeking a waiver, asking to change the rate, or pursuing more than one of those routes. Do not assume a late appeal or waiver will automatically stop collection.

SSA’s general guidance does not predict the result for an individual case. The notice, program type, timing, and facts can affect procedure. For a missed deadline, active withholding, a large debt, or a complicated question about fault or hardship, it may be useful to consult a qualified Social Security benefits attorney or legal-aid provider. No appeal or waiver is guaranteed to succeed, and the general collection protection should not be read as a promise that recovery stops in every circumstance.

Repayment options are separate from an appeal or waiver

If you are not challenging the overpayment and are not seeking a waiver, but the proposed recovery is unaffordable, ask SSA about changing the recovery rate using SSA-634. SSA’s 2024 fact sheet gives “payments as low as $10 per month” as an example. That published example is not a guarantee that the same rate will be available in every case; confirm current options directly with SSA.

Frequently Asked Questions

How do I appeal a Social Security overpayment?

If you believe SSA did not overpay you or calculated the amount incorrectly, request reconsideration, generally within 60 days of receiving the decision or notice. Use Form SSA-561 or SSA’s online non-medical appeal route, explain the specific error, and follow the instructions on your notice.

What form do I use to dispute the overpayment amount?

Use Form SSA-561 to request reconsideration if you dispute whether an overpayment occurred or how much SSA says you owe. SSA’s waiver form, SSA-632-BK, addresses whether recovery should be excused, not whether the original amount was calculated correctly.

How do I request a Social Security overpayment waiver?

Use Form SSA-632-BK or SSA’s online process to complete and upload it. SSA also describes mail, fax, and appointment options. Explain what led to the overpayment, what you knew or reported, and why you believe you were not at fault and repayment would be unaffordable or otherwise unfair.

Will Social Security take money while my appeal or waiver is pending?

SSA says it will not collect while deciding an appeal or waiver requested within 30 days. SSA also says it waits at least 30 days after sending the notice before collection begins. This 30-day collection protection is separate from the general 60-day reconsideration deadline; do not assume a later request automatically pauses recovery.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Is there a deadline to request a waiver?

SSA says there is no time limit to request a waiver. However, requesting one within 30 days is relevant to the stated pause in collection while SSA decides the request. Check your notice and contact SSA promptly if collection has started or you are unsure what applies.

What if I agree I owe the money but cannot afford the recovery amount?

Ask SSA to change the recovery rate using Form SSA-634. This request addresses the amount being recovered, not whether the debt exists or whether it should be waived. SSA’s 2024 Overpayments Fact Sheet cites payments as low as $10 per month as an example, not a guaranteed rate.

What happens with an overpayment of $2,000 or less?

The Social Security Administration’s 2024 Overpayments Fact Sheet says a person may request a waiver by phone or through a local office. SSA POMS GN 02250.001, dated June 11, 2026, says a person need not complete SSA-632-BK at or below $2,000 and that a waiver request is presumed when reconsideration is requested for that amount. Confirm the procedure with SSA and state clearly what you want reviewed.

The Bottom Line

Match the request to the issue: use SSA-561 to dispute whether you were overpaid or the amount, SSA-632-BK to ask SSA to excuse recovery, and SSA-634 to seek a more manageable recovery rate. Reconsideration is generally due within 60 days, while a waiver has no stated filing time limit; requesting an appeal or waiver within 30 days is what SSA identifies for pausing collection while it decides. Follow your notice, keep a record of submissions, and contact SSA promptly if a deadline may have passed or recovery has begun.
