How to Appeal a Social Security Benefits Decision

A practical guide to Social Security appeals, from the first reconsideration request through an ALJ hearing, Appeals Council review, and federal court.

To appeal a Social Security decision, follow the next-step instructions in your notice and file the request for the review stage named there. In the usual sequence, that means reconsideration, a hearing before an administrative law judge, Appeals Council review, and—after Appeals Council action—review in federal district court. Deadlines are generally 60 days, but the event that starts the clock and the filing options vary by stage and type of decision. Read your notice carefully and act promptly; this guide explains the general process, not what you should do in an individual case.

How do I appeal a Social Security decision?

Start with the notice that explains the decision. It identifies the decision being appealed, the next review step, and the appeal rights that apply. Check which benefit or issue the notice concerns, the date printed on it, when you received it, and how the notice says to request review. SSA’s usual four-stage sequence is a useful map, but it does not replace the instructions for your particular decision.

An appeal can put the whole decision under review, including parts you agree with. Before requesting review, consider what the notice decided and what you want SSA to reconsider. If the notice gives a different procedure or deadline from the general descriptions below, follow the notice and contact SSA promptly if you are unsure which step applies.

A useful first task is to separate the decision itself from the next action. The notice may explain why SSA reached its decision, identify the appeal level available, and tell you how to request it. Keep the notice where you can refer to it while completing the request. Note the date printed on it and the date it reached you; those dates can matter differently at different stages. Also check whether SSA is asking you to provide information separately from filing the appeal. Filing the request and responding to an evidence request are related but distinct tasks.

Stage What starts the step General deadline described by SSA How to request review Who reviews it
Reconsideration An initial disability determination For the electronic disability appeal terms, 60 days starting five days after the notice date Online, by mail, or at a local Social Security office SSA reconsideration reviewer
Administrative law judge (ALJ) hearing An unfavorable reconsideration decision 60 days after getting the reconsideration decision Online, by sending the relevant form, or by contacting a local office An administrative law judge
Appeals Council review An ALJ decision or order you disagree with 60 days after getting the hearing decision or order; SSA generally assumes receipt within five days of the notice date unless you show otherwise AC iAppeal, Form HA-520, a letter, or fax The Social Security Appeals Council
Federal district court An Appeals Council denial of review or unfavorable decision 60 days after receipt of the Appeals Council notice File a civil action in the appropriate U.S. district court and serve the agency as required A federal court

The table is an orientation, not a deadline calculator. The applicable program and notice determine the procedure. Do not assume every 60-day period is calculated from the same event.

The stages also differ in who acts and what the step is for. Reconsideration and Appeals Council review are administrative reviews within SSA; an ALJ hearing adds an opportunity to address the case with a judge; federal court is a civil action governed by court filing and service requirements. The route you can take next depends on the decision you just received. You generally do not skip directly from an initial disability determination to federal court under the sequence described here.

How to appeal an initial Social Security decision

Identify the decision and the correct request

For a first disability determination, the next step is generally a request for reconsideration. Use the appeal rights in the decision notice to confirm that this is the correct route. The electronic appeal terms for disability decisions describe a 60-day filing period that starts five days after the notice date. That specific rule should not be generalized to every Social Security benefit or every kind of decision.

Submit the request and track any additional evidence

  1. Read the notice and note its date, the date you received it, the decision being challenged, and the filing instructions.
  2. Submit the reconsideration request online, by mail, or at a local Social Security office, using the route identified for your decision.
  3. If you are not ready to submit all supporting evidence, indicate that more evidence will follow if the process allows it. Respond to any SSA evidence request and send the materials before SSA decides the appeal.
  4. Keep a copy of the notice, appeal request, evidence, and confirmation or other proof of submission. This makes it easier to verify what you sent and when if a question arises.

Explain what you believe was decided incorrectly and provide relevant supporting information. For a disability decision, that may include information about the medical condition and its effects, but the materials reviewed here do not establish a universal evidence checklist. Follow any specific request SSA sends rather than assuming that a particular document is required in every case.

If you submit the request before every supporting item is ready, do not let that delay the appeal itself when the deadline is approaching. The electronic appeal terms allow an indication that additional evidence will follow. After filing, track what remains to be sent and any deadline or request SSA gives you. The key is not to assume that an unfinished evidence package will be held open indefinitely: the materials should reach SSA before it decides the appeal.

Use the route specified for your decision rather than sending the same request through multiple channels without a reason. Save the online confirmation or, for a mailed request, other proof of delivery. Record the date you filed and retain a copy of what you submitted. These simple records can help you respond if SSA asks when the appeal was sent or what materials accompanied it.

What happens after an unfavorable reconsideration decision?

Request an ALJ hearing

If reconsideration is unfavorable and you want to continue, request a hearing using the instructions that accompany the reconsideration decision. SSA lists online filing, sending the relevant form, and contacting a local office for help. Hearing attendance may be online, in person, or by phone, depending on the arrangements offered for the case.

SSA describes the hearing-request deadline as 60 days after getting the reconsideration decision. Use the notice to confirm the appropriate request and how to file it. If you need help with the request, SSA says you can contact the local office. Keep the notice and a record of the filing route and date, just as you would for reconsideration.

Prepare for the hearing

The hearing gives you an opportunity to explain your case and respond to the issues and evidence before the judge. SSA describes the hearing as informal but recorded. The ALJ explains the issues and may question you, question witnesses, and call medical or vocational experts. You and a representative, if you have one, may question witnesses. A written decision follows the hearing.

  • Organize evidence: Gather relevant records and information, and make sure SSA has the materials it needs to consider your case.
  • Meet the evidence cutoff: For a disability hearing, submit or identify written evidence no later than five business days before the hearing.
  • Prepare to explain your case: Be ready to address the issues the ALJ identifies and answer questions about the evidence. Do not assume that the judge already has every record you intended to provide.
  • Keep contact information current: Update SSA so hearing notices and other communications can reach you.

The five-business-day rule is specific to written evidence at disability hearings. It requires you to submit evidence or identify it by the deadline; it does not mean you should wait until then to gather records. If you have information to identify but cannot submit it by that point, contact the hearing office and follow its instructions. Organizing materials early also gives you time to check whether SSA has received them.

Think of the hearing as a chance to address the case the ALJ will decide, not simply to repeat the original appeal request. Review the issues identified for the hearing and the evidence available to SSA. The judge may ask questions, and witnesses or medical and vocational experts may be involved. A representative can assist with preparation and may question witnesses, but representation does not promise a particular result.

If you need more time for evidence or have difficulty meeting the five-business-day requirement, contact the hearing office and follow its directions. The rule is a deadline for submitting or identifying evidence, not a reason to wait until the last moment to organize it.

If you miss the hearing deadline or hearing

If you missed the deadline to request a hearing, SSA says to explain why and ask for an extension. An ALJ may dismiss an appeal if you cannot give a good reason. If you miss the scheduled hearing, contact the hearing office promptly and respond to any show-cause notice by the deadline stated in that notice. Do not treat a missed hearing as resolved without responding to the office.

Do not assume that a missed date automatically ends the matter or that it will be excused automatically. Contact the hearing office promptly, explain what happened, and follow any notice it sends. If a show-cause notice gives a response deadline, treat that as its own urgent date and respond by the stated time.

How to ask the Appeals Council to review an ALJ decision

If you disagree with an ALJ decision or order, you can ask the Appeals Council to review it. SSA identifies AC iAppeal as its preferred filing method and also lists Form HA-520, a letter, or fax as alternatives. Use the notice to confirm how to submit the request in your case.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

SSA’s instructions generally allow 60 days after you get the hearing decision or order. For this stage, SSA assumes that you received the notice within five days after its date unless you can show otherwise. If circumstances affect when you received it, keep information that can support your account and explain it when you contact SSA.

Evidence and written arguments

At Appeals Council review, additional evidence should relate to the period on or before the hearing decision. If you need more time to provide evidence or a legal argument, ask for an extension in writing. Do not assume that material about a later period will be considered as evidence about the period the ALJ decided.

When preparing the request, identify the ALJ decision or order you want reviewed and explain the basis for disagreeing with it. If you are submitting additional evidence, make sure it concerns the period on or before that decision. If you cannot complete the evidence or legal argument in time, request more time in writing rather than assuming the Council will wait for it.

The Appeals Council may deny the request, make a decision, or return the matter to a judge for further review. Those are different outcomes; read the action notice to find out what happened and what appeal rights remain.

A denial of the request, a Council decision, and a return to the ALJ are not interchangeable. Read the Council’s written action carefully to determine which occurred and what the notice says you may do next. If the Council denies review or issues an unfavorable decision, the next step in the usual sequence may be federal court review, subject to the deadline and filing requirements described below.

When can you take a Social Security appeal to federal court?

Federal district court is the final appeal level in the usual sequence described here. If the Appeals Council denies review or issues an unfavorable decision, SSA says you may file a civil action within 60 days after receiving the notice. The notice and court rules control the precise filing requirements, so do not rely on a general description alone when preparing a court case.

SSA’s instructions generally identify the U.S. district court for the area where you live or have your principal place of business. They describe the District of Columbia as a fallback in the circumstances specified by SSA. After filing, the instructions call for copies of the complaint and the issued summons to be sent to the agency’s Office of General Counsel for the area by certified or registered mail. Confirm the correct court, office, and service steps against your notice and applicable court rules.

Filing a civil action involves more than sending SSA another appeal form. The complaint must be filed with the appropriate court, a summons must be issued, and copies must be served on the agency as instructed. The court’s own rules and the instructions in the Appeals Council notice matter. Check both before acting, including which district is appropriate and where the agency copies must be sent.

SSA reported 13,514 new court cases received and 13,306 processed in fiscal year 2024, which ran from October 2023 through September 2024. Those figures describe the agency’s court workload only. They do not show an individual claimant’s odds of success, the time a particular case will take, or an appeal success rate.

How long do you have to appeal a Social Security denial?

SSA describes 60-day periods at the reconsideration, hearing, Appeals Council, and federal court stages. What starts each period is not identical. For the electronic disability reconsideration appeal, SSA’s terms count from five days after the notice date. For a hearing request, SSA describes the period as 60 days after getting the reconsideration decision. For Appeals Council review, SSA generally assumes receipt within five days after the notice date unless you show otherwise. For court, SSA describes 60 days after receipt of the Appeals Council notice.

Because the trigger and receipt assumptions vary, do not calculate a deadline by applying one formula to every notice. Check the appeal-rights section of the particular notice, record when it arrived, and file as soon as you can. If you think you have missed a deadline, contact SSA promptly and explain the circumstances; for a hearing request, SSA specifically says to explain why and ask for an extension. A request for extra time is not a guarantee that it will be granted.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

For example, the five-days-after-notice language in the disability electronic appeal terms is not a universal rule for all four stages. The Appeals Council instructions also use an assumed receipt date, but for that stage the assumption applies unless you can show otherwise. The hearing and court descriptions use their own receipt-based wording. Treat each notice as controlling for its own appeal and avoid waiting until the last day to work out which date applies.

What to do if you need help with an appeal

A representative may help you prepare for a hearing, organize your explanation, and question witnesses. SSA’s hearing guidance describes claimants appearing with representatives. Representation does not guarantee a favorable decision, and this article does not verify any particular provider, fee, or service. If you seek help, confirm the person’s qualifications, the scope of assistance, and any costs before agreeing to representation.

You can also contact the local Social Security office or the hearing office identified in your notice for procedural assistance. When contacting an office, have the notice available and ask specifically which appeal stage applies, how to submit the request, and whether any evidence or response is due by a separate date.

Getting help is a choice, not a condition described for filing an appeal. A representative may be useful in preparing for a hearing, but no representative can guarantee the outcome. For any person or service you consider, understand what assistance is offered, confirm qualifications, and ask about fees or other costs before agreeing. For court review in particular, consider qualified legal help because court filing and service requirements must be followed carefully.

What SSA’s court workload figures do—and do not—show

SSA reported 13,514 new federal court cases received and 13,306 cases processed in fiscal year 2024, which ran from October 2023 through September 2024. These are agency workload counts. They do not measure the likelihood that an individual claimant will win, how long a case will take, or the success rate of appeals.

Frequently Asked Questions

How do I appeal a Social Security decision?

Read the appeal-rights section of the notice and file the next request it identifies. The usual path is reconsideration, an ALJ hearing, Appeals Council review, and then federal district court after Appeals Council action. The exact route depends on the benefit and decision.

How long do I have to appeal a Social Security denial?

SSA describes 60-day periods at the appeal stages, but the trigger differs. The electronic disability reconsideration terms count from five days after the notice date; other stages use their own receipt-based instructions. Check your notice and file as soon as possible.

Can I send evidence after I file my appeal?

For an initial disability reconsideration request, SSA’s electronic terms allow you to indicate that more evidence will follow; submit it before SSA decides the appeal and respond to any evidence request. For disability hearings, submit or identify written evidence at least five business days before the hearing. At Appeals Council review, additional evidence should relate to the period on or before the ALJ decision.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

What happens if I miss my hearing or the deadline to request one?

If you miss the request deadline, SSA says to explain why and ask for an extension; an ALJ may dismiss the appeal without a good reason. If you miss the hearing, contact the hearing office promptly and respond to any show-cause notice by the deadline in that notice.

Can I appeal an unfavorable Appeals Council action?

If the Appeals Council denies review or issues an unfavorable decision, SSA says you may file a civil action in U.S. district court within 60 days after receiving the notice. Check the notice and court rules for filing and service requirements.

Does appealing put only the part I disagree with under review?

Not necessarily. SSA may review the whole decision, including parts you agree with, so read the decision and consider the scope of your appeal before filing.

The Bottom Line

Use the notice to identify the next appeal stage, its specific deadline trigger, and the approved filing route. The four-stage path usually runs from reconsideration to an ALJ hearing, Appeals Council review, and federal court, but every notice controls the next step. File promptly, keep records of what you submit, meet evidence deadlines, and get qualified help if you need it—especially for a court action.
