The U.S. de minimis exemption let qualifying commercial shipments worth up to $800 enter duty-free. That treatment gave low-cost online retailers such as Shein and Temu an advantage when they shipped individual parcels directly to U.S. customers. The nationwide suspension has applied since August 29, 2025; a separate law repeals the exemption’s statutory basis starting July 1, 2027.
What was the de minimis tariff exemption?
De minimis was a U.S. customs exception for low-value imports. Congress created its predecessor in 1938 to avoid spending more to collect a duty than the duty was worth. The original general threshold was $1. Congress later raised it to $5 in 1978, $200 in 1993, and $800 in 2016. The rule was therefore 88 years old in 2026, not literally a century old.
The commercial-goods provision, 19 U.S.C. § 1321(a)(2)(C), allowed qualifying shipments valued at no more than $800 to receive duty-free treatment. The threshold was not a general promise that every package under $800 would be free of all charges; eligibility and customs rules mattered. The policy’s original administrative rationale and its later use at e-commerce scale are distinct parts of the story. The 2026 Economic Report of the President describes the shipment growth, while the legal authorities define the exemption and its suspension.
Why did Shein and Temu benefit?
When a qualifying low-value parcel entered duty-free, the seller could avoid duties that might otherwise apply through other import channels. That created an advantage for direct-to-consumer businesses sending many individual orders across borders, a model associated with low-priced goods from Shein and Temu. Axios reported that ending the exemption disrupted a business model that had helped both retailers sell inexpensive products to U.S. shoppers. The scale of the exemption grew sharply. U.S. Customs and Border Protection figures, as reported in the 2026 Economic Report of the President, show 134 million de minimis shipments in 2015 and 1.36 billion in 2024. Those are all-category shipment counts, not Shein or Temu package counts. The available figures do not establish how much either company’s costs, margins, sales, or prices changed, or what share of its business depended on the exemption.
Why is it called a loophole?
“Loophole” is a political and editorial label, not the name of the legal provision. More precisely, de minimis was a statutory exemption created to reduce disproportionate customs-collection costs, later expanded by Congress and used at scale in online retail. Critics of the expanded rule argue that it gave imported goods a tariff advantage and complicated enforcement. The original administrative rationale does not, by itself, resolve those later policy concerns.

What changed, and when?
The current suspension and the future statutory repeal are separate legal developments. The Trump administration first suspended de minimis treatment for certain goods in 2025. A July 30, 2025 order extended the suspension worldwide, effective August 29, 2025. Executive Order 14388, issued February 20, 2026, continued it. In June 2026, Customs and Border Protection adopted regulations matching the existing suspension. The Court of International Trade upheld the presidential rescission in the case before it on August 13, 2026. Separately, Congress enacted repeal of the statutory basis effective July 1, 2027.
The court explained its ruling this way: “We conclude first that IEEPA’s provision providing that the President may ‘nullify [or] void . . . exercising any . . . privilege’ authorizes the President’s rescission of the de minimis exemption here because the de minimis exemption, by its own terms, creates a ‘privilege.’” This is the court’s per curiam opinion, not a statement by an individual judge. What does the suspension mean for a low-value package?
Under the February 2026 order, covered shipments no longer receive de minimis treatment regardless of value, country of origin, or mode of transportation, subject to statutory exceptions. Non-postal shipments require an appropriate customs entry, and shipments are subject to applicable duties, taxes, fees, and charges. This does not mean every package faces the same tariff rate: the applicable amount depends on customs rules and the product and shipment circumstances. The February 20, 2026 executive order sets out the suspension.
For consumers, the practical consequence is that low value alone no longer guarantees duty-free entry under the suspended provision. The seller or shipping arrangement may affect how charges are handled, so check the order’s delivery terms and any customs-charge notices rather than assuming the former $800 rule applies. The statutory repeal scheduled for July 1, 2027 is an additional change to the law, not the date the current suspension begins. What the change does—and does not—show about the retailers
Ending the exemption removes a cost advantage associated with qualifying low-value parcels and requires covered shipments to follow applicable customs processes. It does not establish that Shein or Temu cannot operate without the exemption, nor does it show by itself how much either retailer will raise prices or change its shipping model. Those company-level effects are not quantified in the available legal and reporting sources.
