How the Social Security Fairness Act Changes Benefits for Teachers, Firefighters, and Other Public Workers

The Social Security Fairness Act repealed WEP and GPO for benefits from January 2024 onward, but a public-sector job or pension alone does not guarantee an increase.

The Social Security Fairness Act can increase Social Security retirement, disability, spouse, or survivor benefits for some people whose pensions come from work that did not pay Social Security taxes. It repealed two rules—the Windfall Elimination Provision (WEP) and Government Pension Offset (GPO)—that had reduced or eliminated certain benefits. A public-sector job or pension alone does not qualify someone for an increase: the key questions are whether the pension is based on non-covered work and whether WEP or GPO had affected the benefit.

What the Social Security Fairness Act changed

Before repeal, WEP could reduce a person’s own Social Security retirement or disability benefit if that person also received a pension based on employment where Social Security taxes were not paid. GPO could reduce or eliminate a person’s Social Security spouse or survivor benefit if they received a government pension based on their own non-covered work. The Social Security Fairness Act removed both provisions for covered benefit months. The Social Security Administration (SSA) explains the change in its Social Security Fairness Act update.

The distinction matters: the Act repealed WEP and GPO, not every rule that can affect a Social Security payment. It does not make every pension irrelevant to every Social Security or Medicare calculation. For example, SSA says Medicare Part B premium billing may still apply in certain cases. The specific change is that WEP and GPO no longer reduce the covered Social Security benefits described here.

Congress passed H.R. 82, and the President signed it on January 5, 2025. The law applies to benefits payable for months after December 2023. In practical terms, January 2024 is the first benefit month for which the repealed provisions no longer apply; December 2023 is the final month they could apply. This is based on the benefit month, not simply the date a deposit arrived. SSA states the effective period in its January 6, 2025 legislative bulletin.

Which teachers, firefighters, and public workers may qualify?

You may be affected if you receive a pension based on work that was not covered by Social Security and WEP or GPO previously reduced the relevant Social Security benefit. SSA identifies some teachers, firefighters, police officers, other public employees, federal workers covered by the Civil Service Retirement System, and people whose work was covered by a foreign social security system as examples of people who could be affected. These are examples, not automatic eligibility categories.

The job title does not decide coverage. State and local governments may have jobs that are covered by Social Security and others that are not; coverage depends on the employment and applicable arrangements, not simply on whether the employer is public. SSA estimates that about 72 percent of state and local public employees work in Social Security-covered employment and were not affected by WEP or GPO. That agency figure is a broad 2025 statistic, not a determination about any individual worker.

  • A public pension based on covered work: The fact that you have a government pension does not by itself mean WEP or GPO applied. If the work was covered by Social Security, this Act’s repeal may not change your benefit on that basis.
  • A pension based on non-covered work: You may have been subject to WEP or GPO, but an increase depends on whether the provision actually affected the Social Security benefit you receive or could claim.
  • No affected Social Security benefit: Repeal does not create a new benefit solely because you worked in a public job or receive a pension.

To assess your situation, identify the work on which the pension is based, whether Social Security taxes were paid on that work, and whether your own or a spouse/survivor benefit had been reduced under WEP or GPO. Your pension provider can help clarify the employment and pension basis; SSA determines how the Social Security rules apply to your benefit.

How the change differs for your own benefit and a spouse or survivor benefit

Benefit affected Old rule What repeal changes
Your own retirement or disability benefit WEP could reduce it if you also received a pension based on work not covered by Social Security. For benefit months from January 2024 onward, WEP no longer reduces that benefit.
A benefit as a spouse or surviving spouse GPO could reduce or eliminate it if you received a government pension based on your own non-covered work. For benefit months from January 2024 onward, GPO no longer reduces or eliminates that benefit on that basis.

SSA says a spouse’s or surviving spouse’s benefit is no longer reduced or eliminated, starting in January 2024, because the worker receives a retirement or disability pension from the worker’s own federal, state, or local government job not covered by Social Security. The agency addresses that question in its spouse and government-pension FAQ. A person’s own retirement benefit and their eligibility for a spouse or survivor benefit are separate questions; one change does not mean every person automatically qualifies for both.

How much could your monthly benefit increase?

There is no single increase amount for teachers, firefighters, or other affected workers. SSA says the increase varies based on factors including the type of benefit and the pension amount. The result also depends on whether WEP or GPO had reduced your benefit, whether you receive your own benefit or a spouse/survivor benefit, and whether you were already receiving payments or still need to claim.

For that reason, a profession-wide average or a generic dollar estimate would not reliably predict your result. The useful comparison is between your benefit under the former reduction and the amount SSA determines under the law as amended. If you are an existing beneficiary, use the revised benefit record or SSA notice rather than assuming that another person’s adjustment will match yours. If you have never filed, ask SSA to evaluate the benefit you may be eligible to claim.

When did existing beneficiaries see the adjustment?

SSA began adjusting monthly payments for affected beneficiaries on February 25, 2025. The agency said most people first saw a changed monthly amount in April 2025, which was the payment for the March benefit month. Eligible beneficiaries also received one-time payments covering increases owed back to January 2024. A payment’s arrival date and the month of benefit it covers are not necessarily the same.

As of July 7, 2025, SSA reported completing more than 3.1 million payments totaling $17 billion, five months ahead of its original schedule. This is a dated agency implementation milestone, not a forecast of an individual’s payment or a count of everyone who may eventually qualify. SSA’s implementation update provides the agency’s timeline and current guidance.

What to do if you already receive Social Security

SSA described automated adjustments for people who were already receiving benefits and whose records were affected by WEP or GPO. If you believe you were affected, check your current benefit record and any SSA notice explaining a changed monthly amount or past-due payment. Compare the benefit month covered with the payment date, particularly when reviewing amounts related to the period beginning January 2024.

  1. Identify the benefit: Determine whether you receive your own retirement or disability benefit, a spouse benefit, a survivor benefit, or more than one type.
  2. Check the pension basis: Confirm whether the pension comes from employment that did not pay Social Security taxes. A public employer or pension label alone is not enough to establish this.
  3. Review SSA’s decision and payment record: Look for an explanation of a benefit change and any past-due adjustment. Note the months involved rather than judging only by deposit dates.
  4. Contact SSA if your record appears incomplete: Ask whether WEP or GPO had affected your benefit and whether the Act’s adjustment has been applied. Keep pension and benefit information available so SSA can review your circumstances.

The Act did not create a paid service or product that beneficiaries must buy to receive an adjustment. SSA is the agency that administers these benefits; use its instructions for questions about an individual record.

What if you have never applied?

An automatic adjustment to an existing record is not the same as filing a claim. If you have never applied for retirement, disability, spouse, or survivor benefits, you may need to submit an application before SSA can determine and pay any benefit due to you. Do not assume that repeal itself enrolls you or automatically produces a retroactive lump sum.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

The Act did not change the usual retroactivity rules for applications. SSA says retirement and survivor benefits are generally limited to six months of retroactive payments before the month you apply. Some disability claims may qualify for up to 12 months of retroactivity. These are general limits, not a promise that a particular claim will be payable for every month in that window. Because the application month can affect the start of payments, contact SSA or apply promptly if you think you may qualify; ask the agency how the rules apply to your claim.

SSA reported receiving more than 387,000 new initial claims by September 30, 2025. That dated figure shows application activity after the law, but it does not establish how many applicants were eligible or how much any one person will receive. The number was reported in SSA’s Fiscal Year 2025 Agency Financial Report.

Questions to settle before estimating your case

Gathering the right details can make a conversation with SSA more productive. These checks help distinguish a potentially affected benefit from a public pension that does not trigger the repealed provisions:

  • Which Social Security benefit are you receiving or seeking: your own retirement or disability benefit, or a spouse or survivor benefit?
  • What job or jobs produced the pension, and were those jobs covered by Social Security?
  • Was a Social Security benefit actually reduced or eliminated under WEP or GPO, or is that only an assumption based on your job title?
  • Are you already receiving the affected benefit, or have you not filed a claim?
  • Are you asking about a benefit month from January 2024 onward, or a month before the repeal’s effective period?

The answers do not calculate a benefit by themselves; SSA must apply the rules to your work and claim record. But they focus the inquiry on the factors that determine whether the Act changes your case, rather than on occupation alone.
