How the Order of Death Affects Gene Hackman and Betsy Arakawa’s Estates

Reports say Betsy Arakawa died before Gene Hackman and each spouse’s will named the other. Here’s why that sequence matters—but does not reveal who ultimately inherits.

Associated Press reporting says Betsy Arakawa died about a week before Gene Hackman. Probate-document reporting says each spouse’s will named the other, so the sequence matters: Hackman did not survive Arakawa, and the gift in her will to him could not take effect as a gift to a surviving spouse. That does not establish who ultimately receives either person’s property. Trust terms, ownership and beneficiary designations, and the wills’ provisions for a beneficiary who dies first can change the result.

What is publicly known about the deaths and wills?

On February 28, 2025, the Associated Press reported that authorities concluded Arakawa died around a week before Hackman. The same report attributed Arakawa’s death to hantavirus pulmonary syndrome and Hackman’s to heart disease with Alzheimer’s complications. On March 17, 2025, the AP reported from probate court documents that Hackman’s will left his estate to Arakawa and that Arakawa’s will directed her estate to him.

Those reported provisions describe the wills’ stated gifts; they do not establish the complete estate plan or final distribution. The AP also reported that a request had been made for a trustee to administer assets in two trusts. The trust documents and their beneficiaries were not publicly clear in that reporting. A March 31, 2025 AP report about a ruling permitting release of most investigative materials concerned death-investigation records, not disclosure of the trust beneficiaries.

Why does who died first matter?

A will can leave property to a spouse, but a gift to that spouse generally depends on the will’s language and the applicable law. If the named recipient dies first, the will may provide an alternate beneficiary or a default distribution. If it does not, rules governing the particular gift and estate may determine what happens. The will and current governing law must be read together; the public reporting does not establish what either will says about this situation beyond the reported spousal gifts.

Because the AP reported that Arakawa died first, Hackman was not alive to inherit from her as a surviving spouse. That does not, by itself, tell us who receives the property she intended for him: the result depends on the relevant provisions and on which assets were actually governed by her will.

Which route can property take?

Not every asset necessarily passes under a will. New Mexico Courts’ self-representation guidance describes joint tenancy with right of survivorship and transfer-on-death deeds as examples of property that can pass outside probate. Trust ownership and account beneficiary designations can also affect how assets transfer, but the public sources do not establish how the Hackmans held particular property or what any designation said.

Property route What determines the transfer What public reporting establishes in this case
Will and probate The will’s terms, whether a named recipient survived as required, and applicable law. The AP’s March 17, 2025 report from probate documents says each will named the other spouse. The full terms and final distribution are not established by that report.
Trust The trust document, its beneficiary provisions, and the property held in the trust. The AP reported on March 17, 2025 that two trusts were involved and their beneficiaries were unclear without the trust documents.
Property passing outside probate Ownership form, deed language, or an account’s beneficiary designation. New Mexico Courts lists examples of non-probate transfers, but the public sources do not show how any specific Hackman or Arakawa asset was titled or designated.
Intestate succession Applicable law, if property is not effectively disposed of by a will, trust, or other controlling transfer arrangement. New Mexico legislative materials describe a general rule for descendants and a surviving spouse, but do not establish that intestacy controls any particular asset here.

Do Hackman’s children inherit?

The available reporting does not establish that Hackman’s children are either excluded from or entitled to a particular share of his property. A will naming a spouse does not answer what happens if the spouse dies first, and it does not resolve property governed by trusts or non-probate arrangements. If property were subject to intestacy, New Mexico legislative materials describe descendants as taking the portion not passing to a surviving spouse. That is a conditional general rule, not a determination that intestacy applies to the Hackman or Arakawa estates; the cited legislative text is not a consolidated current code.

What does the 120-hour survival period mean here?

Some discussion of New Mexico probate law refers to a 120-hour survival period—five days—for deciding whether a beneficiary is treated as having survived another person. The materials available for this case include historical legislative text reflecting survival rules, not an authoritative consolidated current statute sufficient to apply the rule to every asset. The instrument and current governing law would need to be checked. Although the reported interval between the deaths was about a week, that approximate timeline alone does not settle how a particular will, trust, deed, or account designation operates.

Does an administrator or trustee decide who inherits?

No. A personal representative handles estate administration; appointment to that role is not itself proof of inheritance. New Mexico Courts’ guidance describes priority for appointment, while the AP’s reporting treats administration and beneficiary disclosure as separate matters. A trustee administers trust property under the trust’s terms; the fact that a trustee is asked to act does not identify the beneficiaries.

What would be needed to know the final distribution?

  • The complete wills, including any alternate-beneficiary or fallback provisions.
  • The trust documents and identification of the property each trust holds.
  • Deeds, account records, and beneficiary designations showing whether assets pass outside probate.
  • The governing law and any survival conditions that apply to each instrument or asset.
  • Estate administration records showing which assets are included and how they are ultimately distributed.

Without those asset-specific documents and terms, a definitive answer about who receives all or any particular part of the estates is not established by the public reporting cited above.
