How Social Security Spousal and Survivor Benefits Work

Spousal benefits use a living spouse’s record; survivor benefits follow a worker’s death. Eligibility, marriage rules, benefit amounts and claiming choices differ.

Social Security spousal benefits are based on a living spouse’s retirement or disability entitlement; survivor benefits are based on a worker’s record after that worker dies. The eligibility rules, claim timing and way each benefit coordinates with your own retirement benefit differ. Knowing which rules apply can help you decide what to ask the Social Security Administration (SSA) and when to apply.

Spousal and survivor benefits are different programs

A spousal benefit is a family benefit tied to a living worker who is entitled to Social Security Retirement or Disability benefits. A survivor benefit may be payable after a worker who paid Social Security taxes dies. A current spouse, former spouse or surviving spouse may have a path to benefits, but a relationship that qualifies under one set of rules does not automatically qualify under the other.

Question Spousal benefit Survivor benefit
Whose record is involved? A living spouse’s retirement or disability record A deceased worker’s record
Typical age threshold Age 62, with an exception for some people caring for the worker’s qualifying child Age 60, or age 50–59 if disabled, with exceptions for some people caring for the deceased worker’s child
Marriage-duration rule Generally, at least one year for a current spouse; at least 10 years for a divorced spouse Generally, at least nine months for a surviving spouse; a surviving divorced spouse generally must have been married at least 10 years
Potential amount Up to half of the worker’s benefit, subject to the claimant’s age and other rules Potentially 71.5% to 100% of the worker’s benefit, depending on the survivor’s age when benefits begin and other circumstances

These are broad descriptions, not an eligibility decision or a personal benefit estimate. The worker’s entitlement, your age, work record, marriage history, caregiving circumstances and other facts can affect the result.

Who may qualify for a spousal benefit?

Current spouses

Under SSA’s general rules, a current spouse may qualify on a worker’s record if the marriage has lasted at least one year and the claimant is age 62 or older. A spouse younger than 62 may qualify while caring for the worker’s child if that child is age 15 or younger, or has a disability and is any age. The worker must be entitled to Retirement or Disability benefits.

Being married to someone who has paid Social Security taxes does not by itself establish eligibility. The worker’s benefit status and the claimant’s own circumstances matter. Your own retirement benefit can also affect how much is payable on your spouse’s record.

Divorced spouses

A divorced person may qualify on a former spouse’s record if the marriage lasted at least 10 years and other applicable conditions are met. SSA’s general family-benefit guidance includes benefits for a spouse or ex-spouse of someone entitled to Retirement or Disability benefits. The fact that a former spouse has remarried does not by itself prevent a qualifying divorced spouse from receiving benefits on that former spouse’s record.

Who may qualify for survivor benefits?

Surviving spouses

A surviving spouse may generally qualify beginning at age 60 if the marriage lasted at least nine months. A disabled surviving spouse may generally qualify between ages 50 and 59. Remarriage timing matters: SSA’s general rule says the surviving spouse must not have remarried before age 60, or before age 50 if disabled. These rules have exceptions, including for some people caring for a deceased worker’s child; those cases may qualify regardless of age and marriage duration.

Do not apply the living-spouse rules to a survivor claim. The marriage-duration requirement, the age threshold and the effect of remarriage differ. Disability or caring for the deceased worker’s child may change the analysis.

Surviving divorced spouses and other family members

A surviving divorced spouse may qualify under separate rules, generally including a requirement that the marriage lasted at least 10 years. SSA also identifies some valid non-marital legal relationships as potentially qualifying. Children and dependent parents can qualify in defined circumstances, but their eligibility is separate from the rules for a surviving spouse. If any of these situations applies, ask SSA to assess the relationship and circumstances rather than assuming the general spouse rule settles the claim.

How much can the benefits pay?

Spousal benefit amount

A spousal benefit can be as much as half of the worker’s benefit. That is a maximum, not a guaranteed payment: the claimant’s age when benefits start affects the spouse amount, and eligibility and payment can depend on the claimant’s own record and other facts. The maximum should not be read as an automatic extra half on top of a person’s own retirement check.

Survivor benefit amount

A survivor benefit may start at 71.5% of the deceased worker’s benefit and rise with delayed claiming to as much as 100% at the survivor’s full retirement age. SSA describes survivor full retirement age as between 66 and 67; the amount depends on the deceased worker’s record, the survivor’s age and other circumstances. SSA’s amount guidance also notes that survivor benefits may be subject to earnings limits depending on age.

For context, SSA estimated an average monthly benefit of $1,919 for an aged widow(er) alone after the 2.8% cost-of-living adjustment for benefits payable in January 2026. This was a national estimate published by SSA in 2025, not a forecast or estimate for any individual survivor.

When more than one benefit is possible

If you qualify for a benefit on your own record and a spouse’s or survivor’s record, Social Security generally does not pay both full amounts added together. The agency pays the applicable higher amount, which may include your own benefit plus an additional amount based on the other record. The actual calculation depends on the records and rules that apply to your claim.

For example, SSA describes a survivor who starts with survivor benefits and later changes to their own retirement benefit at age 70, when that retirement benefit is highest. This is an example, not a universal recommendation: the suitable sequence depends on the estimates and personal circumstances involved.

Claiming rules affect which benefit you receive first

Deemed filing for retirement and spouse benefits

Deemed filing is the rule that can require someone who is eligible for both retirement and spouse benefits to apply for both when claiming one. For a covered claimant, the resulting payment is the higher applicable amount rather than two full benefits. SSA says the rule was extended to full retirement age and beyond for people born on or after January 2, 1954. The rule’s application depends on the claimant’s birth date and circumstances.

Survivor benefits are treated differently

Deemed filing does not apply to survivor benefits. That can allow an eligible survivor to claim on the deceased worker’s record while their own retirement benefit continues to grow, or to use another sequence if it better fits their circumstances. Compare estimates for each available benefit and the effect of the age you start before choosing a claiming path.

Suspending a worker’s retirement benefit

If a worker voluntarily suspends their retirement payments, benefits payable on that worker’s record are generally suspended as well. SSA describes an exception under which a divorced spouse’s benefit can continue in the specified circumstances. Do not assume that a worker’s suspension leaves every family member’s payment unchanged; ask SSA how it would affect the particular record and benefit.

How work earnings can affect payments in 2026

Before full retirement age, earnings from work can cause Social Security to withhold some benefits under the retirement earnings test. SSA’s 2026 figures are:

Situation in 2026 Annual exempt amount Withholding above the limit
Below full retirement age for all of 2026 $24,480 $1 in benefits for every $2 above the limit
Reaching full retirement age during 2026 $65,160, applying only to earnings before the month full retirement age is reached $1 in benefits for every $3 above the limit
In or after the month full retirement age is reached Earnings do not count toward this test No withholding under this earnings test

These are the 2026 retirement earnings-test amounts; they are not a promise that every withheld dollar is permanently lost. More importantly, do not assume that these retirement limits automatically describe the earnings limit for every survivor. SSA says survivor benefits may also be subject to earnings limits depending on age, so check its current age-specific information for your case.

When a family maximum matters

Social Security may limit the total benefits paid to eligible family members on one worker’s record. This can matter when several family members qualify, even though an individual’s benefit estimate may look different when considered alone. SSA’s 2026 retirement and survivor family-maximum formula has bend points of $1,643, $2,371 and $3,093. Those figures are components of a specialized formula, not individual benefit amounts; they should not be used to estimate what one spouse or survivor will receive.

How to get an estimate or apply

For a personal estimate

Compare the benefit estimates available on your own record with the spouse or survivor estimate, then consider the age you would start, your work earnings and the relevant marriage or caregiving facts. SSA’s guidance emphasizes that deciding when to start benefits is a personal decision. An estimate is not a final eligibility determination, particularly where marital history, disability, a family maximum or earnings records make the case more complex.

For a survivor claim

  1. Contact SSA about the claim. SSA’s July 2026 explainer says survivor benefits cannot be applied for online and advises calling 1-800-772-1213 about monthly survivor benefits and the lump-sum death payment.
  2. Ask whether a separate application is needed. SSA says a person already receiving spouse benefits will be automatically converted to survivor benefits, but should still contact the agency about the lump-sum payment.
  3. Confirm whether the death has been reported. A funeral home will usually report a death to SSA, so the family may not need to report it separately. Confirm the reporting and application steps directly with SSA.

The lump-sum death payment is $255. SSA’s July 2026 explainer says eligible spouses or some minor children may receive it; eligibility is limited, so ask SSA whether it applies to the family.

What to have ready before speaking with SSA

Organizing the facts that drive eligibility and payment can make an estimate or application discussion more productive. Gather what you can, and ask SSA what documentation is required for your situation.

  • Your age and, if relevant, the month you expect to reach full retirement age.
  • Information about your own Social Security retirement benefit and work earnings.
  • The worker’s benefit or record information, if available, and whether the worker is living, deceased, or entitled to Retirement or Disability benefits.
  • Marriage and divorce dates, including how long any marriage lasted, and whether a surviving spouse remarried and when.
  • Information about a child in your care, including the child’s age and whether the child has a disability.
  • Whether other family members may claim on the same worker’s record.

SSA’s public rules explain the broad framework, but they do not settle every individual calculation. Use the agency’s current estimate and application channels to confirm eligibility, the amount payable and the effect of work or other family claims.
