Medicare Advantage trial rights can let you return to Original Medicare and buy Medigap without the usual medical underwriting, but only in two specific situations. Which policy you may buy and when to apply depend on whether you are leaving Medicare Advantage during your first year after joining at age 65, or returning after dropping Medigap to try Medicare Advantage. Your enrollment history, state rules, coverage end date and available policies all matter.
What a Medicare Advantage trial right does—and does not do
A trial right is a limited federal guaranteed-issue protection. It gives qualifying people an opportunity to leave Medicare Advantage and obtain certain Medigap coverage without being treated as though they can apply for Medigap only under ordinary medical underwriting rules. It is not a general right to change Medigap policies whenever you choose, and it does not automatically enroll you in Original Medicare or a Medigap policy.

Medicare describes two qualifying situations. One concerns someone who joined Medicare Advantage when first eligible for Medicare at age 65 and decides within the first year to return to Original Medicare. The other concerns someone who had Medigap, dropped it to join Medicare Advantage for the first time, and wants to return within a year. The rights differ: in the first situation, the person can buy a Medigap policy sold by an insurer in their state; in the second, the right may be to repurchase the former policy if the same insurer still sells it.
Medicare.gov’s “Learn How Medigap Works” advises: “If you want to switch to Original Medicare and buy a Medigap policy, contact your Medicare Advantage Plan to see if you’re able to disenroll.” That is a useful first step, but it does not answer whether a particular policy is available or establish your state-specific application deadline.

In practical terms, the trial right addresses the Medigap application—not every part of the transition. You still need to confirm that you can disenroll from your Medicare Advantage plan, establish when that coverage will end, identify a policy option that fits your pathway, and make a separate decision about prescription drug coverage. Treating those as separate checks can help prevent an assumption about one step from being mistaken for confirmation of the others.
Which trial-right pathway fits your history?
| Pathway | What must be true | Medigap option described by Medicare | Timing to check |
|---|---|---|---|
| First eligible at 65 | You joined Medicare Advantage (or PACE) when first eligible for Medicare at age 65, and decide within the first year to return to Original Medicare. | You can buy a Medigap policy sold by an insurer in your state. This does not mean every letter or policy is available in every state or circumstance. | For this pathway, Medicare says to apply as early as 60 days before your coverage ends and no later than 63 days after it ends. In certain circumstances, rights may last an extra 12 months; confirm your own deadline with your State Insurance Department. |
| Returning after dropping Medigap | You had Medigap, dropped it to join Medicare Advantage for the first time, have been in the Medicare Advantage plan less than a year, and want to return. | You may have the right to repurchase your former Medigap policy if the same insurer still sells it. If not, alternatives can depend on state law and your circumstances. | Confirm the dates and deadline with your State Insurance Department or SHIP. Do not assume the 60-days-before/63-days-after window stated for the first pathway applies to this situation. |
The distinction matters most if you previously held Medigap. A person using the first pathway is not described as having a right to reclaim a particular former policy; Medicare says they can buy a policy sold in their state. The second pathway is tied to the former policy, subject to the same insurer still selling it. If that policy is no longer sold, federal guidance does not establish which alternative you personally can obtain; state law and your facts control that question.
For example, someone who chose Medicare Advantage when first eligible at 65 should check the first pathway, even if they are now focused on finding a particular Medigap plan letter. Someone who had Medigap, dropped it to join Medicare Advantage for the first time, and wants to go back should ask about the prior-policy pathway. These examples do not settle eligibility by themselves: the dates, enrollment history, state and insurer’s current offerings still need to be checked.

How to check your eligibility and act in the right order
- Write down your enrollment history. Record when you first became eligible for Medicare, when you joined Medicare Advantage, whether you had Medigap before joining, whether you dropped it for the plan, and the dates of any changes. The two federal pathways hinge on those facts, not simply on your current wish to return to Original Medicare.
- Pin down the coverage end date. Ask your Medicare Advantage plan whether you can disenroll and when the disenrollment would take effect. Medicare recommends contacting the plan to check your ability to disenroll. Do not treat a request to leave as proof that the date is confirmed; keep the plan’s response and any termination notice.
- Contact your State Insurance Department. Ask which guaranteed-issue rights apply to your exact history, what application deadline applies, what policy options are available, and whether state law gives you protections beyond the federal trial rights. This is particularly important if your prior policy is no longer sold or you may qualify for an extension.
- Use SHIP for free local Medicare counseling. State Health Insurance Assistance Programs (SHIPs) can help you understand local Medicare choices and prepare questions about your situation. They are a resource for explaining options, not a substitute for confirming an insurer’s policy availability and the official deadline.
- Contact the insurer and apply within the confirmed window. For the first-eligible-at-65 pathway, Medicare’s federal guidance says you may apply as early as 60 days before the coverage ends and no later than 63 days afterward. Apply as soon as the window permits rather than waiting until its last day. For the prior-Medigap pathway, get the applicable dates confirmed rather than borrowing that window.
- Make a separate plan for prescription drugs. Medigap policies sold after 2005 do not include Part D drug coverage. If you need prescription drug coverage, determine separately whether you need a Medicare drug plan and how its coverage will line up with your transition.
Keep copies of enrollment records, letters, application materials and communications with the plan, insurer and state authorities. These records can help clarify which pathway applies and when coverage ends if dates are disputed or difficult to reconstruct. When you call, note who you spoke with, when you called, what deadline or policy option they described, and whether you need to follow up in writing.
What “guaranteed issue” does not guarantee
Guaranteed issue in this context is a defined protection tied to qualifying circumstances. It does not make every Medigap policy available in every state, promise a particular insurer will still offer your former policy, set a uniform price, or guarantee an effective date of your choosing. The policy options depend on the applicable pathway, state rules and what insurers sell.
Nor does a trial right create an unrestricted Medigap switching period. Medicare says that in most cases federal law does not allow someone to switch Medigap policies outside the six-month Medigap Open Enrollment Period unless a specific guaranteed-issue situation applies. State law may provide additional opportunities. If you want to change from one Medigap policy to another without leaving Medicare Advantage, do not assume trial rights apply; ask your State Insurance Department which protections cover your circumstances.

Medigap policy comparisons come after eligibility is established. Medicare says policies with the same letter generally provide the same basic benefits, while price is generally the difference between insurers. Massachusetts, Minnesota and Wisconsin standardize Medigap differently. Those general comparison points do not establish that you qualify for a trial right or that a specific policy is available to you. First verify your right and the policies offered in your state; then compare the options that are actually available to you.

Can I switch from Medicare Advantage to Original Medicare and get Medigap?
Possibly, if one of the two trial-right situations applies: you joined Medicare Advantage when first eligible for Medicare at age 65 and return within the first year, or you dropped Medigap to join Medicare Advantage for the first time and return within a year. Can I change my Medigap policy at any time?
No. Medicare says that in most cases federal law does not allow you to switch Medigap policies outside the six-month Medigap Open Enrollment Period unless a specific guaranteed-issue situation applies. State law may offer additional opportunities, so check with your State Insurance Department.
Can I buy any Medigap plan letter under a trial right?
Do not assume every plan letter is available. In the first-eligible-at-65 pathway, Medicare says you can buy a Medigap policy sold by an insurer in your state. In the prior-Medigap pathway, you may be able to repurchase your former policy if the same insurer still sells it; other options can depend on state law and your circumstances.
When should I apply for Medigap after leaving Medicare Advantage?
For the first-eligible-at-65 pathway, Medicare says you can apply as early as 60 days before your Medicare Advantage coverage ends and no later than 63 days after it ends. Certain circumstances may extend rights by 12 months. Confirm the exact deadline with your State Insurance Department, especially if you are using the prior-Medigap pathway.

Does Medigap include prescription drug coverage?
Medigap policies sold after 2005 do not include Part D drug coverage. If you need prescription coverage, determine separately whether you need a Medicare drug plan and how to coordinate it with your transition.
Where can I get free help checking my rights?
Your State Insurance Department can confirm state-specific rights, deadlines and policy availability. SHIP, the State Health Insurance Assistance Program, offers free local Medicare counseling to help you understand your options and prepare questions.
The Bottom Line
Medicare Advantage trial rights are limited, and the right policy depends on how you entered the plan. Confirm your enrollment dates and disenrollment end date, then verify your exact deadline and available policies with your State Insurance Department or SHIP. Do not assume a trial right guarantees any Medigap policy or covers Part D prescriptions.
