A wallet controls the cryptographic means to move assets; it does not, by itself, establish who legally owns them or how quickly a transfer will settle.
How an institutional custody transfer works
A typical transfer moves through an instruction, a control check, authorization, a blockchain transaction, and updated records. The details vary by institution and service arrangement, but the core steps connect custody operations to ledger activity.

- Receive the instruction. A client or authorized operator requests a transfer, withdrawal, or other transaction.
- Check entitlements and policy. The institution checks that the requester may act on the relevant client position, that the destination details are acceptable, and that required limits and approvals are met.
- Authorize the transaction. Authorized signers or a signing system approve the transaction under the institution’s controls. The signing arrangement may use multisignature, multi-party computation (MPC), or another design.
- Submit and monitor it. The transaction is sent to the relevant blockchain network, and the institution monitors its status.
- Update records. The institution reflects the movement in client position records and operational books, reconciling those records against ledger activity as appropriate.
Custody therefore includes more than control of signing authority. It also involves approvals, records, safe transfer procedures, monitoring, and arrangements for returning assets or the means of access. The Federal Reserve, FDIC, and OCC’s July 14, 2025 statement discusses risk management for bank crypto-asset safekeeping and says it “does not create any new supervisory expectations.”

What a wallet holds—and what it does not prove
A crypto wallet does not contain coins in the way a physical safe contains objects. It manages the cryptographic means used to authorize transactions and keeps track of ledger addresses or accounts. The assets are represented on the relevant ledger; the ability to authorize a transaction depends on control of the necessary signing authority.

Three layers should be considered separately:
- On-chain structure: the addresses or accounts through which assets are held or moved.
- Client accounting: the custodian’s records assigning positions to individual clients and reconciling those records with ledger activity.
- Legal treatment: the rights clients have to assets, including how segregation and return work under the custody agreement and applicable law.
A client-specific wallet can make on-chain attribution more direct. An omnibus wallet can pool assets belonging to multiple clients while the custodian tracks each client’s position in its own records. Neither an account label nor a statement alone proves how assets would be treated legally if a provider became insolvent. The custody agreement, governing law, and the provider’s actual arrangements matter.
Omnibus and segregated custody: the difference
“Segregated” can describe different things, so ask whether a provider means separation on the ledger, in its books, or in law. These forms of separation can work together, but they are not interchangeable.
| Arrangement | What it separates | What to verify |
|---|---|---|
| Client-specific wallet or address | On-chain holdings are attributed to a particular client or account. | Whether the arrangement also provides client-level records, appropriate access controls, and the intended legal treatment. |
| Omnibus wallet | Multiple clients’ assets may be pooled at the on-chain level; internal records assign positions to each client. | How client positions are recorded and reconciled, how the provider distinguishes client assets from its own, and what legal rights apply if the provider fails. |
| Client-versus-provider segregation | Client assets are kept distinct from the provider’s own holdings under the applicable legal and operational arrangements. | What the custody agreement and governing law require, and how the provider implements the separation in practice. |
For EU crypto-asset service providers covered by MiCA, Article 75 requires a custody agreement, a register of client positions, procedures for returning client crypto-assets or the means of access, and legal and operational segregation of client holdings from the provider’s holdings in the client’s interest, according to applicable law. The EU implementing rules call for disclosures about wallet separation and, where omnibus wallets are used, how clients’ assets are segregated from one another. These requirements are jurisdiction-specific; an omnibus arrangement should not be assumed to have the same legal effect everywhere.

How institutions govern signing authority
Key management is both a cryptographic design choice and a governance system. An institution needs to define who can initiate and approve transactions, how approvals are separated, how signing components are controlled, what policy checks apply, and what happens if a signer or component is unavailable.
Multisignature
A multisignature arrangement requires multiple keys or signatures under the rules of the relevant blockchain. The institution must still decide who controls those keys, who may approve a transaction, and how the required signers are coordinated.
Multi-party computation
MPC is a family of techniques in which participants jointly produce a signature without relying on a single participant to authorize alone. Implementations differ, so the label “MPC” does not reveal who controls signing components, what approvals are required, or how recovery works.

Neither multisignature nor MPC is inherently safer, faster, or more compliant in every implementation. Compare the actual signing policy, component custody, approval workflow, recovery design, supported assets, auditability, and operational dependencies. EU implementing rules require applicants to describe key approval and safeguarding, including arrangements involving multisignature wallets.

Backup and recovery
Recovery planning addresses events such as signer unavailability, incapacity, or key loss. It should specify how authorized staff regain the ability to act without bypassing the institution’s controls. A 2025 SEC-hosted document that discusses backup-key distribution is explicitly labeled a “DISCUSSION DRAFT”; it is a proposed model framework, not an adopted SEC rule or binding standard.
How custody affects settlement and liquidity
Settlement is the completion of a trade or transfer through movement of the relevant assets and corresponding records. In some arrangements, a client’s position can change in an institution’s internal records while the assets remain in an omnibus wallet. An external transfer or withdrawal requires a blockchain transaction. Those are different operational events, and the internal record change alone does not mean an on-chain transfer has occurred.

Custody affects how prepared an institution is to move assets, how its systems connect to trading and post-trade activity, and which operational or counterparty dependencies apply. The trade-offs are qualitative rather than universal performance measurements:
| Operating model | Potential advantage | Questions and trade-offs |
|---|---|---|
| Institution-operated self-custody | Direct control and the ability to integrate with ledger activity. | Does the institution have the staff, technical controls, recovery arrangements, monitoring, and post-trade systems it needs? |
| Exchange-based wallet | Convenient connection to trading and liquidity. | What counterparty exposure, pooling, withdrawal controls, and asset-use terms apply? |
| Third-party custodian | Specialized custody infrastructure and operational processes. | What are the legal relationship, segregation arrangements, key authority, recovery plan, sub-custodian chain, fees, and settlement process? Outsourcing can add risk-management dependencies and may affect the timing of on-chain settlement. |
| Wallet-as-a-service or platform wallet | Integration across trading or other digital-asset activity. | Who controls signing and operational policy, and is the integration’s cost and complexity justified by the institution’s needs? |
An institutional decision paper identifies exchange liquidity alongside counterparty and pooling risks, third-party custody alongside outsourcing and possible settlement latency, and self-custody alongside substantial integration work. Institutions may combine approaches, depending on their liquidity and security needs and their obligations.
Do these 3 things before closing this tab:
1Fix the driver behind crashes, sound loss and screen glitches2Repair Windows errors before they cause bigger problems3Scan for outdated or missing drivers - takes under a minuteThere is no single settlement time or finality threshold that applies across crypto-assets. Timing depends on the ledger, transaction conditions, custody workflow, and any intermediary or contractual process. How the rules differ by jurisdiction
United States: bank safekeeping and national bank authority
On July 14, 2025, the Federal Reserve, FDIC, and OCC issued a joint statement on risk-management considerations for bank crypto-asset safekeeping. The agencies said it discusses existing risk-management principles and “does not create any new supervisory expectations.” It should not be described as a new custody rule.
In a May 7, 2025 release, the OCC said Interpretive Letter 1184 confirmed that national banks and federal savings associations may buy and sell assets held in custody at a customer’s direction and may outsource bank-permissible crypto custody and execution, subject to appropriate third-party risk management. The OCC also said custody, including through a sub-custodian, must be conducted safely and soundly and in compliance with applicable law. This statement of authority does not apply automatically to every U.S. financial institution or state-regulated entity.
European Union: MiCA custody duties
MiCA Article 75 sets requirements for covered crypto-asset service providers, including a custody agreement, client-position records, procedures to return assets or means of access, and client-versus-provider segregation under applicable law. The implementing rules specify information applicants must provide about wallet separation, client segregation in omnibus arrangements, key approvals and safeguarding, custody policy, operational and ICT risks, third-party delegation and oversight, and return procedures. Article 75 also addresses liability for loss attributable to the provider.

FINMA’s January 12, 2026 announcement for Guidance 01/2026 highlights ledger technology, the need for expertise and robust infrastructure, cross-border custody and insolvency complexity, and oversight of providers. How to evaluate a custody arrangement
Compare the full operating and legal arrangement, not just the wallet type or signing technology. An institution assessing a provider or its own custody setup can ask:
- Which law and jurisdiction govern the custody relationship, and what rights apply if the provider becomes insolvent?
- How are client assets separated from provider assets, both operationally and legally? If assets are pooled on-chain, how are individual client positions recorded and reconciled?
- Who can initiate, approve, and sign transactions? How are approvals separated and policy checks enforced?
- How are signing components backed up, and how does the institution recover from signer unavailability or key loss?
- What withdrawal controls, monitoring, and settlement procedures apply to each supported asset and network?
- Does the arrangement rely on subcontractors or sub-custodians? Who oversees them, and what happens if one is unavailable?
- What operational resilience, system integration, and ongoing costs does the model require?
No single custody model answers all of these questions. The appropriate choice depends on the institution’s legal obligations, desired control, liquidity needs, operational capacity, and tolerance for counterparty and outsourcing exposure.
