A GST-registered Indian SaaS company buying software or another service from a supplier outside India may have to pay IGST under the reverse-charge mechanism. CBIC’s published guidance says the payment currency does not change that result: the key checks are who supplied the service, which Indian recipient received it, and where the place of supply falls under the IGST Act. Finance teams should document those facts, confirm the applicable classification and rate, create the required recipient-side invoice record, and assess input tax credit separately. This is a practical overview, not advice on a specific contract; the official material discussed here was checked on 9 October 2026.
When an overseas subscription is an import of services
Start with the statutory import-of-services test, rather than the currency charged or the name of the product. Under the IGST Act, a service is an import when three conditions are met: the supplier is located outside India, the recipient is located in India, and the place of supply is in India. CBIC’s sectoral FAQ applies this framework to foreign software bought for use in a GST-registered Indian firm and says IGST is payable under reverse charge when the conditions are satisfied.

- Supplier: Identify the legal entity that actually supplies the service. A product’s brand, website or payment processor may not be the contracting supplier.
- Recipient: Identify the Indian business establishment or GST registration that receives the service. The company name alone may not settle this if it has more than one establishment or registration.
- Place of supply: Apply the relevant IGST Act rule. The general rule for cross-border services places supply at the recipient’s location, but statutory exceptions can change the analysis. OIDAR services have a recipient-location rule of their own.
These are transaction-level questions. A subscription described as “SaaS” is not, by that label alone, enough to establish the supplier, recipient, place of supply, tax classification or rate. Preserve the contract and billing details that allow the company to make and support those determinations.

CBIC expressly says the currency used to pay consideration is immaterial in its answer about foreign software used by a GST-registered firm. An INR charge, local card statement or conversion through a payment intermediary does not by itself establish that the supplier is in India or that the transaction is not an import. Conversely, the currency alone does not establish that reverse charge applies; the import conditions still need to be checked.

How registered and unregistered recipients differ
Recipient status matters, especially for online database access and other services that may qualify as OIDAR. The CBIC FAQ says a registered person obtaining online database access from abroad pays applicable IGST under reverse charge. It contrasts that case with an unregistered recipient, for which its explanation says the supply is treated as OIDAR and the provider is liable to register and pay tax. Read that explanation alongside the statute and the facts rather than treating “unregistered business” as automatically identical to “consumer.”
The IGST Act defines OIDAR as a service delivered over the internet or an electronic network that is essentially automated, involves minimal human intervention, and cannot be supplied without information technology. Cloud services are expressly included in the definition. Whether a particular service fits the definition depends on the service supplied, not just on the fact that the customer accessed it online.

The Act also defines a “non-taxable online recipient” as an unregistered person receiving OIDAR for a purpose other than commerce, industry, or business or profession. Section 14 places liability on the supplier located in non-taxable territory when it supplies OIDAR to such a non-taxable online recipient, subject to rules concerning intermediaries. That specific statutory category is narrower than simply every person without a GST registration. If the recipient is unregistered but uses the subscription for business, do not assume the consumer-facing rule settles the case; have the relevant status, service and current statutory provisions checked.
| Case to assess | What the official material indicates | What to verify |
|---|---|---|
| GST-registered Indian business; overseas software or online database service | CBIC says the registered recipient pays applicable IGST under reverse charge when the import-of-services conditions are met. | Actual supplier, receiving Indian establishment, place-of-supply rule, classification and rate. |
| Unregistered recipient receiving OIDAR for non-business purposes | The Act’s non-taxable online recipient framework places liability on the overseas supplier, subject to intermediary rules; CBIC’s FAQ gives a simplified contrast with the registered case. | Whether the person is in the statutory category, whether the service is OIDAR, and whether an intermediary rule applies. |
| Unregistered recipient using an online service for business | The cited FAQ’s consumer-oriented contrast does not establish a universal answer for every unregistered business. | Purpose of use, recipient status, service type, supplier/intermediary arrangement and current law. |
A practical month-end workflow for the finance team
A repeatable process reduces the risk of relying on a vendor’s payment screen or a generic software label as the tax analysis. Keep one record per subscription or contract, and update it when the supplier, contracting entity, receiving establishment, service features or terms change.

- Collect the transaction documents. Retain the agreement or order form, the foreign supplier’s legal name and address, the vendor invoice or billing statement, subscription dates, payment evidence, and a description of the service. Note which Indian GST registration or establishment uses and receives it.
- Establish the supplier and recipient. Compare the contracting entity with the entity named on invoices and payment records. Where a company has multiple Indian GST registrations or establishments, determine which establishment is most directly concerned with receiving the service. The IGST Act uses that concept to identify the recipient’s location when more than one establishment is involved.
- Document the place-of-supply analysis. Apply the general recipient-location rule for cross-border services unless a statutory exception or the OIDAR rule is relevant. Record why the selected rule fits the service; do not treat an Indian billing address or INR payment as a substitute for that analysis.
- Determine whether reverse charge applies. If supplier location, recipient location and place of supply satisfy the import test for the registered business purchase, CBIC’s guidance says the recipient pays IGST under reverse charge. If one element is unclear or an exception may apply, escalate the contract for tax review rather than forcing it into a standard SaaS category.
- Prepare the recipient-side invoice record. CBIC says a registered person liable to reverse charge on a service received from a person located outside India must issue a self-invoice on the date of receipt. Its guidance also says to report that invoice in the GST return for the month in which the supply takes place. Confirm the current rule, timing and filing mechanics for the company’s circumstances before configuring a recurring process.
- Confirm classification and applicable rate. Use the service actually supplied and the relevant current rate entry. Do not automatically assign a rate because the vendor calls the product software, cloud or SaaS.
- Assess input tax credit independently. After determining the reverse-charge liability, check the current statutory ITC conditions, business use, supporting records and any restrictions applicable to the company. Do not presume that payment under reverse charge makes an equal credit automatically and immediately available.
- Reconcile at close. Match the subscription register against invoices, payment records, self-invoice records and the return treatment for the relevant period. Investigate missing documents, changes in the vendor entity, duplicate subscriptions or a mismatch between the receiving registration and the accounting record.
Keep an audit trail that explains the decision
A useful file should let someone other than the original buyer understand why the company treated a charge as an import, which registration received it, what service was classified, and how the reverse-charge and ITC decisions were reached. Retain the reasoning with the underlying contract and billing evidence rather than storing only a tax code in the accounting system. If a vendor changes its contracting entity or restructures billing, revisit the analysis instead of carrying the previous conclusion forward automatically.
Rate: why 18% is not a universal SaaS answer
CBIC’s rate schedule lists a total rate of 18% for the general category of other professional, technical and business services under heading 9983. The schedule presents the combined CGST/SGST equivalent for that entry; the cited material does not establish that every overseas SaaS subscription belongs under heading 9983. The relevant classification must be determined for the actual service and checked against the current rate entry before applying or quoting 18%.

Separate the classification question from the reverse-charge question. Establishing that a registered recipient must pay tax under reverse charge does not, by itself, establish the service’s heading or rate. Likewise, a rate entry that might fit a general services category is not proof that a particular subscription belongs there. Record the basis for the classification, and obtain tax advice where contract scope or service features make the category uncertain.
Input tax credit is a separate decision
Reverse-charge payment and ITC eligibility are related but distinct questions. The sources cited here do not resolve every ITC condition for every software subscription. The finance team should test the company’s particular facts against current statutory requirements, including whether the service is used for business, what supporting documentation is required, and whether any restriction applies. Avoid booking an assumed credit solely because the company has paid IGST under reverse charge.

Where the business has more than one GST registration, ensure the tax and any credit are assessed in relation to the registration that received the service, rather than treating the corporate group as a single undifferentiated recipient. The transaction file should make the receiving establishment and the credit analysis clear. If use is shared across registrations or locations, seek advice on the correct treatment instead of inventing an allocation from the vendor’s invoice total.
Common errors and how to prevent them
- Using payment currency as the deciding test: CBIC says currency is immaterial. Determine supplier, recipient and place of supply instead.
- Treating every online purchase as OIDAR: OIDAR has a statutory definition involving automation, minimal human intervention and dependence on information technology. Review what the vendor actually provides.
- Equating every unregistered person with a consumer: The statutory non-taxable online recipient definition includes a non-business-purpose condition. Check purpose and status rather than relying on a shorthand summary.
- Assuming a vendor invoice replaces the recipient’s self-invoice: CBIC says the registered reverse-charge recipient must issue a self-invoice for the covered service. Confirm current requirements and maintain the recipient-side record.
- Applying 18% to all SaaS: The cited 18% entry is for a general heading 9983 category and does not classify every software subscription. Verify the specific service and current schedule.
- Claiming credit automatically: Determine ITC eligibility under the applicable current conditions after establishing the reverse-charge liability.
- Ignoring a multi-registration structure: Identify the establishment most directly concerned with receiving the service and align the record with that recipient.
Use current rules for filing mechanics
CBIC’s FAQs provide published guidance on imports, reverse charge, OIDAR and self-invoicing, while the IGST Act supplies the statutory definitions and place-of-supply framework. The FAQ contains older statutory language in places, so a company should verify filing mechanics and statutory amendments against the current consolidated rules before relying on a recurring process. The published guidance establishes the broad treatment of the examples it addresses; it does not determine classification, rate or credit for an individual vendor agreement.
For a difficult case, give the tax adviser the contract, invoices, supplier identity, service description, receiving GST registration, usage facts and payment path. A question framed only as “Do we pay GST on SaaS?” leaves out the facts needed to resolve import status, place of supply, OIDAR treatment, rate and ITC.
