How HUD and USDA Environmental Reviews Affect Federally Assisted Housing Projects

HUD and USDA housing projects do not all follow one environmental review. The funding program, activity, site, and agency determine the review route and timing.

Whether a federally assisted housing project needs an environmental review—and who conducts it—depends on its funding program, activity, location, and governing law. HUD projects may follow Part 50 or, when the program permits, Part 58; USDA Rural Development now follows the department-wide framework in 7 CFR part 1b. For covered HUD activities, environmental clearance must come before commitment or expenditure of project funds. A September 2026 HUD-USDA agreement sets coordination goals, but it does not yet establish one shared clearance process.

What an environmental review means for a housing project

An environmental review evaluates potential project impacts and whether conditions at a site could harm residents. Depending on the activity and location, the review may involve requirements concerning noise, hazardous operations, floodplains, wetlands, historic preservation, or other federal authorities. These checks are not identical for every project: the applicable laws and scope depend on the program, proposed work, and site.

That makes review a planning issue, not just a final application form. The applicable process may affect site selection, design, funding sequence, construction timing, and coordination with agencies responsible for related laws. Confirm the required route and scope with the agency administering the assistance before committing funds or proceeding on the assumption that another project’s review applies.

HUD: who conducts the review under Part 50 or Part 58?

HUD’s regulations distinguish between reviews HUD conducts itself and reviews that an authorized responsible entity may assume. A local government does not automatically have authority to conduct a Part 58 review for every HUD program; the program’s statute must allow it.

Route Who is responsible What determines whether it applies
Part 50 HUD performs the environmental review. Applies to programs for which HUD retains review responsibility, including programs whose legislation does not permit a responsible entity to assume it. Confirm the specific program route.
Part 58 An eligible responsible entity assumes the federal review responsibility. HUD identifies states, tribes, and units of general local government as eligible entities. Available only where the governing program law permits assumption. The responsible entity owns the review’s scope, content, and finding.

HUD’s environmental regulations index describes Parts 50 and 58 and related authorities. HUD’s Special Applications Center also explains the distinction, but a general rule of thumb is not a substitute for confirming the route that applies to the project’s program.

When HUD clearance must happen

For covered HUD project activities, environmental clearance must precede commitment or expenditure of funds. The level of review varies with the assistance and activity, so do not treat every housing award as requiring the same analysis—or infer that a particular activity is exempt without checking its program rules.

HUD’s notice on public housing agency activities gives a bounded example: tenant-based rent subsidies without physical changes are generally not subject to NEPA review in the same way as site acquisition or development. That example is specific to its context and does not establish the treatment of other activities or eliminate consideration of other requirements.

USDA Rural Development: the current framework is part 1b

USDA Rural Development’s former agency-specific NEPA rule, 7 CFR part 1970, was removed in 2026. USDA’s May 12, 2026 announcement said Rural Development programs would follow the department-wide framework in 7 CFR part 1b; the April 3, 2026 Federal Register final rule confirms the consolidation and rescission of part 1970. Applicants should therefore not rely on the superseded part 1970 process as the current rule.

Some USDA Rural Development instructions still say that part 1970 remains in effect, which conflicts with the later final rule and USDA announcement. Those instructions also point applicants to State Environmental Coordinators for certain Rural Housing Service projects and other programs. Treat that contact direction as a way to seek project-specific guidance, not as confirmation that an older technical workflow remains current. The detailed applicant workflow for housing under part 1b is not established by the cited USDA materials; ask the appropriate Rural Development environmental official which steps and documentation apply.

What the September 2026 HUD-USDA agreement changes—and what it does not

HUD’s September 29, 2026 announcement describes a memorandum of understanding (MOU) for coordination between the departments. Its stated objectives include evaluating categorical exclusions for HUD- and USDA-funded housing; developing a process to designate a lead agency and streamline adoption of the other department’s approved environmental assessments and impact statements for jointly funded housing; maintaining compliance with Part 58 as it stood on January 1, 2025, subject to any categorical-exclusion changes made through standard rulemaking; and evaluating whether joint physical inspections are feasible.

These are coordination objectives, not a published, completed joint procedure. The announcement does not give an implementation date, establish a new categorical exclusion, set out an operational lead-agency process, or say that one department’s clearance automatically satisfies the other’s requirements. For a project with both HUD and USDA funding, confirm the review responsibilities and accepted records with both agencies rather than assuming the MOU creates a single clearance.

How to plan a project that may involve HUD, USDA, or both

  1. Identify the exact assistance and work. List each funding program and the proposed activity, including site acquisition, physical development, rehabilitation, or assistance without physical changes. The review route and scope depend on these specifics.
  2. Confirm the responsible reviewer. For HUD assistance, establish whether Part 50 applies or whether the program permits an eligible responsible entity to assume Part 58 responsibility. For USDA Rural Development assistance, contact the appropriate environmental official about the project under part 1b.
  3. Raise site and design issues early. Ask which location- and activity-dependent checks apply, including any relevant noise, hazardous-operations, floodplain, wetland, or historic-preservation requirements. A change in site or design may affect the analysis.
  4. Sequence funding and work around clearance. For covered HUD activities, obtain clearance before committing or spending project funds. Confirm the applicable program’s timing rules and any permitted exceptions before taking action; do not treat application approval as environmental clearance.
  5. For joint funding, confirm coordination directly. Ask each agency which reviewer is responsible, what documents it will accept, and whether any announced coordination process is operational for the project. Do not presume there is a shared review or inspection procedure.

Where to check HUD review records

HUD’s online environmental records resources make environmental assessments and categorically excluded reviews available, surface records during comment periods, and state that tiered reviews are available for five years. For a live review, use the comment contact and submission instructions in that specific record; the record governs how the public can comment on that matter.

HUD’s environmental laws and regulations index is also a starting point for the agency’s descriptions of Parts 50, 51, 55, and 58 and related authorities. The index’s displayed content date is September 17, 2025, so consult the administering agency for project-specific requirements and any later changes.
