To clear a reverse mortgage after a borrower dies, heirs must first establish with the servicer who is authorized to act, confirm that the loan is due, obtain a written payoff or approved resolution, and then verify that the lien release is recorded in the local land records. Paying the balance and clearing the public title record are separate steps.
The 95%-of-appraised-value option and the timelines described below apply to FHA-insured Home Equity Conversion Mortgages (HECMs), not automatically to proprietary reverse mortgages. For a proprietary loan, the contract and servicer’s written instructions control.

First confirm who can act and whether the loan is due
A reverse mortgage is a loan secured by the home; it does not make the lender the owner. The borrower retains title while the loan is outstanding. The Consumer Financial Protection Bureau (CFPB) explains that a home generally remains in the borrower’s ownership, even though the home secures repayment.
Before requesting account details or arranging a sale, identify the loan and the people whose status affects its due date. Find the latest statement and, if available, the recorded mortgage or deed of trust. Confirm the servicer’s identity and whether the loan is an FHA-insured HECM or a proprietary reverse mortgage. The distinction matters because the HECM rules summarized here may not be present in a proprietary loan contract.

For a HECM, a borrower’s death does not necessarily mean the loan must immediately be paid off. A surviving co-borrower or, in applicable circumstances, an eligible nonborrowing spouse can affect whether and when the loan becomes due. CFPB guidance says a HECM generally becomes due after the last borrower and any eligible nonborrowing spouse have died. Ask the servicer whether it has formally declared this loan due and payable and request the notice or written status confirmation.
- Record the borrower’s name, property address, servicer, and any loan or case identifier shown on the statement.
- Ask whether there is a surviving co-borrower or eligible nonborrowing spouse whose status affects the loan.
- Ask whether a due-and-payable notice has been issued, when it was issued, and what response deadline it states.
- Read the notice and loan documents; do not assume that a general HECM timeline applies to a different product or overrides the servicer’s notice.
If the servicer’s records do not match the family’s understanding—for example, if it treats a borrower as deceased when a co-borrower is still living—ask for the specific status issue and documentation it needs to correct its records.
Establish successor authority before requesting details
Notify the servicer of the borrower’s death and ask, in writing, what it requires to recognize the person contacting it as a successor in interest, heir, executor, or other authorized representative. A person who expects to inherit the home should not assume that relationship alone entitles them to receive loan-account information or make decisions for the estate.
CFPB examples of documents a servicer may request include an executed will and death certificate or a letter from the executor. The exact proof can depend on state law and the estate’s circumstances. Ask the servicer to provide its documentation requirements, submission address or approved delivery method, and any form it requires. Keep a copy of every document and delivery confirmation.

- Report the death. Contact the servicer through a phone number or address on a recent statement or another independently verified official source. Ask how it wants to receive the death certificate and other documents.
- Request its successor-document checklist. Get the specific requirements in writing, including what establishes the caller’s authority and what proves a right to the property.
- Submit the documents using the stated channel. Include the loan identifier and property address so the servicer can associate the paperwork with the correct account.
- Resolve missing items specifically. If the servicer says the file is incomplete, request a written list of the missing or unacceptable documents and ask how each item should be corrected.
- Clarify authority to transfer title. If probate, an executor’s powers, or the identity of the lawful successor is uncertain, consult an estate attorney or local title professional before signing a deed or accepting a transfer.
CFPB consumer guidance recognizes that heirs may need to show their right to the home before receiving mortgage information. A servicer’s successor-review process and the state’s rules for estate authority are related but distinct: being approved to receive account information does not, by itself, settle every question about who can convey the property.
Request a written payoff and check its terms
Once the servicer recognizes the person entitled to request information, ask for a current written payoff statement. A balance displayed on an older monthly statement is not a substitute for a payoff quote: the amount may be tied to a particular date, and the statement may not provide the payment instructions or date through which that amount is valid.
Check the quote against the borrower and property records, and make sure it states what is needed to complete the transaction. A useful review includes:
Recommended Free Tools
- The borrower’s name, property address, and loan or case identifier, if available.
- The total amount due and the date through which that amount is good.
- Any daily accrual after the good-through date, or instructions for obtaining an updated quote if payment will arrive later.
- The payment recipient, permitted payment method, and delivery instructions.
- Any other amount or action the servicer says is required for the loan to be treated as satisfied.
If the quote is unclear, inconsistent with the servicer’s prior communication, or has instructions that seem unexpected, pause before sending money. Call the servicer using a number from a recent statement or another official source you located independently. Ask it to confirm the amount, date, and payment instructions, then obtain corrected instructions in writing. CFPB’s 2026 mortgage-servicing examination procedures direct examiners to assess whether servicers provide accurate payoff information to successors; that is a reason to verify a quote carefully, not a guarantee that every initial quote will be error-free.

Use caution with a specific HUD warning: HUD says a payoff statement for a lien held by the HUD Secretary that includes wire instructions is fraudulent. That warning applies to Secretary-held liens. It does not establish that all reverse-mortgage payment instructions are fraudulent or that every HECM is a Secretary-held lien. If the loan is identified as a Secretary-held lien and the statement includes wire instructions, do not use them; report the statement through HUD’s specified official contact channel and request a correct statement. For another loan, independently verify the instructions with its servicer rather than generalizing that alert.
Choose a resolution based on the loan, value, and estate’s goal
For a HECM that is due, the heirs’ practical choices generally turn on whether they want to keep the property, sell it, or ask the servicer about a deed-in-lieu. Compare the current payoff terms with an appraisal and consider who has legal authority to act. The options below are not interchangeable, and the 95% provision is a HECM option under the circumstances described—not a general discount for every reverse mortgage.
| Possible path | When it may fit | What to confirm |
|---|---|---|
| Pay the full balance and keep the home | The heir or estate wants to retain the property and can arrange full repayment. | Obtain a current written payoff, confirm how long it is valid and how to pay, and ask the servicer what confirmation and release process follows receipt. |
| Sell the home and repay the loan | The estate or heirs choose not to keep the property. | Compare the sale proceeds with the written payoff and transaction timing. If the home sells for more than the debt, the surplus after repayment goes to the estate or heirs. |
| Use the HECM 95%-of-appraised-value option | CFPB says eligible heirs may satisfy a HECM by paying or selling for at least 95% of appraised value when the debt exceeds the home’s appraised value. | Ask the servicer to confirm that this option applies, what appraisal it will accept, the applicable amount, and how to complete the transaction. Do not calculate eligibility from an informal estimate alone. |
| Ask whether a deed-in-lieu is available | The heir or executor is considering transferring the property rather than completing a sale or repayment. | Confirm that the servicer will consider it and that the person signing has legal authority. HUD’s sample notice says the property must be free of liens or encumbrances; probate may be necessary in some states. |
The CFPB describes a HECM due-and-payable notice as generally giving 30 days to buy, sell, or turn over the home. An extension of up to six months may be possible. Those are program-related timeframes, not permission to wait without communicating: contact the servicer promptly, ask what deadline applies to this case, and request any extension in the manner and by the date it specifies. Do not treat an extension as approved until the servicer confirms it.

Scan for outdated or missing drivers - takes under a minuteDriver Scan →Repair Windows errors before they cause bigger problemsFix Now →For a deed-in-lieu, the servicer’s willingness to consider the option does not cure an estate-authority problem. HUD’s sample notice identifies legal authority to transfer ownership and the absence of other liens or encumbrances as conditions to address. Ask the servicer what it requires and get local legal advice if probate, title ownership, or another lien is unresolved.

Make the payment safely and preserve the record
Use only payment instructions that have been verified with the servicer through an independently sourced contact channel. If funds are being sent by wire, re-confirm the recipient and instructions using that channel rather than relying only on a message or document that provides new instructions. Keep the written payoff, the verified instructions, proof of the funds sent, and evidence that the servicer received or accepted them.
If the payment will arrive after the quote’s good-through date, request an updated payoff or follow the quote’s written update instructions before sending funds. Ask the servicer what happens if the amount received is short or arrives after the stated date, and how any remaining amount will be calculated. Do not infer from a bank’s transfer confirmation alone that the mortgage has been paid in full; it shows the transfer was initiated or processed by the bank, not necessarily that the servicer applied it as intended.
After payment or another approved resolution, request written confirmation from the servicer that the loan has been satisfied or otherwise resolved and ask who will prepare and record the lien release. Keep the servicer’s confirmation with the payoff quote and payment records. The exact form may be called a release, satisfaction, or reconveyance depending on the instrument and local practice.

Verify the lien release in the public land records
A payoff letter or receipt is not the same thing as a recorded release. The lien is cleared from the public title record when the appropriate release, satisfaction, or reconveyance is recorded according to the local process. The FDIC describes recording a release with the same local recording official that recorded the original mortgage or deed of trust.

- Identify the original instrument. Use the recorded mortgage or deed of trust to note the county or other local recording jurisdiction, the original recording date, and the instrument or document number if shown.
- Ask who handles the release. Contact the servicer and ask whether it or another party will prepare and record the release, where it will be filed, and how you can obtain a copy or recording reference.
- Search the appropriate land-records office. Check the county recorder, register of deeds, or equivalent official land-records office for a release associated with the original loan and property.
- Match the release to the lien. Compare the property and borrower information and, where available, the original instrument reference. A record for a different lien or instrument does not establish that this mortgage has been released.
- Follow up if the record is missing. Ask the servicer for the recording date, instrument number, or a copy of the recorded document. A title company or attorney can help investigate a missing release or a chain-of-title issue.
Recording times and procedures vary by locality, and no single deadline applies everywhere. Ask the local recording office what processing period it uses rather than assuming that the release should appear on a particular date. If the servicer says it recorded the document, the recording reference can help the office locate it. If the servicer cannot confirm recording or the land-record search still shows the lien, request a clear written status and consider help from a title professional or attorney.
Keep the HECM rules and local requirements in perspective
The CFPB’s consumer guidance, reviewed in 2026, gives the 30-day period following receipt of a due-and-payable notice and the possible extension of up to six months, as well as the HECM option involving at least 95% of appraised value when the debt exceeds the home’s value. These are program rules and timelines, not statistical estimates, and they should be applied only after the servicer confirms how they fit the loan and the particular notice.
State law can affect which documents establish successor authority, whether probate is needed, and who may transfer title. County or local recording practice governs the precise release procedure and processing time. Because no state or county is specified here, the exact probate forms, release deadlines, fees, and required recording documents cannot be determined in advance. Use the servicer’s written instructions for the account and the local recording office’s procedures for the property; seek state-specific legal or title help if the estate’s authority or the recorded chain of title is unclear.
CFPB identifies HUD-approved housing counseling as an assistance route for people handling HECM questions. A counselor can be useful when heirs need help understanding the options, while an estate attorney or title professional is better placed to address authority to convey property, probate, other liens, or a missing public-record release.
