Access to a road or bridge on payment of toll is covered by the toll-access exemption in Entry 23 of Notification No. 12/2017-Central Tax (Rate). A higher amount charged because a vehicle lacks a valid functional FASTag can receive the same treatment when it is still consideration for road access. A tag issuer’s service fee and a parking charge are separate questions and cannot be treated as exempt merely because they appear on the same statement.
Start with the supply: what does the customer receive?
The quickest way to avoid a GST mistake is to identify the underlying supply. A toll pays for permission to use a specified road or bridge. A FASTag-related charge may pay for a physical RFID tag, account administration, replacement, or another issuer service. A parking payment buys the right to occupy a parking space, sometimes together with security, valet, access-control, or other facilities. Those are different supplies even when one operator collects the money or one app displays all of the transactions.

| Charge | What the customer receives | Relevant GST question |
|---|---|---|
| Highway toll | Access to a road or bridge for the stated toll | Does the supply meet the road-or-bridge toll exemption in Entry 23? |
| Higher toll for no functional FASTag | Road or bridge access, collected at a higher amount because the vehicle lacks a valid functional tag | Is the extra amount still essentially a toll for access, as addressed by Circular No. 177/09/2022-GST? |
| FASTag issue, purchase, replacement or servicing fee | A tag or an issuer’s account, processing or support service | What is the separate service and what classification and rate apply to it? |
| Parking charge | Use of a parking place, potentially with additional facilities | Who supplies it, under what arrangement, and does a specific current exemption or rate apply? |
The table is a classification framework, not a blanket rate chart. The available official material establishes the toll-access exemption and particular toll surcharges; it does not establish one rate for every tag fee or every parking model.
Highway tolls: the exemption is for access to a road or bridge
Entry 23 of Notification No. 12/2017-Central Tax (Rate) describes the exempt supply as “Service by way of access to a road or a bridge on payment of toll charges.” The consolidated text published in 2019 identifies the entry under Heading 9967 with Nil tax. In practical terms, the amount that is consideration for using the tolled road or bridge is the amount to test against this entry.

- Important Note: These are blank cards without pre-programmed card numbers. You cannot directly add them to RFID locks or use a card reader to read them. Before use, you must first write data(card numbers) into them by a 125KHZ RFID card writer. They are not IC cards or NFC cards. They don't work for TTLock or Tuya smart locks which use 13.56MHZ frequency. More product info and FAQ is listed in the Product Description. Please read the description before purchase.

What falls within the toll concept
- The ordinary amount displayed as the toll for crossing or using the road or bridge.
- A toll collected by the concessionaire or another authorised toll-collecting arrangement where the customer is paying for that access.
- A separate amount that an official clarification treats as a higher toll, such as the no-functional-FASTag amount or an overloading-related higher toll, when it remains payment for the same road access.
What the exemption does not automatically cover
- A product or service sold near a toll plaza, including a physical tag or account service.
- Administrative, convenience, replacement, or support fees charged by a payment intermediary or issuer.
- Parking, food, fuel, repairs, or other facilities at a highway stop.
Read the invoice description and the contractual arrangement rather than assuming that every line collected at a toll location is a toll. The legal description is tied to the customer’s access to the road or bridge.
Higher toll when a vehicle has no valid functional FASTag
Circular No. 177/09/2022-GST addresses the question often phrased as whether “the additional toll fees collected in the form of higher toll charges from vehicles not having fastag” are exempt. Paragraph 12.6 states that the additional fee is essentially payment of toll for allowing access to roads or bridges and may receive the same treatment as toll charges.
How to apply that clarification
- Confirm that the vehicle was charged a higher amount for entering or using the road or bridge because it did not have a valid functional FASTag.
- Identify the amount as a higher toll or access charge on the toll record, rather than as an issuer’s service fee.
- Apply the toll-access treatment to that higher toll, subject to the current notification and the exact facts of the transaction.
The circular does not say that every charge appearing in a FASTag account is exempt. Its subject is the higher amount collected for road access when the required tag is not functional or available.

Overloading charges at a toll plaza
Circular No. 164/20/2021-GST deals with overloading charges collected as a higher toll at toll plazas. Where the amount operates as a higher toll for the same access to the road or bridge, the circular connects it with the toll-access exemption. The wording and facts matter: an amount labelled as a penalty, enforcement fee, or unrelated service would need its own analysis rather than being relabelled a toll automatically.
For accounting, retain the toll receipt or electronic record showing the vehicle, plaza, date, base toll and higher amount. That evidence helps demonstrate that the surcharge was collected as part of the access charge addressed by the circular.
FASTag fees: separate the tag service from the toll
A FASTag transaction can contain more than one economic component. The toll itself may be collected through the tag, while the issuer separately supplies the RFID sticker, maintains the account, processes a replacement, or provides customer support. The toll circular does not decide GST on all of those issuer or tag-related fees.

Common fee types to identify
- Tag purchase or issuance: payment for the physical RFID tag and the issuer’s onboarding service.
- Replacement or reissuance: a charge for a new tag or account action after loss, damage or vehicle changes.
- Account or service fee: a stated fee for administration, alerts, support, or another issuer function.
- Recharge amount: money placed in the account to fund future tolls. The recharge balance is not, by itself, proof that an issuer service fee is exempt; examine any fee deducted or separately invoiced.
Ask for an itemised statement when the issuer combines a toll debit with a fee. The document should distinguish the amount passed through or collected for the road access from the issuer’s own consideration. Do not describe the entire debit as “GST-exempt FASTag” without identifying which supply each line represents.

Why the distinction matters
Two amounts can be collected in one digital transaction while having different suppliers, tax treatments and records. A toll concessionaire may supply access, whereas a bank or authorised issuer may supply the tag or account service. If a business claims an exemption or records an expense, it should preserve the issuer invoice, fee schedule and toll statement rather than relying only on the wallet deduction.
Parking charges are not automatically tolls
Parking is a separate supply because the customer is paying to occupy a parking place, not to travel along a road or cross a bridge. The fact that the parking area is beside a highway, inside a transport facility, or paid through a FASTag-linked system does not by itself bring the charge within Entry 23.

Identify the operator and arrangement
- Municipal parking: determine whether the municipality operates the lot directly, grants a collection contract, or supplies parking as part of another public facility.
- Private parking: identify the private operator, the rights granted to the customer, and any bundled security, valet or access-control service.
- Bundled parking: examine whether parking is included with an event ticket, hotel stay, shopping purchase, office lease or transport service, and whether the contract treats it as a distinct or composite supply.
- Digital or barrier-free parking: match the electronic debit to the operator’s invoice or receipt; the payment channel does not determine the GST classification.
Official municipal material cited in an advance-ruling appeal places parking lots among public amenities in the context of municipal functions. That limited, case-specific context does not establish a universal exemption or a single GST rate for private parking, every municipal collection model, or every bundled arrangement. Check the current notification and classification for the actual supplier and contract.
How to classify a real invoice: a practical process
- List every line item. Separate base toll, higher toll for no functional FASTag, overloading-related higher toll, tag charge, account fee, parking, convenience fee and any other amount.
- Write the customer benefit beside each line. Use “road or bridge access,” “physical tag,” “issuer/account service,” “parking place,” or another precise description.
- Identify the supplier and collector. A toll concessionaire, issuer, municipality, private parking operator and bundled provider may be different entities even when one app collects payment.
- Match the road-access items to the current exemption text. Entry 23 is framed around access to a road or bridge on payment of toll charges. Check the notification as amended on the transaction date.
- Test special toll amounts against the circulars. For no-functional-FASTag higher tolls, use Circular No. 177/09/2022-GST; for overloading charges collected as higher toll, use Circular No. 164/20/2021-GST.
- Analyse parking independently. Confirm the operator, place, contract and any composite-supply issue before selecting a rate or exemption.
- Reconcile the documents. Keep the toll receipt, issuer invoice, parking receipt, contract and payment statement together so that a combined debit can be reconstructed.
Worked examples
Example 1: ordinary toll plus issuer fee
A driver’s account shows a road toll and a separate tag-servicing fee. The road-access amount is tested under Entry 23. The servicing fee is a distinct issuer supply; the toll notification does not determine its treatment. The issuer’s invoice should show the two amounts separately.

Example 2: no functional tag at the plaza
A vehicle without a valid functional FASTag is charged the published higher amount for crossing. Because the additional amount is collected as higher toll for access, Circular No. 177/09/2022-GST supports the same treatment as the toll, provided the transaction fits the clarification.

Example 3: parking paid through a tag-linked system
A barrier-free parking facility debits the customer’s FASTag account. The debit method does not convert parking into a toll. Identify the parking operator and arrangement, then apply the current parking classification and rate, if any, to that supply.
Example 4: overloaded vehicle
A toll plaza collects an additional amount identified as higher toll because the vehicle is overloaded. Retain the plaza record and apply the analysis in Circular No. 164/20/2021-GST. If a separate enforcement penalty is imposed, do not assume the circular covers it without examining the legal basis and invoice description.
Records, errors and corrections
Records to retain
- Toll receipts or electronic statements showing the plaza, date, vehicle and amount.
- Evidence that a higher no-FASTag amount was linked to road access and the tag’s validity status.
- Overloading documentation identifying the amount as higher toll where applicable.
- FASTag issuer invoices, fee schedules and replacement or servicing records.
- Parking receipts, operator details, contracts and any document describing bundled services.
Frequent mistakes
- Calling every FASTag debit a toll and treating issuer fees as exempt.
- Applying the road-toll exemption to parking solely because the lot is near a highway.
- Using a 2019 consolidated notification without checking later amendments or the transaction date.
- Combining several supplies on one invoice without showing which amount relates to road access.
- Assuming a municipal label settles GST for a privately operated or contract-managed parking facility.
If an invoice is unclear, seek a corrected, itemised document from the supplier before finalising a return or an expense classification. A tax professional can assess composite supplies, place-of-supply questions and any dispute over the current rate.

The consolidated exemption notification cited above was published in 2019. The GST Council’s notifications index lists Notification No. 06/2025-Central Tax (Rate) as an amendment to Notification No. 12/2017-Central Tax (Rate). Before quoting the exemption in an invoice, contract or tax position, verify the amended text, effective date and whether the particular road, surcharge or arrangement remains within the entry.
That date check is especially important for recurring toll contracts, annual parking arrangements and software or issuer schedules that continue across a rate change. Keep a copy of the notification and circular relied upon for the relevant period, along with the underlying commercial documents.
