If your former spouse is living, a marriage lasting at least 10 years is a key threshold, and you generally must not be currently married. If your former spouse has died, you may instead qualify for surviving divorced-spouse benefits, which have different age and remarriage rules. Your former spouse’s remarriage, by itself, does not disqualify you in either case.
First identify which benefit you may be asking about
Social Security treats benefits based on a living former spouse’s record differently from benefits for a divorced person whose former spouse has died. The second category is generally called surviving divorced-spouse benefits. The distinction matters because the rules for your current marital status, age, and remarriage timing are not the same.

| Question | Former spouse is living | Former spouse has died |

| Benefit category | Divorced-spouse benefits based on a living former spouse’s record | Surviving divorced-spouse benefits |
| Marriage-duration threshold | Generally, the marriage must have lasted at least 10 years. (SSA, “Can someone get Social Security benefits on their former spouse’s record?”, October 7, 2022; SSA, “If You Had A Prior Marriage.”) | Generally, the marriage must have lasted at least 10 years, subject to a caregiver exception. (SSA, “What You Should Know About Social Security if Your Spouse Passes Away,” May 29, 2025; SSA Handbook §403.) |
| Your remarriage | You generally must not be currently married; remarriage generally stops benefits paid on the former spouse’s record. (SSA, “Will Remarrying Affect My Social Security Benefits?”, August 22, 2024.) | Timing matters: remarriage before 50 generally bars benefits unless the later marriage ends by divorce or annulment; remarriage after 60 may still allow eligibility. Additional rules apply to some disabled people who remarry between 50 and 59. (SSA, “Will Remarrying Affect My Social Security Benefits?”, August 22, 2024; SSA Handbook §403.) |
| Former spouse remarries | Their remarriage, by itself, does not prevent you from qualifying. | Their remarriage does not erase their work record or, by itself, bar your claim. |
These are threshold rules, not an individual eligibility decision. Age, disability, entitlement and insured-status rules, the details of your marriage history, and the benefits available on your own record can affect the result.

If your former spouse is living
Check the 10-year marriage rule
For divorced-spouse benefits on a living former spouse’s record, the marriage generally must have lasted at least 10 years. That duration is an important threshold, not a promise that Social Security will approve a claim. Other requirements and the comparison with benefits on your own record also matter.

If you and the same person married more than once, Social Security may count the marriages together for the 10-year test in a particular circumstance: you must have remarried no later than the calendar year after the year your divorce became final. The SSA’s prior-marriage guidance describes the counting rule; if your marriage and divorce dates are close to the threshold, ask SSA to assess the dates rather than assuming that separate marriages either do or do not count.
Your current marital status matters
You generally must not be currently married to receive divorced-spouse benefits on a living former spouse’s record. SSA says that, generally, if you remarry, benefits paid to you on your former spouse’s record stop. If you are receiving these benefits and marry, report the marriage to SSA so the agency can update your record and reduce the risk of an overpayment.

Your ex’s remarriage is a different issue
Your former spouse’s decision to marry someone else does not, by itself, take away your ability to qualify on that person’s work record. A former spouse may qualify even when the worker has remarried. In some circumstances, the worker’s own entitlement status may not be a prerequisite either. Do not infer that every applicant qualifies simply because the former spouse remarried or because the marriage lasted 10 years; SSA must evaluate the applicable entitlement requirements and records.
Do these 3 things before closing this tab:
1Clear out junk files and repair common Windows errors2Fix the driver behind crashes, sound loss and screen glitches3Repair Windows errors before they cause bigger problemsCompare the potential benefit with your own record
Eligibility to claim on a former spouse’s record and the amount payable are separate questions. Your own retirement or other Social Security benefit may be relevant to what you can receive. There is no single monthly amount that can be inferred from the length of your marriage: the applicable records and claiming circumstances determine the result. Ask SSA to compare the options for your case before deciding when or how to claim.

If your former spouse has died
Look at surviving divorced-spouse eligibility
When a former spouse dies, the potential claim is generally a survivor claim, not a divorced-spouse benefit based on a living worker. For many surviving divorced spouses, SSA identifies a marriage of at least 10 years and an age threshold of 60, or 50 if disabled. The person generally must be single unless a remarriage exception applies. The deceased worker’s insured status and other entitlement requirements also have to be met.
The death of a former spouse does not erase that person’s Social Security work record. Nor does that person’s remarriage, by itself, bar a surviving former spouse from claiming on the record. SSA evaluates the surviving claimant’s circumstances and the deceased worker’s record under survivor rules.

Apply the remarriage rules by the age when you remarried
For survivor benefits, the age at which you remarried can change the result. SSA’s general guidance describes these age bands:
- Before age 50: Remarriage generally prevents surviving-spouse or surviving-divorced-spouse benefits, unless the later marriage ends by divorce or annulment.
- From age 50 through 59: A person who is disabled may qualify under additional conditions. The age range alone does not establish eligibility.
- After age 60: Remarriage may still allow a person to receive survivor benefits on a deceased former spouse’s record, or benefits on a new spouse’s record. This is not a guarantee that either benefit is payable or that one option is better.
These rules differ from the general rule for benefits on a living former spouse’s record. Do not use the living-spouse rule—under which remarriage generally stops those benefits—to decide a survivor claim. Tell SSA when you remarried and whether that marriage later ended; those details can affect which survivor rules apply.

Check the caregiver exception
A surviving divorced spouse who is caring for the deceased worker’s entitled child may be able to qualify without the usual age or 10-year marriage requirements if the child is under 16 or disabled. This is a specific caregiver path, not a general waiver of the survivor rules. SSA notes that a caregiver benefit can affect benefits payable to other people on the deceased worker’s record, so the agency should assess the record as a whole.
Independent reader supportYour contribution helps us test, update, and keep practical guides available for everyone. How to sort out your own situation
- Establish whether the former spouse is living. That determines whether to ask SSA about divorced-spouse benefits or surviving divorced-spouse benefits.
- Write down the marriage history. Record when each marriage began and ended, whether you remarried the same person, and the dates needed to assess the SSA counting rule for marriages within the specified calendar-year period.
- List your current and past marital status. For a living former spouse’s record, current marriage generally affects eligibility. For a survivor claim, include the age at each remarriage and whether any later marriage ended by divorce or annulment.
- Note age, disability, and caregiving details. For a survivor claim, tell SSA if you are disabled or care for the deceased worker’s entitled child under 16 or disabled. These facts may point to a different eligibility path.
- Ask SSA to review each possible record. Include your own Social Security record and, when applicable, the living former spouse’s or deceased worker’s record. Ask the agency to determine eligibility and compare the benefits available under the rules rather than relying on the 10-year test alone.
- Confirm how to file before applying. SSA’s May 29, 2025 survivor-benefit guidance says applicants must make an appointment by calling Social Security and that survivor benefits cannot be applied for online. Filing routes can vary by benefit type and change over time, so check SSA’s current instructions and confirm the process for your claim.
What to have ready when you contact Social Security
To make a case-specific review more useful, organize the facts that determine which rule applies:
- Whether your former spouse is living or deceased.
- The start and end dates of every marriage to that person, including dates of remarriage and divorce if you married the same person more than once.
- Your current marital status and the dates and ages at which any later marriages began and ended.
- Your age and, where relevant, information about a disability or care for the deceased worker’s entitled child under 16 or disabled.
- Any question about your own retirement or survivor benefit that you want SSA to compare with a benefit based on the former spouse’s record.
This is not a substitute for SSA’s records or decision. The agency’s review is important where a marriage is near the 10-year threshold, a remarriage falls near an age boundary, or more than one record or benefit category may be relevant.
Quick Recap
Common mistakes to avoid
- Treating 10 years as the whole test. It is a key marriage-duration threshold, but it does not settle age, entitlement, insured-status, marital-status, or record-comparison questions.
- Confusing who remarried. Your remarriage generally affects benefits based on a living former spouse’s record. The former spouse’s remarriage, by itself, does not bar your claim.
- Applying survivor rules to a living ex, or vice versa. Survivor claims have age-based remarriage rules that should not be assumed to apply to divorced-spouse benefits on a living worker’s record.
- Assuming an exception guarantees payment. The multiple-marriage counting rule and caregiver exception can matter, but SSA must determine whether the conditions are met and whether other requirements are satisfied.
- Assuming a benefit amount from a general rule. The reviewed SSA guidance does not establish one amount for all divorced or surviving divorced spouses. Ask SSA to assess the records and applicable rules for your case.
