Default search agreements can steer users toward a provider without preventing them from switching. By placing a search engine at familiar entry points—such as a browser or mobile device—these agreements can deliver query volume and reach at a scale smaller rivals may struggle to match. The U.S. case against Google found certain exclusive distribution agreements unlawful, but the remedy is narrower than a ban on all default payments.
Why does my phone choose a default search engine?
A device or browser can be configured to send searches to a particular provider unless the user changes the setting. A default may be selected by the device maker, browser provider, or user, and a search company may negotiate with a distribution partner for placement or other terms. The specific arrangement varies; not every default is the result of a paid agreement.
Defaults matter because they shape the first search option many people encounter. A user may accept the initial setting, keep using a familiar provider, or not know where to change it. A different engine may still be available in a settings menu or through another route, but the existence of that route does not mean users encounter or select alternatives equally often.
The UK Competition and Markets Authority (CMA), in its 2025 final decision on Google’s general search services, concluded: “The choice of default is important to competition because consumers are likely to use the default they have chosen or which is set on their device.” The CMA also cited evidence that some consumers have difficulty changing defaults. That is evidence of influence and friction—not proof that users are unable to choose another search engine.

How can a default affect competition?
Distribution brings queries and reach
A prominent default can direct a substantial flow of searches to one provider. That gives the provider access to users at common entry points and can make it harder for rivals to reach people, even if those rivals offer alternative search services. The U.S. District Court for the District of Columbia described distribution agreements as a means by which Google maintained its position; the CMA described defaults as an important barrier to rival access and expansion in the UK.
Scale can reinforce an incumbent’s advantage
Search providers need users and queries to compete for attention and build their services. When an incumbent receives traffic through established distribution, a smaller rival may have difficulty matching its reach. The resulting disadvantage can persist even where a user could switch: rivals still need a practical route to be discovered and selected.

This is a competition concern, not a rule that every paid placement is unlawful. The legal issue in the U.S. case was the particular agreements and conduct the court found had maintained monopoly power, not simply the existence of a default.
Availability is not the same as effective choice
A settings option or choice screen can make an alternative formally available. Actual selection can still be shaped by awareness, design, confidence, habit, and the effort required to change a setting. Assessing user choice therefore involves more than asking whether another engine can technically be selected; it also matters how easily users encounter and choose it.

What did the U.S. court find, and what did it order?
In August 2024, the U.S. District Court for the District of Columbia found that Google violated Section 2 of the Sherman Act by maintaining monopolies in general search services and general search text advertising through exclusive distribution agreements. That was a U.S. liability ruling. A separate remedies opinion followed on September 2, 2025.
The court’s 2025 remedies opinion restated its assessment of distribution’s importance: “Though the Chrome default is not alleged to be exclusionary conduct, it is a market reality that significantly narrows the available channels of distribution and thus disincentivizes the emergence of new competition.” The statement distinguishes the default’s market effect from a finding that the Chrome default itself was the exclusionary conduct alleged.

What the remedies cover
The U.S. Department of Justice’s summary, updated April 15, 2026, describes restrictions on certain agreement conditions and obligations for specified data and syndication access. In that summary, the order:
- Restricts conditioning Google app licensing or revenue sharing on certain placements.
- Restricts maintaining specified Google products for more than one year under covered agreements.
- Restricts terms that prohibit partners from distributing competing search, browser, or generative-AI products.
- Requires certain search-index and user-interaction data to be made available to certain competitors.
- Requires syndication offers to certain competitors.
These are defined limits and obligations, not a blanket prohibition on every payment for default placement. The remedies opinion discussed the plaintiffs’ proposed Chrome divestiture as a structural remedy they sought; that proposal should not be confused with the operative relief described in the DOJ summary.

Appeal and implementation status
Google said on January 16, 2026, that it had filed a notice of appeal and asked the court to pause some remedies while the appeal proceeded. The GovInfo docket index records that, on May 7, 2026, the court denied without prejudice Google’s motion for a partial stay pending appeal. The order also requires plaintiffs to give Google and the court 45 days’ notice before certain qualified competitors may begin accessing data-sharing or syndication remedies, giving Google an opportunity to renew its stay request.
Those procedural entries establish the appeal and the stated notice requirement, but they do not establish the complete appellate history or that every remedy was already operational. The status described here is limited to the cited May 7, 2026 docket entry.

Can I change my default search engine?
In general, users can change a default through device or browser settings, though the available options and steps depend on the product. The evidence discussed by the CMA is a reminder that the practical effort matters: a choice may exist but be less likely to be used if it is hard to find or change. This article does not prescribe a universal settings path because it differs across devices and browsers.
