The most effective way to reduce your tax is not to collect the largest number of deductions. It is to compare your final liability under the applicable old and new regimes for the correct tax period, then claim only the exemptions and deductions that the selected regime permits.
For an ordinary salaried taxpayer without business or professional income, the new regime is the default for AY 2026–27, but the old regime can be chosen in the income-tax return. Your employer’s payroll declaration helps calculate tax deducted at source (TDS); it is not the statutory regime election. The comparison must include salary, other income, age, residence, rebate, surcharge, cess and every valid claim.

First identify the tax period
India’s year labels are easy to confuse. AY 2026–27 returns cover income earned during the earlier financial year under the Income-tax Act, 1961. The Income-tax Act, 2025 takes effect on 1 April 2026. Income earned from 1 April 2026 to 31 March 2027 is called Tax Year 2026–27 under that new Act.

AY 2026–27 slab structure
For an individual below 60, the AY 2026–27 new-regime bands listed by the Department are nil up to ₹4 lakh, followed by 5%, 10%, 15%, 20%, 25% and 30%; the 30% rate begins above ₹24 lakh. The old regime uses age-based thresholds. For a person below 60, the usual bands are nil up to ₹2.5 lakh, 5% from ₹2.5 lakh to ₹5 lakh, 20% from ₹5 lakh to ₹10 lakh and 30% above ₹10 lakh. Resident senior citizens and super senior citizens have higher basic exemption thresholds under the old regime.
These are slab rates before rebate, surcharge and cess. Income taxed at special rates, such as some capital gains, may not follow the salary slab calculation.

Rebates can change the result
For AY 2026–27, the Department lists a new-regime rebate of up to ₹60,000 where a resident individual’s taxable income does not exceed ₹12 lakh. The old-regime rebate is up to ₹12,500 where taxable income does not exceed ₹5 lakh. The eligibility test is based on taxable income after permitted deductions, not gross salary. Surcharge can apply at higher incomes, and the 4% health and education cess is added after income tax and surcharge.
Ways to reduce taxable income in the old regime
Claim the correct HRA exemption
House Rent Allowance is an old-regime exemption under section 10(13A). It is not an automatic deduction of all rent paid. The exempt amount is calculated under prescribed conditions using salary, HRA received, rent, and the applicable city factor. You need genuine rent payments, occupancy details and supporting records. If you live in your own home, or cannot substantiate the tenancy, do not claim an exemption simply because your payslip shows HRA.

Give your employer the relevant particulars through Form 12BB for TDS estimation. If the employer does not accept a claim during payroll, retain the evidence and report the eligible amount correctly in your return.
Use the standard deduction
For AY 2026–27, the employee standard-deduction ceiling is ₹50,000 in the old regime. It applies against eligible salary or pension income without requiring investment receipts, but it cannot be increased by reporting commuting, meal or other personal expenses.

Use Chapter VIA deductions only for qualifying payments
Common old-regime routes include qualifying contributions and payments under sections 80C, 80CCC and 80CCD(1), and eligible health-insurance premiums or medical expenditure under section 80D. Examples of 80C-type items can include recognised provident-fund contributions, public-provident-fund deposits, eligible life-insurance premiums, tuition fees, qualifying principal repayment and approved equity-linked savings investments. The combined statutory ceiling and each item’s conditions matter; a payment that is merely labelled an “investment” is not automatically deductible.
Keep policy certificates, investment statements, bank proofs and receipts. Check whether a payment was actually made in the relevant financial year, whether the product qualifies, and whether a combined limit has already been used by another item.
Add the separate NPS deduction when eligible
Section 80CCD(1B) provides an additional deduction for an individual’s own National Pension System contribution. AY 2026–27 validation rules state a ₹50,000 limit. This is separate from the combined 80C/80CCC/80CCD(1) pool, but it still requires an eligible contribution and evidence.

Include qualifying employer NPS contributions
Employer contributions under section 80CCD(2) are treated separately from your own NPS payment. The allowable percentage depends on the employer category and the regime. Obtain the contribution figure from payroll or Form 16 and do not duplicate it as an employee contribution.

Under the AY 2026–27 old-regime guidance, section 24(b) can allow up to ₹2 lakh of interest for a qualifying loan used to purchase or construct a self-occupied property, subject to statutory conditions. Obtain the lender’s interest certificate and verify completion, ownership and loan-purpose requirements. Principal repayment belongs to the applicable Chapter VIA analysis; it is not the same claim as interest.
What remains available in the new regime
Use the larger standard deduction
The AY 2026–27 validation rules cap the employee standard deduction at ₹75,000 under the new regime. This deduction is built into the comparison even when you make no investments or pay no rent.
Check employer NPS carefully
Employer NPS under section 80CCD(2) is a stated new-regime exception. For AY 2026–27, the validation rules specify a 14% of salary limit for employees of public-sector undertakings, other employers, and Central or State Governments. Confirm the employer category, the definition of salary used for the calculation and the applicable tax period. Your own additional NPS contribution under section 80CCD(1B) does not become deductible merely because employer NPS is allowed.
Recognise the exclusions
The official FAQ says HRA exemption and interest on borrowed capital for a self-occupied property are unavailable in the new regime under the cited 1961-Act framework. Chapter VIA claims such as 80C and 80D are generally barred, apart from specified statutory exceptions including employer NPS under section 80CCD(2), Agniveer Corpus Fund contributions under section 80CCH and section 80JJAA. Do not transfer an old-regime allowance, reimbursement or investment deduction into the new regime without a specific rule allowing it.

How to decide which regime saves more
Regime choice is a total-tax calculation, not a contest over the number of deductions. A taxpayer with substantial eligible HRA, qualifying investments and self-occupied-loan interest may get a different result from someone whose income is mostly covered by the new regime’s slabs, rebate and ₹75,000 standard deduction.
- Set the period. Choose AY 2026–27 under the 1961 Act, or the applicable Tax Year under the 2025 Act. Never mix the two.
- List all income. Start with gross salary, then add interest, rent, capital gains and any other income. Separate income that is taxed at special rates.
- Record personal factors. Enter age category, residential status and whether you have business or professional income.
- Enter old-regime claims. Include only substantiated HRA, standard deduction, qualifying Chapter VIA payments, NPS and home-loan interest.
- Enter new-regime claims. Use the new standard deduction and permitted exceptions such as eligible employer NPS. Remove HRA, ordinary 80C/80D claims and self-occupied-loan interest.
- Run the official comparison. The Department’s calculator accepts the Act, year, age, residence, income and deduction details and produces tax under both regimes.
- Apply the final adjustments. Check rebate eligibility, surcharge and 4% cess. Compare final tax, not just taxable income.
- Choose in the return. If you are a salaried taxpayer without business or professional income, the old-regime election can generally be made each year in the return by the section 139(1) due date.
TDS declarations and the return are different decisions
Your employer normally asks for Form 12BB details such as HRA, leave travel concession, home-loan interest and tax-saving payments so payroll can estimate monthly TDS. Submit accurate information and retain the supporting documents. A payroll choice can affect how much tax is withheld during the year, but it does not itself exercise the statutory option under section 115BAC. The return is where an eligible non-business taxpayer makes the final regime choice.
If TDS was calculated under one regime but the return calculation favours the other, reconcile the tax in the return. Excess TDS can be claimed as a refund; insufficient TDS can create a balance payable and, in some cases, interest.
Documents to assemble before filing
- Form 16, salary slips and details of taxable allowances.
- Rent agreements, receipts and landlord information supporting an HRA claim.
- Form 12BB submission and the evidence supplied to payroll.
- Provident-fund, insurance, tuition, investment and NPS payment records.
- Employer NPS contribution and employer-category details.
- Home-loan interest certificate, principal statement and property-use details.
- Interest certificates, dividend records and statements for other income.
- Age, residential-status and bank details relevant to rebate, filing and refund.
Common mistakes and how to avoid them
Using the wrong year
Calling income earned after 1 April 2026 “AY 2026–27” can lead to the wrong Act and limits. Write the earning period beside every calculation.
Assuming an employer declaration is irreversible
Payroll withholding and the return election are related but distinct. Keep your evidence and make the legally valid choice in the return.

Claiming rent, investments or interest without eligibility
Only the prescribed exempt or deductible amount counts. False receipts, duplicate claims and payments outside the relevant financial year can be disallowed and may trigger tax, interest or penalty.
Comparing deductions instead of final tax
A larger deduction does not automatically produce a lower bill. Recalculate after rebates, surcharge and cess under both regimes.
Carrying 1961-Act provisions into Tax Year 2026–27
The 2025 Act begins on 1 April 2026, and not every Tax Year 2026–27 deduction rule is established by the AY 2026–27 material. Check the current statute, rules, forms and calculator before filing for that period.
When professional help is sensible
Consider a qualified tax professional when you have several employers, stock compensation, rental or capital-gains income, a property under construction, employer NPS questions, foreign income, or a business or professional activity alongside salary. The correct answer depends on documents and current law, not on a generic “old versus new” rule.
The Bottom Line
For AY 2026–27, calculate both regimes with the official calculator, use old-regime exemptions and deductions only when you can substantiate them, and remember that the employer’s TDS declaration is not the final regime election. For income earned from 1 April 2026 onward, start again with the Income-tax Act, 2025 rules rather than assuming the AY 2026–27 limits continue.
