Banks protect customer data used by AI by applying privacy, information-security, cybersecurity, model-governance and third-party-risk controls to each system’s data flows and purpose. Those safeguards matter whether a bank builds a tool itself or relies on a vendor: using a provider does not transfer the bank’s responsibility for lawful, safe handling of customer information. The exact controls vary with the system and use case, and U.S. federal guidance does not establish one universal technical design for every AI application.
What bank AI safeguards are meant to protect
AI is not a single kind of banking system. A bank might use a model to analyze information, a generative tool to draft or summarize content, or an agent that can access sensitive information and potentially take actions. The data involved, the system’s capabilities and the consequences of an error differ across these uses. A sensible risk assessment therefore starts with the particular application, not with a broad label such as “AI.”

Customer data can be at risk at more than one point. It may be collected or supplied as an input, handled by a bank’s system or an outside provider, or exposed through a generated response. A system connected to sensitive information or transaction authority also raises access and security concerns beyond the content of its output. Federal Reserve Governor Michael Barr warned in April 2025 that proprietary or customer information could inadvertently appear in generative AI outputs or responses; he also noted the security risk of agents that can access sensitive customer data or authorize transactions. These are risks to manage, not proof that every AI system exposes information.
For customers, the important distinction is between safeguards that a bank should manage and a guarantee that a particular tool cannot fail. The U.S. federal sources discussed here describe responsibilities and control areas, but do not establish a single required architecture or an effectiveness figure showing how much any safeguard reduces the chance of exposure.

How banks govern an AI use case
Before considering technical controls, a bank needs to understand what the system is intended to do, what information it can reach, who is accountable for it and what harm could follow from a mistake or disclosure. The sensitivity and volume of data, the criticality of the activity, and whether the system is internal or supplied by a third party all affect the risk picture. A tool that only processes limited information presents a different oversight question from one that handles sensitive customer data or can initiate consequential actions.
The agencies’ 2026 revised model-risk guidance describes a risk-based approach covering model development and use, validation and monitoring, governance and controls, and vendor products. It recognizes that practices suitable for one institution or application may not suit another. The guidance is not a universal technical checklist: it does not establish prescriptive or enforceable standards, and generative and agentic AI are outside its scope. It should not be described as a comprehensive rule for every AI system a bank might use.
Governance also means making responsibilities and permitted uses clear. For a given system, the bank must consider who owns the data, what the data may be used for, and what privacy and security limits apply when information is shared. Those questions matter both within the bank and in arrangements with providers. Clear boundaries help the institution assess whether the system’s actual use matches the use it approved.

Privacy, information security and cybersecurity
AI does not suspend ordinary banking obligations. In congressional testimony on May 13, 2022, OCC Deputy Comptroller Kevin Greenfield stated: “Banks must comply with applicable privacy and information security requirements when using AI.” The Federal Reserve has likewise said existing legal and regulatory requirements continue to apply, including those related to data privacy, cybersecurity, fair lending and third-party risk management. Governor Michelle Bowman put the point directly in a November 22, 2024 speech: “AI is not exempt from current legal and regulatory requirements, nor is its use exempt from scrutiny.” Read Bowman’s speech.
OCC testimony also highlights the sensitivity of the large volumes of information AI may process and the need for cybersecurity practices that safeguard sensitive data and prevent or limit corrupted data from compromising an AI application. In practical terms, the bank’s review has to consider not just whether a tool produces a useful result, but also how information is handled and whether the system’s operation could be compromised. The specific measures depend on the bank and application; the cited federal materials do not prescribe one technical control set for every use.
Generative systems deserve particular attention to what they return. A customer or employee may supply information to a tool, while a response may inadvertently include proprietary or customer information. If an application can access sensitive records, the bank also needs to consider who or what can reach that connection and whether the system can take actions. The potential consequences depend on the permissions and use case; an output risk is not the same as an agent’s ability to affect an account or transaction.

What changes when an outside provider is involved
Banks may rely on vendors for AI models, systems, cloud services or expertise. In those arrangements, oversight needs to address the provider’s role and the criticality of the service. OCC testimony identifies robust due diligence, contract management and ongoing oversight as relevant controls. It also points to defining responsibilities, data ownership, permitted uses, and privacy and security limits for data shared with providers.

Random freezes, missing sound and display glitches usually trace back to one bad driver. Find and replace yours safely.Free scan · under a minuteA contract and an initial review are not the whole relationship. The 2023 interagency third-party risk guidance frames oversight across planning, due diligence, contract negotiation, ongoing monitoring and termination. That life-cycle approach matters because the bank needs to consider the relationship before it begins, while the service is being used and when it ends. The exact oversight should be scaled to how critical the service is rather than treated as identical for every provider.
Most importantly, a vendor’s involvement does not remove the bank’s accountability. The 2023 guidance says third-party use does not diminish or remove a banking organization’s responsibility to operate safely and comply with applicable laws and regulations, including those protecting customer information. A bank therefore cannot treat “the provider handles the AI” as a substitute for its own oversight.

How testing and monitoring fit in
For models within the scope of the 2026 revised model-risk guidance, testing, validation, outcomes analysis and monitoring are among the practices used to support oversight, alongside governance and controls. These activities help an institution assess model performance and keep watch over its use rather than assuming that an initial approval settles every question. Their application should reflect the model and the institution’s risk, not an imagined one-size-fits-all protocol.
Scope is important here. The 2026 guidance excludes generative and agentic AI, so it cannot be treated as directly governing every such system. Nor does it prescribe one testing procedure for every model. Banks still face applicable legal and regulatory obligations, but the guidance’s stated limits mean readers should not infer that it supplies a complete, enforceable AI testing checklist.
What U.S. federal guidance says—and what it does not
The regulatory picture has developed through several documents with different purposes and statuses. An OCC request for information issued March 31, 2021 sought views on financial institutions’ AI use, governance, risk management, controls, data processing and use, and third-party oversight. It is background to regulators’ consideration of the topic, not a current rule.

The May 2022 OCC testimony described privacy, information-security and third-party risks. In June 2023, the FDIC, Federal Reserve and OCC issued final interagency third-party risk guidance, including the principle that a bank remains responsible for third-party activities and customer information protection. In November 2024, Governor Bowman stated that AI remains subject to existing legal and regulatory requirements. In April 2025, Governor Barr discussed generative AI risks, including inadvertent disclosure and risks from agents with sensitive access or authority.
In 2026, the banking agencies issued revised model-risk guidance covering development and use, validation and monitoring, governance and controls, and vendor products, subject to the scope and non-prescriptive status described above. Separately, on September 11, 2026, the OCC and other banking agencies proposed revised third-party risk guidance for public comment. A proposal is not a final rule; it should be described as proposed unless a later official source confirms finalization. These documents address different parts of risk management and should not be collapsed into a claim that one comprehensive AI regulation now governs every banking AI system.
How customers can think about a bank’s use of AI
There is no basis in these federal sources for ranking banks by the effectiveness of their AI data protections, and they do not report a statistic measuring how much safeguards reduce exposure. They also do not provide a product comparison among named banking AI systems or establish the actual controls used by every individual bank. Customers can nevertheless frame useful questions around the system’s data access, purpose and oversight:
Recommended Free Tools
- What customer information does the AI application process, and how sensitive or extensive is that information?
- Is the service supplied by an outside provider, and what roles, data rights, permitted uses, privacy limits and security responsibilities govern the arrangement?
- Can the system return customer or proprietary information in a generated response, or can it access sensitive records?
- Can it take actions or authorize transactions, and how is that capability considered in the bank’s risk assessment?
- How does the bank test and monitor the system, and how does it oversee a provider over the life of the relationship?
These are practical questions drawn from the risks and governance factors regulators discuss, not an official regulator checklist or a guarantee that a bank must answer each one in a particular format. They can help distinguish a limited analytical use from a more consequential system and clarify whether the institution considers data handling, provider accountability and ongoing oversight.
Why protections vary between banks and applications
Federal guidance supports a risk-based approach rather than a single uniform technical architecture. A bank’s choices depend on the data involved, the use’s criticality, the system’s capabilities, whether a provider is involved, and the applicable supervisory framework. An internal system and a vendor product can raise different oversight issues; a tool that produces text and an agent with access to sensitive information or transaction authority do not have identical risks.
The sources here focus on U.S. federal banking regulators. They do not describe every bank’s operational controls, settle requirements in every jurisdiction, or provide a complete list of mandatory safeguards for all AI uses. A careful account should therefore distinguish regulatory responsibility and recognized risk categories from claims about a particular bank’s implementation.
