How Are Unemployment Benefit Overpayments Handled?

An unemployment overpayment notice is not automatically a fraud finding. Learn how appeals, non-fraud waivers and collection may work, and what to check first.

If a state unemployment agency says it overpaid you, read the notice promptly: it identifies the weeks, amount, reason and deadline that govern your next steps. Appeal if you dispute the decision or calculation; if the debt is established and non-fraud, you may be able to request a waiver. If the debt remains collectible, recovery methods depend on the state and benefit program.

What an overpayment notice means

An overpayment determination says that some benefits were not payable, or that the agency calculated an amount you must repay. It is not, by itself, proof that you intentionally committed fraud. The notice should identify the benefit weeks and amount at issue, explain the agency’s reason, state whether the case is classified as fraud or non-fraud, and tell you how and when to appeal.

Rules for regular state unemployment insurance (UI) differ by state. Temporary federal programs can have additional program-specific protections and procedures. The notice from the agency handling your claim—not a general guide—is the place to confirm the applicable program, filing method and deadlines.

What to do when you receive a notice

  1. Read and preserve it. Check the weeks, amount, stated reason, fraud classification and appeal deadline. Save the notice and its envelope or electronic delivery record.
  2. Identify what you disagree with. Is the issue whether you were eligible, which weeks or earnings were counted, or how the amount was calculated? Or do you accept the debt but want to ask whether repayment can be excused?
  3. Protect the appeal deadline. If you dispute the determination, use the filing channel and deadline in the notice. Include the part you challenge and relevant records; keep copies and proof of filing.
  4. Ask about a waiver if appropriate. If the debt is non-fraud and you believe repayment should be excused, check whether your state and program allow a waiver and how to apply. Do not assume that submitting a waiver request changes an appeal deadline or stops collection.
  5. Confirm collection instructions. Contact the agency through the official details in the notice to ask about the balance, payment options and whether collection continues while a request is reviewed.

Relevant records depend on the agency’s stated reason. They might include wage records, employer communications, identity documents, or records about availability for work or separation from a job. State rules determine evidence requirements, hearing format and whether a late appeal can be accepted for good cause.

Appeal or waiver: which route fits?

What is challenged? The finding that benefits were not payable, or the amount calculated. Collection of an established overpayment.
When might it fit? You believe the facts, eligibility decision, weeks or calculation are wrong. You believe applicable law allows repayment relief, often because you were not at fault and repayment would meet specified hardship or equity criteria.
What evidence is relevant? Records about eligibility, weeks, earnings, identity or the agency’s stated reason. Evidence relevant to fault and the state’s equity, good-conscience or financial criteria.
What result is sought? Reversal or revision of the overpayment decision. Full or partial release from repayment, if authorized.
What timing issue matters? The appeal deadline in the notice, which is state-specific. The state or program’s waiver rules and how a pending request affects collection.

The U.S. Department of Labor (DOL) distinguishes disputing entitlement from asking for a waiver: an appeal challenges the underlying decision, while a waiver asks the agency to relinquish recovery of an established debt. If both issues apply, ask the agency whether you should pursue both tracks. Do not let a waiver inquiry cause you to miss the appeal deadline.

How an appeal works

Follow the instructions in the determination, including the filing method and deadline. Explain which part you dispute and why, and attach records that address the agency’s reason. Keep a complete copy of what you submit and confirmation of when it was filed. The agency’s notice and state rules control; California’s appeal procedures, for example, should not be assumed to apply elsewhere.

Some federal guidance for temporary pandemic-era programs specifies notice and an opportunity for a fair hearing before repayment is required. DOL’s guidance for Pandemic Emergency Unemployment Compensation (PEUC) also refers to a final determination. Those directions are program-specific; they should not be treated as a uniform procedure for every state UI claim.

When a waiver may be available

DOL defines a waiver as a non-fraud overpayment that a state agency, under state law, formally agrees the claimant does not have to repay. DOL describes a framework in which a state may authorize a waiver when the payment was not the claimant’s fault and repayment would be “against equity and good conscience” or would otherwise defeat the purpose of UI law.

That framework does not guarantee a waiver. State law and the program involved determine whether relief is available, what criteria apply and what information the agency needs. Agency error alone does not automatically qualify a claimant, and do not assume that a fraud-related debt is eligible. If your state offers a waiver process, use its form and answer factual and financial questions accurately.

For CARES Act waiver processing, DOL says the state must first establish the overpayment through an individual investigation and written determination that includes appeal rights, then decide whether recovery should be waived. DOL’s FY2025 state guidance encourages waivers when legal conditions are met and says states must first establish the overpayment; it also says recovery activity cannot be waived for fraudulent overpayments.

How an unpaid overpayment may be collected

If a debt remains, the agency may use collection methods authorized by applicable law. These are not identical nationwide. California lists withholding federal and state income tax refunds as possible recovery methods. The District of Columbia describes tax-refund interception, wage garnishment, legal action and deductions from future claims in cases involving failure to repay or follow an agreed plan. The available methods and consequences depend on the jurisdiction and may also depend on whether the case is classified as fraud.

Ask the issuing agency for your current balance, whether payments are due while an appeal or waiver is pending, whether a repayment plan is available, and which collection measures may apply to your case. Do not assume that a pending request or a proposed payment plan automatically pauses collection. DOL guidance in one context says non-fraud recovery escalation should follow notice and an appropriate period to establish or comply with a repayment plan; that is not a universal state guarantee.

What national recovery figures do—and do not—show

DOL defines the UI recovery rate as overpayments recovered divided by adjusted overpayments established, with waived overpayments subtracted from the established amount. A state using the Treasury Offset Program can report a rate above 100% because offsets may recover older debts as well as overpayments established during the period being measured. DOL’s recovery-measures page was updated September 11, 2026.

That measure describes program-level recovery, not the likely outcome or amount owed in an individual case. A national overpayment total or claimant count should not be inferred from it.
