Why might my premium rise after someone hit my car?
Separate three possible changes before deciding what happened: an accident-specific surcharge, a change to your individual rating or discounts, and a general rate increase. They can produce a higher renewal bill, but they are not the same thing.
An accident-specific surcharge or rating change
An insurer may consider claims history when deciding whether to offer coverage and how much to charge. Texas Department of Insurance (TDI) says insurers commonly use claims-history reports such as CLUE, which can show claims filed with a different insurer. TDI also says premiums can rise after claims and that a policyholder could lose a claim-free discount. A lost claim-free discount
A renewal can increase even if the insurer did not add a separate surcharge for the accident. Ask whether a claim-free or other discount was removed, and whether the accident changed your rating tier. Request an explanation of the specific changes rather than relying on the overall premium difference.

A general rate increase
An insurer can raise rates for a broader group of policyholders, including customers with no claim or ticket. Maryland’s insurance regulator says general increases may reflect costs such as vehicle repairs and parts, vehicle values, business expenses, and other insurer costs. How can I tell what changed?
Ask the insurer or agent to separate the renewal change into its components. Specifically ask whether the accident was treated as chargeable, whether a discount was removed, whether another individual rating factor changed, or whether a general rate revision applied. A clear answer helps distinguish an accident-related decision from a broader repricing.

Claims records can also affect how an insurer views your history. Florida’s Department of Financial Services (DFS) says a CLUE report generally contains up to seven years or more of personal-auto and personal-property history. If a report or insurer record appears to classify the accident incorrectly, request a review. Texas TDI says Texas insurers cannot charge more for claims they did not pay, including claims denied because the policy did not cover the damage, and cannot charge more simply because a customer called to ask about the policy or claims process. Do state laws protect drivers after a not-at-fault accident?
Some states describe protections for particular not-at-fault accidents, but the wording and conditions differ. These examples are not an exhaustive list and do not establish a nationwide rule. Whether a claim qualifies may depend on the statute’s definition of a nonfault incident, the facts of the accident, and the policy.

Do not assume that a protection described in one state applies elsewhere. For a decision on your own renewal, consult your state insurance department and the current law or guidance for your location.

What should I do if my renewal went up?
- Read the renewal notice. Look for the new premium, any stated reason for the change, and instructions or deadlines to protest or ask for review.
- Ask the insurer or agent to explain the change. Request a breakdown identifying any accident surcharge, rating-tier change, lost discount, or general rate revision. If the accident was recorded or classified incorrectly, ask for a review.
- Check your claims history if needed. Request your CLUE report and dispute errors with the reporting company. - Use your state’s complaint or protest process if the explanation does not resolve the issue. Maryland’s regulator says a notice involving an increase attributed to a claim or driving-record change must include “Right to Protest” directions. Its process requires complaints within 30 days of the notice mailing. That timing is Maryland-specific; elsewhere, check your state regulator’s current instructions and deadline. - Compare equivalent coverage if you shop for another policy. Match coverage limits, deductibles, included protections, and policy features, and ask which discounts apply. A lower quote may reflect less coverage or different terms, not a better price for equivalent insurance.
How should I compare quotes after a claim?
Use the same coverage limits, deductibles, and policy features when comparing offers, then check which discounts each insurer applies. Ask whether the quote reflects the claim history you provided and how the insurer classified the accident. This makes it easier to compare like with like rather than mistaking a coverage difference for a premium saving.
