Re:

How a Company Should Respond to a GST Show-Cause Notice: Documents, Deadlines and Steps

A practical company workflow for responding to a GST show-cause notice: identify the provision and period, gather relevant evidence, answer each allegation and verify filing requirements.

Start by identifying the provision, tax period, allegations and reply date stated in the complete notice and its annexures. Then reconcile each allegation against the company’s returns and transaction records, prepare a point-by-point response with relevant supporting documents, file the form applicable to that notice, request a hearing if appropriate, and keep proof of submission. There is no single reply deadline or document list that applies to every GST show-cause notice; the notice and the law applicable to its period determine the response.

First identify what kind of GST notice you received

“Show-cause notice” is a broad label used in different GST procedures. This guide focuses on demand notices using the DRC procedure under Rule 142; its forms and workflow do not automatically apply to every GST notice. Before drafting, check the complete notice, annexures and any DRC-01 summary rather than relying on an email subject line or a short portal alert.

Record the issuing authority, GSTIN, reference number, service date and method, tax period, statutory provision cited, allegations, proposed tax, interest and penalty, and the date by which the notice asks for a reply. Confirm that the notice and attachments are complete. If something is missing or unreadable, preserve the communication and promptly seek the missing material through the appropriate channel; do not assume that an incomplete copy changes a deadline.

Keep the notice, annexures, portal communication and service details together in a case file. The complete notice gives context to the allegations and calculations; a short summary or email alert may not contain everything the company needs to assess. Note who received the communication and when, then make sure the people preparing the response are working from the same complete set of documents.

Understand the route cited in the notice

The CGST Act distinguishes between section 73 cases involving non-payment, short payment, erroneous refund, or wrongly availed or utilised input tax credit without fraud, and section 74 cases alleging fraud, wilful misstatement or suppression to evade tax. These are not options a company can freely select between: the allegations, tax period and governing law determine the route. Read how the notice describes the conduct, not just the section number in its heading.

That distinction matters when the company evaluates the asserted facts and the legal basis for the proposed demand. For example, if a notice alleges a discrepancy in input tax credit, identify the transactions and records behind the discrepancy and examine the notice’s stated grounds. Do not assume that the issue is automatically a section 73 matter merely because the company disagrees with an allegation, or that a section number by itself resolves whether the department’s factual case is correct. Have a qualified GST professional review the cited provision and allegations.

Section 74A is also relevant to current GST law. Its application and the provisions in force for a particular tax period must be checked against the current official statute and effective-date provisions. Do not assume that older section 73 or 74 wording and limitation rules govern a later period, or that a provision cited for one period applies to another.

In comparing the possible statutory routes, focus on the grounds alleged, the tax period and effective law, the proposed tax, interest and penalty, the reply date, the evidence needed to address the case, and any consequences of payment. The routes are not interchangeable choices for the taxpayer. Confirm the currently applicable CGST and corresponding SGST or IGST provisions and the proper jurisdiction before filing.

How to determine the reply deadline

Do not rely on a general online rule such as “reply within X days.” The materials available here do not establish one deadline for every kind of GST show-cause notice. The specific notice, the statutory route, the tax period and the law currently applicable to that period matter. Note the response date printed in the notice, then have the company’s GST adviser verify the applicable legal time limit and any procedural requirements.

Make a deadline record as soon as the notice arrives: when and how it was served, the date stated for reply, who will prepare the response, who will approve it, and the time needed to obtain records. Keep a copy of the notice as received. If the date is unclear, inconsistent across communications or appears to have passed, raise that issue promptly with a qualified GST professional rather than silently treating the notice as open-ended.

Build the work plan backwards from the date being checked. Allow time to retrieve records, reconcile figures, investigate missing information, obtain legal review, approve the final version and upload the files. The internal plan is not a substitute for the statutory deadline, and starting early does not change the date stated in the notice. If the company needs clarification about a missing annexure or the reply process, record the request and follow up through an appropriate channel while continuing to manage the stated response date.

Build an allegation-to-evidence map

Before writing, divide the notice into its individual allegations and calculations. A compact internal matrix helps the company see which points are supported, disputed, unclear or still being investigated. It also makes it easier to ensure that the reply and attachments use consistent figures.

Notice point What to record What the company should establish
Allegation or paragraph Paragraph number, issue, tax period and amount stated Whether it is admitted, disputed or needs clarification
Department’s basis Calculation, document or factual assertion relied on Whether the company has the referenced material and whether its figures reconcile
Company’s explanation Relevant facts and the company’s position How the records support the explanation or identify a factual disagreement
Supporting records Attachment name and relevant date, period or transaction Whether each attachment actually addresses the allegation and agrees with the reply
Open item and owner Missing information, follow-up needed and responsible person Whether the point is ready for review and filing

The table is an internal working tool, not a prescribed statutory form. Keep it focused on the notice: a large bundle of unrelated business records can make the response harder to assess rather than stronger.

Use the map to assign each open point to someone who can answer it, such as the person maintaining the relevant ledger or return working papers. Set a status for each allegation—ready, awaiting records, or requiring professional review—and update it as the response develops. Before filing, compare the proposed attachment list against the matrix: every key assertion should have an identified factual basis, and every attachment should have a clear purpose.

Which documents to gather

There is no universal statutory checklist of documents for every demand notice. Select records that prove or clarify the actual allegations, and check that totals agree across the reply, calculations and attachments. Depending on the issues raised, the company may need to review existing records such as:

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.
  • GST returns for the relevant period and the underlying return working papers;
  • sales and purchase registers, invoices and credit or debit notes;
  • general ledgers and relevant account extracts;
  • contracts, purchase orders or other records explaining the transaction or its terms;
  • payment records that support the company’s account of a transaction;
  • e-way bills where the notice concerns movement of goods;
  • reconciliation statements linking the department’s figures to the company’s records;
  • relevant prior correspondence, audit materials or explanations already given to the department; and
  • the notice, its annexures, the DRC-01 summary and records showing how and when the communication was served.

These are examples of potentially relevant existing records, not documents every company must submit. For each proposed attachment, identify the allegation it supports, the relevant period or transaction, and any calculation it explains. If a document contains material unrelated to the issue, consider with an adviser whether it is necessary and how to present it appropriately. Do not alter source records to make them fit a calculation; explain discrepancies transparently.

For a discrepancy involving returns or ledgers, show how the company moved from the source records to the figure in its response. A reconciliation can make differences easier to follow when it identifies the relevant period, category of transaction and underlying records. Where the notice refers to a transaction, connect the invoice or contract, relevant ledger entry and payment or movement record only insofar as each helps explain that transaction. The records should support the company’s actual explanation rather than merely increase the size of the submission.

Check that document labels are consistent with the reply’s references and that a reviewer can identify the relevant dates or transactions. If the department’s calculation is unclear, identify what information is missing and explain why clarification is needed; do not silently substitute an unsupported assumption. Keep the originals and working copies in the company’s records, and preserve a copy of exactly what was uploaded.

Draft a point-by-point reply

Organise the written response in the same sequence as the notice. For each allegation, state the company’s position, explain the relevant facts, identify the records that support it, and address the department’s stated calculation or grounds. The DRC-06 form provides a reply field and a list of uploaded documents; it does not prescribe a particular advocacy format.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.
  1. Identify the matter. Include the notice reference, GSTIN, financial year or tax period, and the provision cited, using the details shown in the notice and the applicable form.
  2. Answer each allegation separately. Say whether the company admits the point, disputes it, or needs clarification. Avoid a general denial that leaves the notice’s specific grounds unanswered.
  3. Set out the factual explanation. Explain what the company’s records show and how they relate to the department’s assertion. Keep factual statements distinct from legal arguments so that each can be checked.
  4. Address the calculation. If the company believes a figure is incorrect, show the basis for that position and identify the underlying records. Reconcile the response’s totals with the relevant returns and attachments.
  5. Connect evidence to claims. Name each attachment clearly and refer to it beside the allegation it supports. Include only relevant records and ensure the uploaded-document list matches the files actually submitted.
  6. Have the legal position reviewed. A qualified GST professional should check the statutory route, tax-period rules, legal grounds and any proposed payment position before filing, particularly where fraud, wilful misstatement or suppression is alleged.

Do not rely on volume alone. A concise explanation tied to identifiable records is easier to evaluate than a collection of documents with no indication of what each proves.

Where the company disputes a calculation, show the correction in a way that can be followed from the inputs to the result. Identify which figure in the notice is challenged, what record or transaction changes it, and how the corrected total was reached. If only part of an allegation is disputed, distinguish that portion from any part the company admits rather than treating the entire issue as one undifferentiated disagreement.

Keep the tone factual and precise. Do not make unsupported accusations or state legal conclusions as if they were self-evident. If the company cannot yet answer a point because information is unclear or missing, identify the specific issue and the clarification needed. Any request for more information should be reviewed in light of the notice and deadline; it should not be treated as automatically extending the time to reply.

File the applicable form and preserve the record

For demand notices within Rule 142’s coverage, the rules provide for a DRC-01 notice summary and a DRC-06 reply. DRC-06 calls for details including the taxpayer’s GSTIN, notice information, financial year, reply, uploaded-document list, hearing preference, verification and authorised-signatory details. Confirm the current portal process, form requirements and permitted attachments before submitting; rules and portal procedures can change.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.
  1. Review the notice and confirm that the DRC route and response form apply to the case.
  2. Complete the applicable reply form with the notice details and the company’s response.
  3. Upload the supporting documents identified in the reply and check that the document list is accurate.
  4. Make the personal-hearing selection in the form as appropriate, and state the request clearly in writing if the company seeks a hearing.
  5. Verify the response, attachments, signatory details and submitted figures before filing.
  6. Save the filed reply, attachments and portal acknowledgement or other proof of submission, along with the service record and notice.

The form’s hearing option is a practical decision point, not a substitute for written submissions. A hearing may be useful where oral clarification or explanation could assist. The cited section 73 text provides for a hearing when the person chargeable with tax or penalty requests one in writing, or when an adverse decision is contemplated. Check the provision applicable to the notice and make any request in the required manner.

Before final submission, check the form fields against the notice, including the GSTIN, reference details and financial year. Confirm that the authorised signatory details and verification are complete, and that the uploaded-document list corresponds to the actual files. Keep the portal acknowledgement with a copy of the reply as filed; retaining only a draft or a screen capture of an unfinished submission will not establish what the company ultimately submitted.

Consider payment proposals separately from the reply

Payment is not simply another box to tick while preparing a response. The rules discuss DRC-03 for informing the officer of payment in specified circumstances, DRC-04 as an acknowledgement, DRC-01A communications in certain pre-notice situations, and DRC-05 as a conclusion order in covered payment cases. The relevant procedure and legal effect depend on the provision, amount, timing and circumstances.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Before making or describing a payment, have a qualified GST professional assess what it covers and whether it could have consequences for the proceedings. In particular, verify whether payment may conclude proceedings in the company’s situation and what, if anything, remains disputed. Keep the payment record and any acknowledgement or order with the notice file. Do not assume that a payment settles every issue simply because money was paid.

Separate the decision about payment from the work of answering the allegations. The company should be clear about the amount, the basis for it, the point or period it relates to, and the procedure it is using. Check the applicable legal effect before describing a payment as full settlement or as an admission. If any part of the department’s demand remains disputed, the response should accurately explain the company’s position and should not leave the status of that dispute ambiguous.

Review the order if one is issued

When an adjudication order arrives, compare it with both the notice and the company’s reply. Check the facts accepted or rejected, tax period, calculations, tax, interest, penalty and grounds for the decision. Keep the communication date and the complete order, including any annexures.

The cited section 73 text states that an order cannot demand more than the amount specified in the notice or confirm demand on grounds outside those stated in it. Verify that rule against the provision and law applicable to the particular case before relying on it. Separately, obtain advice promptly about the review or appeal route and deadline under current law; those details depend on the order and circumstances and are not established as one universal period here.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Make a side-by-side check of what the notice proposed, what the company answered and what the order decided. Note any difference in the grounds relied on, the period or the amounts, and give the complete order and its communication details to the company’s GST adviser without delay. Do not assume that filing a reply ends the matter or that the time to consider a later challenge is open-ended; the applicable route and timing require separate, current advice.

Common mistakes that weaken a response

  • Replying to a summary instead of the complete notice. Read the allegations and annexures together; a summary may not contain the details needed to answer the case.
  • Using the wrong statutory route or period. Check the cited provision and the law effective for the tax period, including whether current section 74A provisions are relevant.
  • Assuming one reply deadline applies to every notice. Verify the date and applicable time limit for this notice rather than relying on a generic number.
  • Sending a broad denial without addressing the grounds. Follow the notice paragraph by paragraph and explain the factual or calculation disagreement.
  • Uploading records without tying them to the allegations. Label and reference relevant attachments, and reconcile their figures with the written response.
  • Paying without assessing the consequences. Check the applicable procedure and legal effect before treating payment as a routine step.
  • Failing to keep filing proof. Retain the final response, uploaded files, acknowledgement and communication record in one case file.

Because GST notices are governed by specific provisions and time periods, a company should have its response reviewed by a qualified GST professional. The company should verify the currently applicable CGST and corresponding SGST or IGST provisions, current form requirements and jurisdiction before filing. This is general procedural information, not legal advice for a particular notice.

Frequently Asked Questions

How do I reply to a GST show-cause notice?

First identify the provision, tax period, allegations, proposed amounts and reply date in the complete notice and annexures. Reconcile each allegation against the company’s records, draft an issue-by-issue response with relevant supporting documents, file the form that applies to the notice, request a hearing where appropriate and retain proof of submission. Have a qualified GST professional check the current legal route and procedure.

What documents are required for a GST notice reply?

There is no universal document list for every GST notice. Depending on the allegations, relevant records may include GST returns and working papers, invoices, sales or purchase registers, ledgers, contracts, payment records, e-way bills, reconciliations, prior correspondence and audit materials. Attach only records that help address the notice, and ensure their figures agree with the reply.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

What is the deadline to reply to a GST show-cause notice?

There is no single deadline established for every type of GST show-cause notice. Read the date in the complete notice, record the service details, and have an adviser verify the applicable time limit based on the provision, tax period and current law. Do not assume that requesting missing information or having an unclear copy automatically changes the deadline.

Do I need to file DRC-06 for every GST show-cause notice?

No. The DRC-06 reply applies to demand notices covered by the Rule 142 process; “show-cause notice” is also used in other GST contexts. Confirm that the DRC route and current form requirements apply to the specific notice before filing.

Should a company ask for a personal hearing?

Consider requesting one if oral clarification or explanation could assist. DRC-06 includes a personal-hearing choice, and the cited section 73 text provides for a hearing when requested in writing or when an adverse decision is contemplated. Check the provision applicable to the notice and make the request in the required manner.

Does paying the amount end GST proceedings?

Not necessarily in every situation. The rules provide for payment-related forms and communications in specified circumstances, but the consequences depend on the provision, amount, timing and case. Before paying, obtain advice on what the payment covers, whether proceedings may conclude and what issues remain disputed.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

The Bottom Line

Respond to the notice in the order it presents its allegations: verify the route, period and date; match each claim to relevant company records; explain the facts and any calculation dispute point by point; file the applicable form, request a hearing if appropriate and retain proof. Because deadlines, forms and payment consequences depend on the specific notice and current law, have a qualified GST professional review the response before filing.
