If a builder delays possession, a home-loan moratorium may offer temporary payment relief if your lender approves it, while restructuring can change the loan terms to address a longer-lasting affordability problem. Neither option is automatic, and a possession delay by itself does not establish that your EMI or pre-EMI has stopped. Ask the lender for written terms and compare the payment due, interest, fees, credit reporting and full repayment schedule before agreeing.
First, don’t assume the possession delay pauses your loan
Your loan is an agreement with your lender; the builder’s possession commitment is a separate matter. A missed possession date, a builder’s promise to pay EMI, or a missed builder payment does not by itself establish that your payment obligation to the lender has ended. Check your own loan and any tripartite or subvention documents, and ask the lender to confirm in writing what is currently due.

This distinction matters especially when the builder was supposed to service interest or EMI. The Reserve Bank of India (RBI) has cautioned about repayment and credit-information risks in builder-serviced schemes, including the possibility of a borrower’s credit rating or score being affected if the builder delays payments on the borrower’s behalf. The Supreme Court of India’s orders dated 4 March and 29 April 2025 recount disputes in which builders promised to pay EMI or pre-EMI under tripartite arrangements, later defaulted, and lenders sought repayment from homebuyers while projects remained incomplete. Those orders describe particular disputes and proceedings; they do not establish that every borrower has the same remedy or can stop paying.

Keep the immediate lender question separate from the dispute about possession. The first is what your loan account requires now and whether the lender will approve a temporary or longer-term change. The second concerns the builder’s commitments and delay. A builder’s promise, a possession estimate, or a complaint about the project is not a substitute for written confirmation from the lender about your due date and account status.
Moratorium or restructuring: which should you ask about?
Start with the duration and nature of the cash-flow problem. If the disruption is short-term and you expect income to recover, ask whether the lender offers a temporary deferment or other temporary arrangement. If reduced payment capacity is likely to continue, ask the lender to model restructuring options. A lender may consider a tenure extension or changes to instalments, but eligibility and terms depend on its policy and your loan documents.
| Your situation | First request to the lender | What to compare before accepting |
|---|---|---|
| Temporary income or cash-flow disruption, with expected recovery | Ask whether a short moratorium or other temporary arrangement is available for your account. | Interest during the pause, whether it is capitalized or payable separately, any catch-up payment, the new EMI and end date, fees, and credit reporting. |
| Reduced ability to pay that may persist | Ask for restructuring scenarios, including a revised instalment or tenure extension. | New EMI, total interest and repayment, repayment end date, any rate change, fees, and credit reporting. |
| Under-construction home with only part of the loan disbursed | Request the disbursement history, pre-EMI calculation, and available repayment alternatives. | Interest on the amount disbursed, future stage-linked disbursals, when regular EMI begins, and whether paying principal earlier is feasible. |
| Builder had agreed to pay interest or EMI and has missed a payment | Notify the lender, request your current account statement, and ask what is due from you now. | Your obligations under lender documents, the due date, possible charges or credit reporting, and separate steps concerning the builder. |
This is a way to frame questions, not a guarantee that the lender will approve a request or legal advice about an individual contract. Get the lender’s decision and the terms that apply to your account in writing.
It can help to describe the problem in practical terms when you contact the lender: whether you need relief for a defined short period or cannot afford the current instalment on an ongoing basis. If the issue is temporary, ask what payment resumes and when. If it is likely to last, ask for a scenario that shows the new instalment and complete cost over the extended term. If the loan is partly disbursed, ask for a separate calculation that reflects the amount actually drawn and any expected stage-linked disbursements.
How a moratorium works—and what the word does not tell you
A moratorium is a temporary lender-approved deferment or pause in scheduled payments. The label alone does not tell you whether interest continues to accrue, whether it is added to the loan balance, or whether it must be paid separately. Nor does it tell you whether the deferred payments are collected later in a lump sum, spread across future instalments, or handled another way. Those details must come from the written arrangement for your account.
Before agreeing, ask the lender to show what happens to the balance during the pause and exactly what payment is due in each month, both during the pause and after it ends. Confirm the effective date and duration, whether the pause applies to principal, interest, or both, and what happens if the review is still pending when your next payment falls due. Do not treat “moratorium” as a promise of interest-free relief or assume a delayed possession automatically qualifies you.

A moratorium may fit a temporary gap if the payment schedule after the pause is affordable. If the underlying shortfall will continue, simply postponing payments may leave you facing a payment later without resolving the longer-term mismatch. The lender’s proposed schedule—not the name of the relief—is what lets you judge whether it addresses your problem.
Ask the lender to spell out whether the arrangement changes only the dates on which payments are due or also changes the balance, instalment, or loan term. If interest is capitalized, request the amount added and the balance used for the revised schedule. If interest is paid separately, ask for the due dates and amounts. If deferred sums are spread across later instalments, check whether those instalments rise, whether the term changes, and when the normal schedule resumes. These are account-specific terms, so do not infer them from a general description of a moratorium.
How restructuring works—and the cost of a lower EMI
Under the RBI’s Resolution of Stressed Assets – Revised Framework, restructuring is a concession granted by a lender for economic or legal reasons connected to a borrower’s financial difficulty. It normally changes one or more loan terms, such as the repayment period, instalment amount, repayable amount, or interest rate. The lender decides whether to offer it under its applicable policy; a borrower cannot assume that a request will be accepted.
A longer repayment period can reduce the monthly EMI, which may help with a continuing cash-flow problem. But paying for longer generally means more interest and a more expensive loan. RBI consumer guidance says a bank may increase tenure to reduce the EMI burden in a short-term cash-flow mismatch; it also cautions that the longer tenure increases interest payments. Ask for the revised amortization schedule, including the total interest and final repayment date, rather than judging the offer by its EMI alone.
| Comparison point | Moratorium | Restructuring |
|---|---|---|
| Main purpose | Temporary deferment or pause, if the lender approves it. | Modify loan terms to address financial difficulty, subject to lender approval. |
| What may change | Payment timing; treatment of interest and deferred amounts depends on the written terms. | One or more terms, potentially repayment period, instalment amount, repayable amount, or interest rate. |
| Immediate cash-flow effect | May reduce or defer scheduled payment temporarily; confirm exactly what remains payable. | May lower the instalment, depending on the revised terms. |
| Long-term cost | Cannot be assessed from the label: obtain the balance calculation and complete post-pause schedule. | A longer tenure can mean more interest and higher total repayment; compare the full schedule. |
| Availability and charges | Not automatic; lender terms and any fees must be confirmed for the account. | Not automatic; lender terms and any fees must be confirmed for the account. |
Use this comparison only as a starting point. The actual written offer may combine or sequence changes, and its cost depends on the balance, rate, remaining term, and lender’s treatment of payments. Ask for an option-by-option schedule rather than trying to infer the total cost from a revised EMI.
For a fair comparison, use the same starting account position and ask the lender to show the payment path from the next due date through final repayment under each option. Compare immediate monthly cash relief, interest accrued or capitalized during any pause, revised instalments, total interest, total repayment, the end date, and all charges. A lower amount due this month is useful only if the later payments and overall cost are workable for you.

Under construction? Understand pre-EMI and staged disbursals
When a housing loan is disbursed in stages as construction progresses, pre-EMI is generally interest on the amount already disbursed. RBI’s home-loan FAQ describes it as payable from each disbursement until regular EMI begins. A possession delay alone does not establish that this interest stops. Request the lender’s disbursement history and the calculation behind the current pre-EMI so you can check the amount against what has actually been drawn.
RBI housing-finance guidance says disbursals to individuals should be closely linked to construction stages. It also warns about risks in builder-linked schemes in which the builder services interest or EMI, or loans are disbursed upfront. If your loan is only partly disbursed, ask how future construction-linked disbursals affect the interest amount and when regular EMI is scheduled to begin.

This is not a facility every lender is established to offer. Ask whether it is available for your account and request the payment amount and resulting schedule in writing before relying on it.
Do not assume that every under-construction loan has the same payment arrangement. Your current payment may be pre-EMI based on disbursements to date, while later construction stages may lead to further disbursements and a different interest amount. Ask the lender to identify each disbursement date and amount, the current outstanding balance, the current pre-EMI calculation, and the point at which regular EMI is expected to start. Then compare any proposed relief against that specific schedule.

- Request a full fee list. Ask whether there are charges for restructuring, changing tenure, or any other part of the arrangement. RBI consumer guidance lists tenure changes and restructuring among possible loan fees; the applicable charges for your account must be confirmed by the lender.
- Confirm credit-information reporting. Ask how the arrangement, any missed payment, and any builder-serviced payment default will be reported to credit information companies, and request the answer in writing.
- Clarify timing and the review period. Obtain written confirmation of the decision, effective date, payment required while the request is being reviewed, and what happens when a pause ends. Do not assume a pending request changes a due date.
Keep the sanction letter, loan agreement, account statements, builder-buyer agreement, tripartite or subvention papers, builder’s possession commitments, delay notices, payment receipts, and correspondence with both the lender and builder together. Those documents help you distinguish what the lender has agreed to from what the builder promised.
When asking for written terms, check that they identify the account and the effective dates rather than describing a general policy. Save the lender’s response and the schedule you used to compare options. If the lender says no relief is available, ask what payment remains due and whether any other account-specific arrangement can be considered. Do not stop or change payments based only on an unanswered request or an informal discussion.

Separate the builder’s commitment from the lender’s written loan terms. The RBI’s housing-finance guidance warns that builder-serviced payment arrangements can expose borrowers to repayment and credit-information risks. The Supreme Court orders of 4 March and 29 April 2025 recount disputes involving builder promises to pay homebuyers’ EMI or pre-EMI, subsequent builder defaults, lender demands, and incomplete projects. These accounts are relevant context, not a determination of the remedy in your individual case.
If the builder has stopped paying, contact the lender promptly for an account statement and ask what payment is due under your loan documents. Preserve evidence of the original commitment and missed payments, including the tripartite or subvention arrangement, receipts, notices and correspondence. Ask the lender to confirm the account’s payment status and reporting treatment. Any claim or remedy against the builder is a separate issue from confirming your immediate position with the lender.
RBI’s housing-finance guidance also emphasizes linking individual housing-loan disbursals to construction stages and cautions about builder-linked schemes, including arrangements where a builder services the interest or EMI. For an existing borrower, that is a reason to document what was disbursed, what the builder undertook to pay, what was actually paid, and what the lender now records as due. Keep copies of the sanction letter, tripartite agreement, builder-buyer agreement, payment receipts and relevant notices together; do not rely on a builder payment schedule as proof that the lender has altered your loan account.

If the problem is temporary, a short deferment may be worth considering only if its post-pause terms are manageable. If the difficulty is likely to persist, ask the lender to model restructuring rather than relying on a temporary pause alone. In either case, decide from the written schedule and account-specific terms, not the builder’s possession estimate or a verbal promise.
Frequently Asked Questions
Can I stop paying my home-loan EMI if the builder delays possession?
A possession delay alone does not establish that your payment obligation to the lender has stopped. Check your loan and any tripartite or subvention documents, and ask the lender in writing what is due. Do not skip a payment based only on a builder’s promise or a pending relief request.
Does pre-EMI continue while construction or possession is delayed?
For a stage-wise disbursed home loan, RBI describes pre-EMI as interest on the amount disbursed, payable from each disbursement until regular EMI begins. A possession delay alone does not establish that it stops. Ask your lender for the disbursement history and current calculation.
Do these 3 things before closing this tab:
1Fix the driver behind crashes, sound loss and screen glitches2Clear out junk files and repair common Windows errors3Scan for outdated or missing drivers - takes under a minuteIs a moratorium interest-free?
Not necessarily. The word does not specify whether interest continues, is capitalized, paid separately, or dealt with another way. Ask the lender for the balance calculation and a written schedule showing payments during and after the proposed pause.
Which is better when a builder delays possession: moratorium or restructuring?
It depends on whether your payment problem is temporary or likely to persist, and on the lender’s written terms. A moratorium may defer payments for a limited period; restructuring changes one or more loan terms. Compare the immediate payment, interest, fees, credit reporting, total repayment and final repayment date.
What if the builder promised to pay my EMI but has stopped?
Notify the lender promptly, request a current account statement, and ask what is due under your loan documents. Preserve the tripartite or subvention papers, receipts, builder commitments, missed-payment records and correspondence. RBI has warned that builder-serviced schemes can expose borrowers to repayment and credit-information risks.
Can restructuring lower my EMI?
A lender may consider changing the instalment or extending the tenure, but approval and terms depend on its policy and your loan documents. A longer tenure can lower the EMI while increasing total interest. Ask for a revised amortization schedule showing total interest, total repayment and the final repayment date.

The Bottom Line
A builder’s delay does not by itself pause your home-loan obligation. Ask the lender for account-specific options in writing, then compare any moratorium and restructuring offer by its payment due during relief, interest treatment, fees, credit reporting, total repayment and final date. A lower EMI or temporary pause is useful only if the complete schedule is manageable.
