Gujarat’s reported response was that the proposal would be open to all existing port operators and remained under consideration. The available sources establish the competing claims, not that a monopoly was created or that the extension was approved.
What Congress alleged about Mundra port
Ramesh said Adani Ports and Special Economic Zone Ltd. (APSEZ) had sought an additional 45 years for its Mundra concession before the 2024 Lok Sabha election. He argued that such an extension would harm competition and reduce state revenue. His description of the outcome as a “monopoly” was an allegation and prediction, not a finding supported by market-share or pricing data in the sources available here. The 45-year figure refers to the additional period Ramesh said APSEZ sought; it is not evidence of an approved extension or a confirmed final agreement.
What Gujarat said in response
As reported by the Financial Express, the state said the proposed policy was still under consideration and would apply equally to existing port operators. It also said extension requests had come from PLL at Dahej, APM Terminals at Pipavav and APSEZ at Mundra, rather than from one operator alone. The government rejected the claim that the proposal would create a monopoly. Financial Express reported the response on 15 August 2024.

The same report says the government disputed Ramesh’s claim that 50 years was the maximum permissible concession term, citing the Gujarat Industrial Development Board Act and longer terms in other coastal states. That is the government’s reported interpretation; the cited material does not independently resolve the legal question.
How the proposal relates to Gujarat’s port concessions
Gujarat has used a build-own-operate-transfer (BOOT) framework for port development. The state’s Ports and Marine Sector page records a 30-year BOOT agreement for Pipavav executed in 1998 and a Mundra BOOT agreement signed in February 2001.

Gujarat Pipavav Port Limited’s FY2023–24 financial statements separately record its 30-year BOOT agreement with the state and Gujarat Maritime Board, dated 30 September 1998. The company filing was submitted on 31 July 2024. Those records document earlier agreements; they do not establish that the proposed 2024 extensions were granted or what their final terms might have been.

- Established: Congress made the allegation, and Gujarat’s reported response rejected it and said the proposal would apply across operators.
- Established: Gujarat’s port framework includes earlier BOOT agreements, including Pipavav’s documented 30-year concession.
- Not established: Whether the proposal was later approved, rejected or revised, or what terms—if any—were ultimately applied to each operator.
- Not established: Whether any extension changed competition, port-user prices or state revenue. The cited reports provide competing predictions, not measured outcomes, a competition-authority finding or a market-share analysis.
The distinction between state-managed and centrally administered ports matters when comparing rules. In an August 2024 parliamentary statement, the Union government said 217 non-major ports were managed by state maritime boards or state governments, while 12 major ports were under central administration. Its description of open bidding concerned project-level public-private participation at major ports; it does not establish the rules governing Gujarat’s state-managed ports. The Press Information Bureau published the statement on 6 August 2024.
