GST Reforms: What Could Change in Compliance, ITC, Refunds and Litigation From 2027

India’s GST Council has recommended a return-reconciliation overhaul and changes to ITC refunds, refund processing and disputes. The proposals have different dates and still depend on final legal and portal implementation.

India’s 57th GST Council recommended a major return-reconciliation change that may begin with the April 2027 return, alongside proposed expansions to some input tax credit (ITC) refunds and changes to refund processing, penalties and appeals. These are recommendations, not a blanket set of rules already in force: the applicable law, notifications, circulars and GST portal changes will determine what taxpayers can actually use and when.

What is proposed, and when could it take effect?

At its meeting on 8 October 2026, the GST Council recommended amendments to the CGST Act, CGST Rules and IGST Act, as well as circulars and portal changes. The Government of India’s explainer, published on 9 October, describes the recommendations. The Council also recommended public consultation on the revised return mechanism.

The measures do not share one start date. The proposed dates relate to different actions: credit availed from 1 November 2026, the return for April 2027, and credit availed from 1 April 2027. Until the relevant legal and system changes are finalized, businesses should treat the measures below as proposals rather than current entitlements or filing options.

Measure Proposed timing or condition Who may be affected
Refund of accumulated ITC on input services for inverted-duty-structure claims Credit availed on or after 1 November 2026 Businesses with qualifying inverted-duty-structure claims
Revised return-reconciliation mechanism May apply from the return for April 2027; subject to consultation and final changes Taxpayers reporting liability and ITC across GST returns
Refund of capital-goods ITC for zero-rated and inverted-duty-structure claims Credit availed on or after 1 April 2027; refund spread over 60 months Eligible exporters and businesses with qualifying inverted-duty-structure claims

How could GST return reconciliation change?

The central compliance proposal is to align outward-supply liability and ITC reported across GSTR-1, GSTR-1A or IFF, GSTR-3B and GSTR-2B. The Council recommended that the mechanism may begin with the April 2027 return and be put to public consultation. Final forms, rules and portal functionality will determine how taxpayers make corrections.

The proposed tools and controls include:

  • Improved reconciliation of GSTR-1, GSTR-1A and IFF with GSTR-3B, including a way to correct GSTR-3B liability to align with outward-supply information.
  • Portal statements showing reverse-charge tax paid and the related ITC claimed.
  • An Invoice Management System through which recipients could accept, reject or keep certain inward-supply documents pending for GSTR-2B generation.
  • An Electronic Credit Reversal and Reclaim Statement.
  • Alignment of ITC reported in GSTR-3B with ITC available in GSTR-2B.
  • Invoice details for payments made through DRC-03.

For businesses, the practical effect would be a more explicit link between invoice-level information, recipient responses, available credit and the amounts reported in returns. The exact correction steps, deadlines and treatment of pending or disputed documents depend on the final mechanism; taxpayers should not assume that a proposed portal feature is available before GSTN implements it.

What could change in registration and cancellation?

The Council recommended clearer registration documentation and FAQs, easier portal navigation, drop-downs, tooltips and contextual filing guidance. It also proposed automatic acceptance for most amendments to registration particulars. Changes to the principal place of business would generally sit outside that automatic route; taxpayers registered through the automatic route would have automatic acceptance for all registration particulars, including that place.

For cancellation applications, the proposed first phase would allow system acceptance after pending returns are filed and dues are paid for specified taxpayers. This includes taxpayers who did not pass on more than ₹2.5 lakh of ITC in any month, and those who exceeded that amount in a month if they file the final return within the specified time. A later phase would extend automatic acceptance more broadly once returns and dues are cleared.

Proposed route for some small sellers using e-commerce operators

The Council also recommended a simpler registration route for eligible small goods sellers using e-commerce operators in States or Union Territories where they have no physical presence. Under the proposal, the operator’s warehouse would be declared as the principal place of business. Eligibility would be subject to conditions, including a monthly ITC-passing threshold of ₹2.5 lakh. The detailed conditions and final process will matter; the recommendation alone does not establish eligibility for an individual seller.

Which ITC refund claims could expand?

Two proposed changes concern the type of credit that may be refunded. They have different credit dates and apply to specified claim categories, so they should not be treated as a general right to cash out all accumulated ITC.

Input services in inverted-duty-structure claims

The Council recommended allowing refunds of accumulated ITC on input services for inverted-duty-structure claims where the credit was availed on or after 1 November 2026. A taxpayer should confirm the enacted provision and the relevant credit-availment date before relying on this for a claim.

Capital goods in zero-rated and inverted-duty-structure claims

For capital goods, the Council recommended refunds in claims relating to zero-rated supplies and inverted duty structure for credit availed on or after 1 April 2027. The proposed refund would be spread over 60 months. This is distinct from the input-services proposal and does not mean that capital-goods credit availed earlier qualifies.

Proposed changes to specified blocked-credit restrictions

The Council recommended removing section 17(5) restrictions for listed categories that include outdoor catering; health and life insurance; telecommunication towers; pipelines outside factory premises; free samples; and goods destroyed or written off on expiry of shelf life as required by law. These proposed changes are not a blanket entitlement. The final statutory text and the general conditions for claiming ITC would still govern each transaction.

How might refund processing work?

The Council recommended a phased, more automated process. In the proposed first phase, system risk evaluation would be relevant to provisional refunds for zero-rated and inverted-duty-structure claims. In the second phase, automation would extend further to qualifying applications.

Proposed process change Scope or condition
Automatic sanction of full excess balance in the electronic cash ledger First phase
Acknowledgement or deficiency memo deadline reduced from 15 days to 10 days First phase; deemed acknowledgement if neither is issued within 10 days
Automatic provisional sanction of 90% First phase for zero-rated and inverted-duty-structure refunds, using system risk evaluation
Automated acknowledgement after system verification Second phase for qualifying applications
Full automated sanction after adjustments for pending dues and system risk evaluation Second phase for zero-rated claims

Other recommendations would make RFD-01 refund data system-readable and remove scanned-document uploads for specified zero-rated and inverted-duty-structure claims. The Council also recommended removing the cap that limits zero-rated goods refunds to 1.5 times the domestic turnover of like goods, and clarifying that the ₹1,000 minimum threshold applies to the combined refund amount across CGST, SGST/UTGST and IGST.

For appeal pre-deposit refunds, the Council recommended clarifying interest through a standalone provision in section 115 and a circular. The recommendation does not by itself settle the applicable calculation or entitlement; those details depend on the final provision and guidance.

What is proposed for notices, penalties and appeals?

The Council recommended comprehensive guidance for officers handling demand notices and adjudication and appeal orders. The proposed guidance covers quality and timeliness, evidence-based use of fraud, wilful-misstatement or suppression grounds, and observance of natural justice, including personal hearings.

Notice threshold and reduced penalties

A combined tax-and-cess threshold of ₹10,000 was recommended for show-cause notices. Certain pending notices and appeals below that level would be decided as if the threshold had applied when the notice was issued.

For non-fraud cases, the proposed reduced penalty would be 5% if tax and interest are paid within 30 days under section 73 or within 60 days under section 74A after the adjudication order. The Council also recommended removing the minimum ₹10,000 penalty. Separately, the proposed maximum general penalty under section 125 would fall from ₹25,000 to ₹10,000.

Appeals involving only a penalty

Where an order involves only a penalty and no tax demand, the proposed upper limit for the appeal pre-deposit is ₹40 crore in total: ₹20 crore for CGST and ₹20 crore for SGST/UTGST.

Arrest and prosecution proposals

The Council recommended omitting section 69, which provides GST arrest powers, raising the prosecution threshold from ₹1 crore to ₹5 crore, and narrowing or rationalizing specified prosecution offences and punishments. These are consequential enforcement proposals; they should not be described as a current change unless the relevant amendments have taken effect.

What other proposals may matter to exporters and businesses?

The Council recommended export-related changes for services supplied to or through foreign offices or branches, a circular on permissible receipts in foreign exchange or Indian rupees, and a default recipient-location place-of-supply rule for certain services where the recipient makes goods physically available. It also recommended zero-rating in specified cases where goods for an overseas buyer are delivered into an SEZ or FTWZ and payment is received in convertible foreign exchange or permitted Indian rupees. The precise conditions will depend on final legal text, so exporters should not infer eligibility from these summaries alone.

Other process proposals include tighter limits and authorization for e-way-bill interception, a hearing process for objections to electronic credit-ledger blocks under rule 86A, and a late-fee waiver for delayed returns by taxpayers whose preceding-year turnover is up to ₹5 crore if the returns are filed by the end of the month in which they are due.

What should taxpayers verify before acting?

Before changing a return, refund claim, registration application or litigation position based on these proposals, check the current legal and portal status of the specific measure. In particular:

  • Confirm whether an amendment, notification, rule or circular has been issued and its effective date.
  • For a refund, check the relevant category, credit-availment date, claim conditions and any phased implementation.
  • For return reconciliation, use only the correction and document-response options actually enabled in the GST portal.
  • For a notice, penalty or appeal, check the applicable statutory provision and transition rules for pending matters.

The Council’s recommendations and the Government of India’s 9 October 2026 explainer describe a proposed direction, not proof that every change has been finalized or commenced. The operative text and GST portal implementation control what a taxpayer can do.
