Reverse charge does not automatically exempt a supplier’s invoice from GST e-invoicing. If a supplier is covered by India’s e-invoice mandate, it must report its own invoice to an Invoice Registration Portal (IRP) for a supply attracting reverse charge under section 9(3), even though the recipient pays the tax. The recipient’s tax liability and the supplier’s invoice-registration duty are separate questions.
Does reverse charge require an e-invoice?
It depends on whether the supplier is covered by the e-invoice mandate and whether the particular supply is within scope. The GST E-Invoice System FAQ states: “If the invoice issued by notified person is in respect of supplies made by him but attracting reverse charge under Section 9(3), e-invoicing is applicable.” In other words, a covered supplier cannot treat its own outward invoice as exempt from e-invoicing simply because the buyer pays GST under reverse charge. Reverse charge determines who is liable to pay tax for a specified supply; it does not, by itself, decide whether the supplier must register its invoice electronically. The recipient’s liability for applicable reverse-charge supplies is addressed separately in the IGST Act.
Who does what in a covered RCM transaction?
| Responsibility | Party | What it means |
|---|---|---|
| Issue and report the outward invoice | Supplier covered by the e-invoice mandate | Submit invoice data to an IRP. If validated, the IRP assigns an Invoice Reference Number (IRN). The GST E-Invoice System says the supplier generates the e-invoice, not the recipient or transporter. GST E-Invoice System mandate page |
| Pay tax under reverse charge | Recipient, where the applicable RCM provision makes the recipient liable | Handle the recipient-side tax obligation separately from the supplier’s invoice-registration step. The applicable provision and facts determine the treatment. IGST Act |
| Reconcile the inward document and records | Recipient | Check the supplier document against inward RCM records and the recipient’s tax treatment. GSTR-2B identifies inward supplies liable to reverse charge as a separate category, including invoices, debit notes and amendments. GST Portal GSTR-2B FAQ |
Which supplier and transaction cases differ?
Covered supplier’s own section 9(3) supply
When a supplier within the mandate issues an invoice for its own supply that attracts section 9(3) reverse charge, it reports that invoice to the IRP. The official FAQ illustrates this with an advocate firm that crosses the threshold and supplies services to a company liable to pay tax under RCM: the firm reports its invoice. #1 Best Overall
- Two-Part Carbonless Invoice Book: Each invoice book has 50 sets of invoices, each with a white/light yellow section, with the yellow section retained in the invoice book to maintain detailed records.
- Consecutively Numbered: Enlarged red 6-digit numbers in the upper right corner of each invoice receipt book help you quickly navigate through your orders.
- Wraparound Divider Flap: A thick folded cardboard divider is integrated into the back of each invoice book for use between each two-part sales order to prevent the written content from rubbing off on subsequent copies of the invoice, resulting in wasted invoices.
- 2 Packs/50 Sets (100 Sets Total): Each invoice book provides 50 sequentially numbered carbonless sets of 2 invoice books for long-term use.
- Customizable Space: Each invoice book for small business has space at the top to add a company seal or sticker.
Services received from an unregistered supplier
The FAQ says supplier e-invoicing does not arise for services received from an unregistered person. That does not settle whether the recipient owes reverse-charge tax; assess that obligation separately under the applicable provisions and facts. GST E-Invoice System FAQ
Imported services
The FAQ likewise says supplier e-invoicing does not arise for imported services. This is a distinction about supplier e-invoicing, not a general exemption from any recipient-side RCM analysis. GST E-Invoice System FAQ

How to assess whether the supplier is covered
Check turnover history
The GST E-Invoice System mandate page lists an aggregate annual turnover threshold of ₹5 crore, effective 1 August 2023. It says aggregate annual turnover in any preceding financial year from 2017–18 onward is considered. The threshold is one part of the test, not a stand-alone answer for every taxpayer or transaction. The official FAQ lists certain entity classes and supply categories excluded from e-invoicing. Because the FAQ’s summary is not a complete current legal audit, check the applicable text of Rule 48 and notifications for the relevant date against the supplier’s status and transaction. The available official materials do not establish a complete current list of every exception. GST E-Invoice System FAQ

Practical compliance checks for supplier and recipient
- Identify the document issuer and supply. Establish whether the document concerns the supplier’s own outward supply, a service received from an unregistered supplier, or an imported service.
- Determine the tax-liability route. Identify the precise RCM provision or category and which party is liable to pay tax. Do not infer e-invoice treatment from the payer alone.
- Test the supplier’s mandate status. Check aggregate turnover in the relevant preceding financial years, taxpayer class, transaction coverage and any applicable exclusion for the relevant date.
- For a covered supplier’s own in-scope invoice, submit invoice data to the IRP. The supplier—not the recipient or transporter—uses the IRP workflow; retain the resulting IRN with the invoice record.
- Reconcile recipient records. Compare the supplier document with inward RCM entries, including relevant invoices, debit notes or amendments in GSTR-2B, and apply the recipient’s tax treatment to the actual transaction.
- Verify the current rule before acting. Review current Rule 48 and applicable notifications as well as the facts for the date of supply; the general FAQ distinction does not replace case-specific compliance review.
What this rule does not establish
- Not every transaction involving reverse charge must have a supplier-issued e-invoice. The outcome depends on who issued the invoice and whether that supplier and transaction fall within the mandate.
- An inward RCM entry in GSTR-2B is a reconciliation signal; it does not, by itself, prove that a supplier-issued e-invoice is required in every RCM case.
- The e-invoice conclusion alone does not determine the recipient’s precise tax or input tax credit result; those depend on the transaction and applicable provisions.
