A GST show-cause notice (SCN) proposes action and gives you an opportunity to respond; it is not, by itself, a final adjudication order. “Demand notice” is often used loosely, so check the document’s title, cited provision, contents and stage. Under the GST procedure, a notice summary is generally associated with FORM GST DRC-01, while an adjudication order summary is associated with FORM GST DRC-07. Your next step depends on which document you received.
If you are asking, “What is the difference between a GST demand notice and a show-cause notice?” start with this distinction: a notice puts a proposed case to you, while an order records a decision after adjudication. Then identify the exact legal provision, tax period and amounts in your communication. Those details—not the word “demand” on its own—shape your response options and the dates you need to check.

What is the difference between a GST demand notice and a show-cause notice?
The key difference is procedural stage. An SCN sets out a proposed liability or action and asks the recipient to show cause why it should not proceed. An adjudication order records the authority’s decision after the process. The phrase “demand notice” may be used for a notice asserting an amount payable, but it is not a reliable way to tell whether liability has been finally determined.

The notice and the later adjudication order are separate documents in the statutory process. To understand what has happened, look at the document’s formal title, cited section and sub-section, contents, issuing authority and procedural stage. Also read the full communication and annexures rather than relying on a short portal description.

Rule 142 distinguishes a notice summary from an order summary. A DRC-01 is a summary of a show-cause notice, not proof on its own that a liability has been finally adjudicated. A DRC-07 is associated with an order summary. The summary form helps identify the stage, but it does not replace reading the full underlying notice or order.
How to identify the document and legal basis
Check the document, not just the word “demand”
Look for the document title, issuing authority, statutory section and sub-section, reference number, date, tax period and the action requested. Determine whether it is a proposed notice, a statement, or an adjudication order. A DRC-01 summary points to an SCN stage; a DRC-07 summary points to an order stage. The full document and applicable law remain essential to understanding the legal effect.
Do not decide that a communication is final simply because it displays an amount payable, uses demand-related wording, or appears in a portal summary. Equally, do not assume that every communication is merely a proposal. Check whether the document asks you to show cause, gives a decision, or identifies itself as an order. If the summary and full document seem inconsistent, preserve both and seek clarification or case-specific advice rather than guessing which one controls.
Sections 73 and 74
Under section 73 of the Central Goods and Services Tax Act, the demand concerns tax not paid or short paid, an erroneous refund, or input tax credit wrongly availed or utilised for reasons other than fraud, wilful misstatement or suppression of facts to evade tax. Section 74 addresses corresponding demands where the stated basis is fraud, wilful misstatement or suppression of facts to evade tax. These provisions have different conditions and consequences; the section and allegations printed in your notice matter.
The cited section is not a minor administrative detail. It helps you understand the kind of case the officer is asserting and which procedural route may be relevant. Read the factual grounds alongside the provision: identify what conduct, transaction, return entry, refund or input tax credit is being questioned, and whether the notice states that the issue involves fraud, wilful misstatement or suppression to evade tax. Do not infer that basis from the amount alone; compare it with the actual allegations.

These are central CGST provisions. State and union-territory GST enactments and delegated powers may also be relevant. Read the authority and provision actually cited in your communication. Section 74A may be relevant to newer periods or cases, but its current operation, commencement and application are not established here. Do not assume that sections 73 or 74 deadlines or payment concessions apply to a section 74A notice; verify the current authoritative text, amendments, commencement notifications, tax period and notice.
What DRC-01 can tell you
The DRC-01 format identifies fields including the section and sub-section, SCN reference and date, tax period and financial year, brief facts, grounds, and itemised dues for tax, interest, penalty, fees and other amounts. Use those fields as a cross-check against the full notice, calculations and annexures. A summary can help orient you, but it does not replace the notice’s complete allegations and evidence.

For each amount, note whether the summary separates tax, interest, penalty, fees and other dues, then compare those lines with the detailed computation and grounds. If a number appears without enough explanation in the summary, look for the explanation and supporting working in the notice or annexures. Keep a record of any mismatch you identify so it can be addressed in a reply or in advice about next steps.
What to check first when a notice arrives
- Record the communication details. Note the issuing authority, statutory provision and sub-section, document type, reference number, date received or served, and the tax period. Save the document and portal communication. Preserve the communication date and filing acknowledgements because timing can matter.
- Establish the procedural stage. Check whether the communication is a proposal, a statement, or an adjudication order. Do not treat “demand” in a heading or informal description as conclusive evidence that an order has been passed. Check whether the document asks for a response or communicates a decision.
- Match each allegation to its calculation. Compare the stated grounds and amounts with the notice’s working, annexures, relevant returns and business records for the period. Separate disputed items from amounts you may accept. Review tax, interest, penalty, fees and other amounts as separate lines where they are itemised.
- Check the evidence and period. Identify which records or transactions the officer refers to and whether they relate to the stated tax period. Compare the notice’s account of the facts with the supporting records available to the business. Do not assume that the short portal summary contains every allegation or supporting detail.
- Calendar the applicable date. Determine the response or appeal deadline under the actual provision and current law, counting from the legally relevant service or communication date. Do not borrow a deadline from a different section or type of proceeding. A notice-stage reply and a post-order appeal are different procedural steps.
- Preserve proof of action. Keep copies of the reply, attachments, payment intimation if any, and portal acknowledgement. Retain the original communication and evidence of when it was served or communicated, along with filing date and reference details.
- Choose a response route deliberately. Decide whether to contest the proposal, consider a qualifying statutory payment route, or obtain case-specific advice. If an order has already issued, examine appeal rights separately. The choice should follow review of the exact provision, facts, period and computation rather than the label used for the communication.
How to reply to a GST show-cause notice
For a covered notice whose summary has been uploaded in DRC-01, rule 142(4) provides for a reply in FORM GST DRC-06. The reply should address the notice’s actual allegations rather than offer a general denial. Use the notice’s numbering and explain what you dispute, what you accept, and why. The form route is tied to the rule and the circumstances described; check that it applies to the communication you received.
Before drafting, assemble the full notice, its annexures, relevant returns and records for the stated tax period, and the calculations on which the proposed amounts appear to rely. This is practical preparation, not a substitute for checking the procedural requirements that apply to your case. The goal is to make it possible to follow the response from allegation to record to conclusion.

- Build a point-by-point response. For each allegation, state the relevant facts, the amount in dispute or accepted, and the reason for your position. Follow the notice’s structure so that each issue can be matched to the corresponding response.
- Explain the legal and calculation basis. Address the cited provision and show how the relevant records support your treatment or computation. If you dispute a figure, identify the calculation or factual item at issue rather than only stating that the total is incorrect.
- Separate agreement from disagreement. Where some parts of the proposed case are accepted and others are disputed, identify those parts clearly. Do not let a broad statement obscure which allegations, amounts or grounds you are addressing.
- Attach supporting material. Include the documents relied on and identify what each attachment supports. Check that the attachments correspond to the tax period and issue in the notice. Refer to them consistently in the reply so the reader can locate the relevant material.
- Submit through the applicable route. Use FORM GST DRC-06 where rule 142(4) applies. Follow the current portal and procedural requirements for the case, and check the communication for any relevant instructions.
- Retain the filed record. Save the complete submitted reply, attachments and acknowledgement, including filing date and reference details. Keep the acknowledgement with the notice and the materials used to prepare the response.
Do not assume that a short portal summary contains every allegation. Base the response on the complete notice and its evidence, and verify the applicable rules for the exact proceeding. If the legal basis, computation or significance of an allegation is unclear, a qualified GST adviser, tax practitioner or GST litigation lawyer may be able to review the specific case. This is especially worth considering where the amount is substantial, the facts are complex, or the proposed fraud-related basis is disputed.

Can you pay instead of replying?
Rule 142 provides for payment intimation in FORM GST DRC-03. It also provides that when a person makes the qualifying payment under section 73(8) or 74(8) within 30 days after service of a notice under rule 142(1), the proper officer issues FORM GST DRC-05, concluding proceedings in respect of that notice. The qualifying amounts and legal consequences differ between the provisions.
The 30-day period described here is specifically tied to the qualifying payment route under sections 73(8) or 74(8), after service of a notice under rule 142(1). It is not a general reply deadline, a universal settlement period, or a rule to apply automatically to every GST communication. Check the precise provision, the service date, the amounts that qualify and the circumstances required by the applicable law.
This is not a universal instruction to pay. Before using the route, verify the section, facts, period, calculation and current law. Payment may have significant consequences for the matter, so consider case-specific advice where the amount, allegations or legal position are substantial or uncertain. In particular, do not assume that paying a figure in a summary automatically resolves every issue or has the same effect under sections 73 and 74. Confirm what the qualifying payment covers and what proceedings the rule says will be concluded.
If you are disputing the proposed case, understand the implications of payment before choosing that route. If you decide to make a payment intimation, retain the DRC-03 information and acknowledgement with your records. If payment is not the route you choose, make sure you understand and meet the applicable response requirements instead. The appropriate option depends on the notice, facts and governing provision; the best route can differ by taxpayer.

What if an adjudication order has already been issued?
A reply to an SCN and an appeal are different steps. A reply contests the proposed case before adjudication. If the authority has communicated an adverse order, section 107 provides a route to appeal to the Appellate Authority, generally within three months from communication of the decision or order. The appeal rules identify FORM GST APL-01 for an appeal under section 107(1).
First confirm that the document is an order and record when it was communicated. A DRC-07 summary is associated with an adjudication order, but read the order itself to understand the decision, reasons and amounts determined. Compare what the order decided with the issues and evidence previously raised. The appeal route is for an aggrieved person challenging an adjudicating authority’s decision or order; it is not another name for replying to the earlier SCN.
Check the current filing requirements, any applicable pre-deposit conditions and whether an extension is available under the governing law before acting. The three-month period is a general statutory period, not a substitute for checking the order, communication date and current rules. The available material identifies the general period and form, but does not provide a complete case-specific filing checklist or establish what pre-deposit applies in a particular case. Verify those points against the current official rules and the order before filing.
If you have an order, do not treat the notice-stage options as if they automatically remain available in the same way. Review the order’s communication date promptly, identify the decision you may challenge, and seek advice on the appeal route and filing requirements where needed. Preserve the order, its summary, the earlier notice, the reply and acknowledgements so the procedural history is together in one file.

Common mistakes to avoid
- Treating DRC-01 as the final order. It summarizes a show-cause notice; distinguish it from the adjudication order and its DRC-07 summary.
- Relying on a portal synopsis alone. Read the complete notice, grounds, calculations and annexures. A summary is a navigation aid, not the full record of the allegations and evidence.
- Assuming “demand notice” has one fixed meaning. Colloquial usage varies. Identify the document by its title, statutory basis, contents and stage.
- Applying the wrong provision’s deadline or concession. Sections 73, 74 and potentially other provisions have distinct application and consequences. Confirm the cited law and tax period. Do not extend a rule for one provision to an unresolved or different provision without checking current law.
- Confusing the 30-day payment period with a reply deadline. The rule describes a specific qualifying payment route under sections 73(8) or 74(8), not a universal response period for every notice.
- Paying without checking what the payment resolves. Confirm the qualifying amount and effect under the applicable section and rule. The consequences differ by provision, and payment may significantly affect the matter.
- Confusing reply and appeal. DRC-06 is a reply route at the notice stage; APL-01 is identified for a section 107(1) appeal after an order.
- Using a general date without checking service or communication. The relevant date and applicable legal period depend on the stage and provision. Preserve proof of service or communication and verify the current rule.
- Failing to preserve filing evidence. Retain the communication date and portal acknowledgements as well as the filed documents and attachments.
- Assuming section 74A follows sections 73 or 74 automatically. Its operation, commencement and precise application must be checked against current authoritative materials for the relevant tax period and notice.
Frequently Asked Questions
What is the difference between a GST demand notice and a show-cause notice?
A show-cause notice proposes action or liability and gives you an opportunity to respond. “Demand notice” is used loosely and is not a reliable indicator that a final decision has been made. Check the full document, statutory provision, contents and stage. A DRC-01 is a summary of an SCN; an adjudication order is a separate document, commonly summarized in DRC-07.

Is DRC-01 a final GST demand order?
No. Rule 142 distinguishes the summary of a show-cause notice in DRC-01 from the summary of an adjudication order in DRC-07. Read the full notice and any later order rather than treating the DRC-01 summary alone as proof that liability has been finally adjudicated.
How do I reply to a GST show-cause notice?
For a covered notice whose summary has been uploaded in DRC-01, rule 142(4) provides for a reply in FORM GST DRC-06. Address the allegations point by point, explain the facts and calculations you dispute or accept, identify the legal basis for your position, attach relevant records and save the filing acknowledgement. Verify the route and current requirements for your particular proceeding.
What are DRC-03 and DRC-05 used for?
Rule 142 provides for payment intimation in FORM GST DRC-03. For a qualifying payment under section 73(8) or 74(8) made within 30 days after service of a notice under rule 142(1), the proper officer issues FORM GST DRC-05 to conclude proceedings in respect of that notice. The qualifying amounts and consequences differ by provision, so check the exact section and current law before paying.
Can I appeal a GST demand order?
If an adjudication order is adverse, section 107 generally allows an aggrieved person three months from communication of the decision or order to appeal to the Appellate Authority. The appeal rules identify FORM GST APL-01 for an appeal under section 107(1). Check current filing requirements, any applicable pre-deposit conditions and the actual communication date.
Do sections 73 and 74 have the same basis?
No. Section 73 concerns specified tax, refund or input tax credit demands for reasons other than fraud, wilful misstatement or suppression of facts to evade tax. Section 74 addresses corresponding demands where the stated basis is fraud, wilful misstatement or suppression of facts to evade tax. Read the provision and factual allegations in your notice; their conditions and consequences differ.
Can I use the sections 73 or 74 deadlines for a section 74A notice?
Do not assume that sections 73 or 74 deadlines or payment concessions apply. Check the current authoritative text, amendments, commencement notifications, relevant tax period and the notice itself. The current operation and exact application of section 74A are not established by the materials summarized here.
The Bottom Line
Do not judge a GST communication by the phrase “demand notice” alone. Confirm whether you have a proposed notice or an adjudication order, read the cited provision and full supporting material, and calendar the deadline that applies to that stage and tax period. A covered SCN may call for a DRC-06 reply; a qualifying payment route and a post-order appeal are separate options with their own conditions. Keep the notice, records, submissions and acknowledgements together, and get case-specific advice if the legal basis, amount or next step is unclear.
