The recommendation was made at the Council’s 57th meeting on October 8, 2026, but it is not, by itself, an operative tax exemption. The effective date depends on the implementing notification, circular, or legal amendment; no such instrument or start date was verified as of October 11, 2026.
What the GST Council recommended
The 57th GST Council recommended exempting “the services of passenger transportation by helicopter on seat-sharing basis from/to airports/helipads located in north-eastern states, Sikkim and Bagdogra in West Bengal.” The proposal is limited by both the kind of service and the stated locations:

- Service: passenger transportation by helicopter sold on a seat-sharing basis.
- Locations: an airport or helipad in a northeastern state, Sikkim, or Bagdogra, West Bengal, must be the origin or destination described in the recommendation.
The wording does not say that every helicopter journey passing through one of these regions qualifies. It refers to journeys from or to the specified airports or helipads.
Is the exemption already in force?
Not on the strength of the Council recommendation alone. The Ministry of Finance’s PIB release on the 57th meeting says recommendations are given effect through relevant circulars, notifications, or amendments to law, “which alone shall have the force of law.” As of October 11, 2026, no implementing instrument or effective date for this recommendation was verified. Until one is issued, the recommendation should not be treated as confirmation that an eligible fare is already GST-free.

For a booking or invoice, check the applicable government notification or circular and its effective date rather than relying only on the Council announcement. The announcement does not specify an estimated fare reduction or the number of routes or passengers that would be affected.
How the earlier GST treatment worked
Before the new recommendation, the official framework distinguished shared-seat helicopter transport from charter operations. In September 2024, the Council recommended a 5% GST rate for helicopter passenger transport on a seat-share basis and said helicopter charters would continue to attract 18% GST. The government subsequently implemented the 5% rate through Notification 07/2024-Central Tax (Rate), effective October 10, 2024, as described in Circular No. 234/28/2024-GST.

That circular also regularized the past-period treatment of seat-share services from July 1, 2017, through October 9, 2024, on an “as is where is” basis, and clarified the 18% treatment for charter operations. The 2026 recommendation proposes an exemption for its specified journeys; it does not itself establish that the earlier charter treatment has changed. Any change to the operative rates or classifications must be read in the implementing legal instrument.

The recommendation expressly concerns passenger transport on a seat-sharing basis, not a private charter. The 2024 circular states that helicopter passenger transport other than on a seat-share basis, including charter operations, attracts 18% GST under that framework. Whether a later instrument changes that treatment would depend on its wording and effective date.

How this differs from the earlier regional air-travel provision
In 2022, the Council said an existing exemption for air passenger transport to and from northeastern states and Bagdogra was being restricted to economy class. That history should not be read as a blanket regional exemption for helicopter journeys. The 2026 recommendation is specifically about helicopter passenger transportation on a seat-sharing basis, and its stated geography includes Sikkim.
