The GST Council recommended an optional 5% GST rate for passenger transport and motor-vehicle rental services supplied using an electric vehicle, provided the service includes an operator and the battery-charging cost is included in the consideration. The recommendation also specifies restricted input tax credit (ITC). It is a proposal about services—not a 5% rate on buying an electric vehicle—and the reviewed official material does not establish that the option has been notified or taken effect.
What the proposed 5% option covers
The Press Information Bureau’s account of the GST Council recommendation describes an option to pay GST at 5% on two types of services, subject to the stated conditions:

The Council’s wording is an option for suppliers, not a statement that every covered supplier must use the 5% rate. Rental with an operator is not the same as leasing
The recommendation covers rental services of motor vehicles with operators. The GST Council’s official record for its 53rd meeting distinguishes passenger transport and renting with an operator (SAC 9965/9966) from leasing without an operator (SAC 9973). Battery charging must be included in the consideration
The charging-cost condition is explicit: the cost of battery charging must be included in the consideration for the service. The recommendation does not explain how that amount must be itemized or establish eligibility where charging is excluded from the consideration. Do not assume the 5% option applies to a service that does not meet the stated condition.
Restricted input tax credit is part of the proposal
The recommended 5% option comes with restricted ITC. In other words, it should not be described as a 5% rate with unrestricted credits. The press release does not set out the restriction’s mechanics, so it does not support a detailed ITC calculation or a claim about which particular credits a supplier may claim.

This is not a tax rate on buying an EV
The recommendation concerns GST on passenger transport and operator-provided vehicle rental services. It does not announce a 5% GST rate on purchasing an electric vehicle or a charger. It also does not establish that passengers or renters will receive a fare or price reduction: the recommendation is about the tax treatment of a service, not a promised consumer saving.

Has the 5% option taken effect?
The official press release says the Council recommended providing this option. That wording alone does not establish legal commencement. The GST Council archive lists later meeting materials, including recommendations dated 3 September 2025, but the reviewed official sources do not verify whether or when this particular EV-service recommendation was notified. Accordingly, the 5% rate should be described as proposed or recommended unless the applicable tax notification and its commencement date are confirmed. A supplier considering the option needs to check the governing notification and its conditions rather than relying on the Council recommendation alone.
