GST Audit vs. Investigation: What Triggers Each and How They Differ

A GST audit is a records review that can be ordered without suspected fraud. Investigation-related powers have separate triggers and procedures under the CGST Act.

A GST audit under section 65 of India’s Central Goods and Services Tax Act (CGST Act) is a formal review of a registered person’s records and compliance. It can be ordered without the section 67 “reasons to believe” threshold that applies to specified inspection powers. “Investigation” is not one parallel statutory procedure: it commonly refers to fact-finding that may involve section 67 inspection, search or seizure, or a section 70 summons. These are distinct powers, with different triggers and processes; none, by itself, proves wrongdoing or creates a final tax demand.

The practical first question is therefore not simply whether a communication uses the word “audit” or “investigation,” but which section and action it identifies. An ADT-01 audit notice, a section 67 authorization, a section 70 summons and a section 66 special-audit direction call for different responses and have different legal conditions.

At a glance: audit and investigation are different processes

The most useful legal comparison is between a section 65 audit and the powers commonly described as a GST investigation: section 67 inspection, search and seizure, and section 70 inquiry summons. Section 66 special audit is a separate route. The CGST Act places these provisions in different statutory chapters, and each has its own conditions.

Question Section 65 audit Investigation-related powers
Where is it in the CGST Act? Chapter XIII, section 65 Chapter XIV, including sections 67 and 70
What starts it? The Commissioner or an officer authorized by the Commissioner may order an audit of a registered person. Section 65 does not set section 67’s reasons-to-believe threshold as a condition. Section 67 inspection requires specified grounds and a proper officer’s reasons to believe they exist. Search and seizure have a separate statutory condition. Section 70 summons may be issued when attendance or material is considered necessary in an inquiry.
What is examined? Records and compliance, including turnover, tax paid, exemptions and deductions, applicable rates, input tax credit (ITC), and refunds. Suspected evasion and evidence: for example, relevant places, goods, books or documents, or information obtained from a person in an inquiry.
What process is specified? At least 15 working days’ advance notice; a usual three-month completion period, with a possible extension of up to six months; findings and reasons communicated after conclusion. The process depends on the particular power used. The section 65 audit notice and timing rules do not apply to every investigation-related action.
Does it itself establish a tax liability? No. Audit findings may lead to further proceedings under the applicable demand provisions. No. Inspection, search, seizure or summons are fact-finding or enforcement steps; any demand or other consequence requires the relevant further statutory process.

This comparison is for Indian central GST under the CGST Act. State and Union Territory GST laws generally have corresponding provisions, but the applicable law, officer, jurisdiction and document should be checked for the case at hand.

The distinctions matter because an ordinary audit is a review of a registered person’s records, while section 67 powers are tied to specified suspected conduct or evidence being secreted. A summons is different again: it seeks a person’s attendance or material for an inquiry. The word “investigation” is often used as an umbrella, not as a single statutory notice with one uniform trigger.

Can GST officers audit a business without suspecting fraud?

Yes. Section 65 authorizes the Commissioner, or an officer authorized by the Commissioner through a general or specific order, to audit a registered person for a period, at a frequency and in a manner prescribed. The section does not make a suspicion of fraud or the section 67 reasons-to-believe test a prerequisite for selecting a registered person for audit.

An audit is intended to verify whether the taxpayer’s declarations and payments align with its books and supporting records. It may cover turnover, tax paid, exemptions or deductions, the rates applied, ITC availed and utilized, refunds, and other relevant issues. Selection for audit is therefore not, on its own, a finding that the taxpayer evaded tax.

The audit may take place at the registered person’s place of business or at the tax office. The Rules provide for notice in Form GST ADT-01. Section 65 requires that notice be given at least 15 working days before the audit is conducted.

That advance-notice rule belongs to the section 65 audit framework. It should not be treated as a universal notice period for an inspection, search, seizure or inquiry summons. The legal basis and applicable process depend on the particular power invoked.

What triggers a GST investigation?

There is no single CGST Act section titled “GST investigation” that sets one trigger for every investigative action. The term is often used administratively for fact-finding into suspected non-compliance. To understand the legal basis, identify the specific section and power named in the notice or authorization.

In particular, an audit selection and a section 67 inspection do not begin from the same statutory test. Section 65 permits an audit under a general or specific order, whereas section 67(1) requires a proper officer’s reasons to believe that specified circumstances exist. Section 67(2) has its own condition for search and seizure. Section 70 addresses summons in an inquiry, rather than automatically authorizing a search or deciding a tax demand.

Section 67 inspection

For inspection under section 67(1), a proper officer not below the rank of Joint Commissioner must have reasons to believe that one of the specified circumstances exists. These include a taxable person suppressing a transaction relating to supply or stock, claiming excess ITC, or contravening the Act or Rules to evade tax. The provision also covers specified goods held by a transporter, warehouse or godown operator, or another person, where tax has escaped or record-keeping is likely to cause evasion. The officer may authorize another central-tax officer in writing to inspect relevant places.

In other words, section 67 inspection is tied to specified suspected conduct and an officer’s statutory reasons to believe—not simply the fact that a business has been chosen for an ordinary audit. The reasons-to-believe requirement is a legal condition; the existence of an inspection authorization is not itself a final decision that the suspected conduct occurred.

The statutory list is not simply a general power to inspect any business for any reason. It links the inspection to alleged suppression, excess credit, contravention to evade tax, or the specified goods and record-keeping circumstances. Readers should distinguish the stated basis for an authorization from a final conclusion: the former permits an investigative step if the statutory conditions are met, while the latter would require a later process.

Section 67 search and seizure

Search and seizure are not automatic consequences of an audit, an inspection or a discrepancy. Under section 67(2), the proper officer must meet the same minimum rank threshold and have reasons to believe that goods liable to confiscation, or books, documents or things useful or relevant to proceedings, are secreted in a place. The statutory condition for search and seizure is distinct from the condition for inspection.

The Act also governs how seized documents may be retained: retention is limited to what is necessary for examination or inquiry or proceedings, and material not relied upon is subject to statutory return provisions following notice. The precise application depends on the facts and the current statute. A person facing a search or seizure should read the authorization and records carefully and get advice on the specific action rather than assume that audit procedures apply.

This is why a discrepancy raised during an audit should not be described as automatically producing a search or seizure. Those measures have their own statutory threshold and concern relevant goods or material believed to be secreted at a place. The existence of one process does not erase the conditions attached to another.

Section 70 inquiry summons

Section 70 empowers a proper officer to summon a person whose attendance is considered necessary to give evidence or produce a document or other thing in an inquiry. A summons is a procedural demand for attendance or material. It is not, by itself, a search authorization, a concluded finding of evasion, or a final tax demand.

The CGST Act states that an inquiry under section 70 is deemed to be a judicial proceeding for specified provisions of the Penal Code. That makes a summons a serious formal process: the recipient should identify what is requested, the issuing authority and the stated date or deadline, and respond appropriately. It does not mean that receiving a summons establishes liability.

CBIC’s circular index lists summons guidance under section 70 dated 17 August 2022. The practical point remains to read the particular summons rather than assume that it is an audit notice or that it carries section 65’s 15-working-day advance notice rule. A summons concerns attendance or production of material in an inquiry; the statutory authority and requested action should be clear from the document.

What to expect after a section 65 audit notice

The audit process has defined notice, examination and findings stages. The exact records requested and the practical steps will depend on the period and issues being audited.

  1. Check the notice. Confirm that the document is an audit notice, identify the issuing authority, the period covered and the records or information requested. The Rules prescribe Form GST ADT-01. Do not confuse it with an inspection or search authorization, a summons, or a special-audit direction.
  2. Prepare the records relevant to the review. The authorized officer may examine records supporting books, returns and statements, turnover, exemptions and deductions, applicable tax rates, ITC availed and utilized, refunds, and other relevant issues. Organize the requested material by period and issue so that the figures in returns can be reconciled to the underlying records.
  3. Make the records available and track commencement. Section 65’s completion period ordinarily runs for three months from commencement. For this purpose, commencement is the later of the date the called-for records are made available or the date the audit is actually instituted at the place of business.
  4. Review discrepancies and provide a response. The officer may communicate discrepancies. The registered person may reply, and the officer finalizes findings after considering that reply. Keep a record of the material supplied and the explanations made.
  5. Read the findings and reasons. On conclusion, the proper officer must inform the registered person of the findings, rights and obligations, and reasons within 30 days. The Rules provide for communication of the audit findings in Form GST ADT-02.

The Commissioner may extend the ordinary three-month completion period by up to a further six months, but the reasons for extension must be recorded in writing. These are section 65 audit time limits; they should not be assumed to govern an inquiry, inspection, search or other investigation activity.

The timing has two separate reference points. First, the notice must precede the audit by at least 15 working days. Second, the three-month audit period begins at “commencement,” which is the later of making the called-for records available and the actual institution of the audit at the place of business. These rules are not interchangeable: the advance notice rule does not itself set the audit’s completion date.

After the officer communicates a discrepancy, the person may provide a reply for consideration before findings are finalized. The audit’s concluding communication should state findings, rights and obligations, and reasons; Form GST ADT-02 is the prescribed findings form in the Rules. If findings identify unpaid or short-paid tax, an erroneous refund or wrongly availed or utilized ITC, any further demand action is a distinct legal step under the relevant provisions.

What can happen after an audit or investigation?

An audit finding is not automatically an adjudicated tax liability. If the audit identifies tax unpaid or short-paid, an erroneous refund, or ITC wrongly availed or utilized, the proper officer may initiate action under the applicable demand provisions. That is a further statutory step, not simply another name for the audit conclusion.

Likewise, evidence gathered through inspection, search, seizure or an inquiry summons does not itself resolve whether a tax demand is due. A demand, adjudication or prosecution requires the relevant further process under the law. The document received and the action it authorizes matter more than the broad label “investigation.”

A discrepancy, request for records, summons or investigation selection should therefore be treated as a procedural event, not as proof of guilt. The taxpayer’s opportunity to respond and the legal basis and process for any later action remain important.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

It is useful to separate three questions when reading an outcome: what did the officer examine or collect; what findings or material were communicated; and whether a further statutory proceeding has actually been initiated. A factual inquiry can produce material that informs a later step, but the inquiry itself is not the same as that later step. In the same way, audit findings may point to a possible discrepancy without themselves constituting the final determination of a demand.

How section 66 special audit differs

Section 66 is a third route, not another name for an ordinary section 65 audit or for a section 67 search. It allows a special audit to be directed at a stage of scrutiny, inquiry, investigation or other proceedings when the statutory conditions are met.

An officer not below Assistant Commissioner rank must form the prescribed opinion that the value has not been correctly declared or that the ITC availed is outside normal limits, taking account of the case’s complexity and the revenue interest. Prior approval from the Commissioner is required. The nominated chartered accountant or cost accountant generally has 90 days to submit a report; the period may be extended by up to a further 90 days.

The registered person must have an opportunity to be heard concerning material proposed to be used against them. The Commissioner determines and pays the expenses of examination and audit. Because a special audit can be ordered within other proceedings, its presence does not change the statutory trigger for the proceeding in which it occurs.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Special audit is therefore different both in who carries out the examination and why it may be ordered. The accountant is nominated by the Commissioner, and the officer’s statutory opinion must concern incorrectly declared value or credit outside normal limits in light of complexity and revenue interest. It is not simply a more intensive version of every section 65 audit, nor does it by itself decide liability.

How to identify which GST process you are facing

Start with the exact document rather than assuming that every request from a tax authority is an audit or investigation. Check the issuing officer and authority, the section cited, the prescribed form if applicable, the period or subject matter, and what the document directs you to do.

  • Form GST ADT-01 or a section 65 audit notice: an audit of records and compliance, with the advance-notice and timing framework described above.
  • Section 67 inspection or search authorization: an enforcement power based on statutory conditions; inspection and search or seizure are distinct actions.
  • Section 70 summons: a requirement to attend or produce evidence or material in an inquiry.
  • Section 66 direction: a special audit by a nominated chartered accountant or cost accountant, subject to its approval, opinion and hearing requirements.

For a real notice, verify the applicable central, state or Union Territory law, the officer’s authority, the requested material and every stated deadline. A qualified GST professional can assess the document and the facts; this article is general information, not advice on an individual proceeding.

A practical checklist is to preserve the complete communication and any authorization, note the section and form cited, identify the period and material requested, and mark the date or deadline stated in the document. Then distinguish what it asks you to do from what it does not decide. A request to produce records is not necessarily a concluded demand, and a summons is not the same instrument as a search authorization. Verify jurisdiction as well: the CGST Act governs central GST, while corresponding State and Union Territory laws may apply to the particular officer and proceeding.

Sources and scope

The statutory framework described here is drawn from the CGST Act published by the Central Board of Indirect Taxes and Customs (CBIC), particularly sections 65–70, and CBIC’s Assessment-Audit Rules on audit notice, verification, discrepancy responses and findings forms. CBIC’s circular index lists summons guidance under section 70 dated 17 August 2022. State and Union Territory provisions generally correspond, but readers should verify the law and jurisdiction applicable to their case.

Frequently Asked Questions

Is a GST audit the same as a GST inspection?

No. A section 65 audit is a formal review of records and compliance and requires at least 15 working days’ advance notice. Section 67 inspection is a different power tied to specified circumstances and a proper officer’s reasons to believe those circumstances exist. Search and seizure under section 67(2) have a separate statutory condition.

Can GST officers audit my business without suspecting fraud?

Yes. Section 65 allows the Commissioner or an authorized officer to audit a registered person by general or specific order. The section does not require the section 67 reasons-to-believe threshold as a condition for audit selection.

What should I expect after an ADT-01 audit notice?

Check the authority, period and requested records; Form GST ADT-01 is the prescribed audit notice. The officer may examine records supporting books, returns, turnover, exemptions and deductions, tax rates, ITC, refunds and other relevant issues. The person may respond to communicated discrepancies, and the officer communicates findings, rights, obligations and reasons in Form GST ADT-02 within 30 days of conclusion.

Does a section 70 summons mean GST has found tax evasion?

No. A summons seeks a person’s attendance or documents or other material in an inquiry. The CGST Act treats a section 70 inquiry as a judicial proceeding for specified Penal Code provisions, so a summons is a serious formal process, but it is not itself a finding of evasion or a final tax demand.

How long can a section 65 GST audit take?

It is ordinarily to be completed within three months from commencement. The Commissioner may extend that period by up to six months for reasons recorded in writing. Commencement is the later of making the called-for records available or the audit’s actual institution at the place of business. Findings, rights and obligations, and reasons are due within 30 days after conclusion.

Can an audit discrepancy automatically lead to a search or seizure?

No. Search and seizure are not automatic consequences of an audit discrepancy. Section 67(2) has its own conditions, including a proper officer’s reasons to believe that relevant goods or books, documents or things are secreted at a place.

The Bottom Line

Bottom line: A section 65 GST audit is a notified review of records that can be ordered without suspected fraud. “Investigation” may refer to different powers: section 67 inspection and search or seizure have specified statutory triggers, while section 70 summons seeks evidence or material in an inquiry. Identify the exact section and document, follow its applicable process, and do not treat a notice or inquiry as a final finding of liability.
