Não há, nas fontes consultadas, registro de que Gotye tenha sido condenado por plágio ou obrigado por um tribunal a pagar US$ 1 milhão. A notícia de maio de 2013 tratava de royalties que já teriam acumulado esse valor segundo estimativas da época: um acordo de autorização do sample de “Seville”, de Luiz Bonfá, destinava 45% dos royalties à família do músico.
O que significava a notícia dos US$ 1 milhão?
O valor foi noticiado como royalties acumulados, não como multa nem indenização fixada em sentença. A NOS informou em 16 de maio de 2013 que a família de Luiz Bonfá tinha direito a 45% dos royalties conforme o acordo. A reportagem da 20 Minutes, também publicada naquele dia, qualificou o milhão como uma estimativa do Sunday Telegraph baseada nas vendas e observou que ela não incluía streaming nem execuções em rádio. Portanto, trata-se de um total reportado e estimado até maio de 2013, não de uma quantia auditada ou de uma ordem judicial.
As reportagens disponíveis não documentam processo ou decisão judicial que tenha declarado plágio ou condenado Gotye a pagar esse montante. Também não sustentam afirmar que os herdeiros processaram o cantor. A formulação mais precisa é que o uso do sample foi autorizado e gerou participação em royalties prevista em acordo.
Que música brasileira foi usada na faixa?
“Somebody That I Used to Know”, de Gotye com Kimbra, contém um sample de “Seville”, gravação instrumental de Luiz Bonfá. A Billboard descreveu o riff de violão de Bonfá como sampleado na canção. O UOL identificou “Seville” como uma gravação lançada em 1967.

O sample também teve papel criativo na composição. Em entrevista à Billboard, Gotye disse: “That Luiz Bonfá sample directly prompted the first line of lyrics.” Em português: “Aquele sample de Luiz Bonfá provocou diretamente o primeiro verso da letra.”
Por que “plágio” não descreve bem o caso?
“Plágio” aparece em manchetes como atalho para falar de uma obra que incorpora música de outra pessoa, mas isso não demonstra, por si só, que houve uma disputa judicial ou apropriação sem autorização. Neste caso, a NOS informou que havia um acordo com a família de Bonfá desde o início e que os créditos da faixa identificavam o sample como autorizado. A participação de 45% nos royalties era parte desse acordo, segundo a reportagem.
