Gifting Grain: How It Works and What Farmers Should Know

Gifting grain transfers ownership of unsold crop rather than sale proceeds. The recipient, timing, crop expenses, and documentation all affect the tax analysis.

Gifting grain means transferring ownership of unsold grain—not simply selling it and giving the proceeds—to a child or charitable organization. For a U.S. farmer, the tax result depends on who receives it, when it was produced and transferred, how the farm reports income, and whether the recipient truly controls the grain. A transfer is not a guaranteed tax saving, and the rules for a charity are not the same as those for a child.

What does gifting grain mean?

In a grain gift, the recipient becomes the owner of grain that has not already been sold or committed for sale. A charitable-transfer guide from University of Illinois farmdoc says the gift should come from unsold crop inventory with no prior sale commitment, and that the organization should decide what to do with the grain and when to sell it. That distinction matters: merely directing a buyer or elevator to send sale proceeds to someone else is not necessarily a transfer of the grain itself.

The tax context is especially relevant for cash-method farmers. The IRS says income generally includes amounts actually or constructively received; income can be constructively received when it is credited to an account or otherwise available without restriction. See IRS Publication 225 (2025), Farmer’s Tax Guide. Grain that has already been sold, or whose proceeds are already available to the farmer, should not be treated as though ownership of unsold grain were transferred.

How does a charitable grain gift work?

A charitable gift requires the organization to accept the grain and become its owner. The charity—not the farmer—should control the decision to sell it. The University of Illinois farmdoc guide describes this as a gift of unsold crop inventory, with no sale commitment made beforehand.

  1. Ask the charity first. Confirm that it accepts grain gifts, which crops and delivery arrangements it can handle, and what written forms or acknowledgments it requires.
  2. Coordinate with the elevator or cooperative. Check that it can document the transfer and record the charity as owner. Confirm the account, delivery, storage, fees and paperwork before grain is moved or assigned.
  3. Transfer grain that remains unsold. Avoid making a prior sale commitment. The transfer should be of the grain itself, rather than a direction to pay sale proceeds to the organization.
  4. Put ownership and control in the charity’s hands. The charity should decide whether and when to sell and bear ownership-related costs, consistent with the arrangement described by University of Illinois farmdoc.
  5. Keep the records. Retain the transfer letter, delivery or ownership documentation, and the charity’s acknowledgment. Ask the charity and elevator what records they will provide.

Procedures are organization-specific. The FarmHouse Foundation’s historical example describes contacting the foundation, establishing an elevator account, delivering grain, and having a warehouse receipt identify the foundation as owner and seller; it is an illustration, not a universal process. The FarmHouse Foundation 2016–17 Year in Review explains that example. A current recipient’s description, such as the Fremont Area Community Foundation’s Gifts of Grain page, should be confirmed directly with that organization.

Can a farmer gift grain to a child?

Potentially, but a family transfer is not simply the charitable procedure with a different recipient. Who reports income, the crop’s production year, the transfer date, the farm’s accounting method, and the allocation of crop expenses can all affect the result. Kiddie-tax rules may also apply to a child’s income.

Timing is important. University of Minnesota Extension’s older Estate Planning Series explains that a same-year gift of grain produced that year can require reducing Schedule F expenses associated with that crop. Because that material is older, it is background rather than a substitute for current tax guidance or advice based on the farm’s records. Ask a tax professional familiar with farm returns to review the crop year, expenses, recipient, and reporting before making the transfer.

What are the possible tax effects?

There is no universal tax outcome. A properly completed transfer may affect whether the farmer recognizes income from a grain sale, but it does not automatically create a charitable deduction, and it does not make every gift tax-free. The Fremont Area Community Foundation notes that a donor may not qualify for a charitable deduction even where the donor may avoid recognizing the grain sale as taxable income. That is an organization’s explanation, not a determination of any particular donor’s tax treatment.

The IRS’s cash-method rules make the difference between transferring grain and redirecting proceeds consequential. The IRS also discusses crop-share income that can be treated as converted to money when gifted, including when the recipient is charitable. Crop shares are distinct from a transfer of grain inventory, so the crop-share discussion should not be applied automatically to a grain gift. Review the relevant distinctions in Publication 225 with a qualified tax adviser.

University of Minnesota Extension educator David Bau made a related point in a November 26, 2024, Successful Farming interview: gifting grain from a prior crop year may avoid the same-year expense-allocation issue he described. Treat that as an explanation of the timing concern, not as a guaranteed savings rule. The extension material also includes an older self-employment-tax figure; it should not be used as a current rate or a promised benefit.

How to decide whether a grain gift fits

Before choosing between a grain transfer and selling the grain and gifting cash, work through the factors that can change the mechanics and tax treatment:

  • Recipient: Is the recipient a qualified charitable organization or a child? The rules and records are different.
  • Sale status: Is the grain still unsold and free of a prior sale commitment?
  • Crop year and transfer date: Was the grain produced in the same year it will be gifted, and when will ownership transfer?
  • Accounting method: Does the farmer use cash or accrual accounting? The IRS discussion cited here addresses cash-method income recognition.
  • Control after transfer: Will the recipient genuinely own the grain and decide when to sell it?
  • Acceptance and documentation: Can the charity or child’s arrangement and the elevator’s records clearly establish the transfer?

These are decision factors, not a ranking of grain gifts over cash gifts. State rules, recipient policies, elevator procedures, and farm-program reporting may also matter. Confirm the transfer mechanics with the recipient and elevator, and have a qualified tax adviser evaluate the federal and state consequences using the farm’s specific facts.
