A GameStop investor filed a proposed class-action lawsuit accusing Roaring Kitty, the online name of Keith Gill, of a pump-and-dump scheme tied to his social-media posts and trading activity. The investor, Martin Radev, voluntarily withdrew the case three days later, on July 1, 2024. The dismissal was without prejudice; it did not decide whether the allegations were true.
What happened to the lawsuit against Keith Gill?
Radev filed the proposed class action on June 28, 2024, in federal court in Brooklyn, naming Gill as the defendant. On July 1, Radev voluntarily dismissed it. Reuters reported that the withdrawal was without explanation and that the lawsuit could be refiled.

What did the complaint allege?
The complaint alleged that Gill’s May and June 2024 posts, together with his GameStop trading activity, misled investors as part of a pump-and-dump scheme. It claimed investors suffered losses. Those were the plaintiff’s allegations, not findings by a judge; the filing itself did not establish that Gill manipulated the market or that investors’ losses were caused by his actions.

Reuters quoted the complaint as saying: “Defendant still enjoys celebrity status and commands a following of millions through his social media accounts.” That is language from the complaint, not a court’s conclusion.
How the posts and trading disclosures fit into the timeline
The complaint arose amid a sharp move in GameStop shares and public attention to Gill’s posts and disclosed positions. Reuters reported the following sequence:

- June 2, 2024: Gill’s Reddit post disclosed a position Reuters described as five million GameStop shares and 120,000 call options.
- June 13, 2024: Reuters reported that Gill disclosed he had shed the call options and held nine million GameStop shares.
- June 28, 2024: Radev filed the proposed class action in the Eastern District of New York.
- July 1, 2024: Radev voluntarily dismissed the case.
The share-price and position details above are reports by Reuters in 2024, not findings that a court verified the underlying trading records. The complaint’s theory was that the posts and trading activity misled investors; the timing alone does not establish that claim.
What “dismissed without prejudice” means
A voluntary dismissal without prejudice generally leaves open the possibility of bringing the claim again, subject to applicable legal rules and deadlines. It is different from a ruling on the merits: the court did not determine through this dismissal whether Gill engaged in a pump-and-dump scheme, whether the complaint’s allegations were true, or whether Radev or other investors were entitled to recover money.

A 2025 University of Chicago Legal Forum article likewise noted that no legal ruling determined that Gill engaged in market manipulation in the 2024 events: University of Chicago Legal Forum.

Reuters reported that the dismissal came without explanation, and the reviewed reporting provides no independent statement from Radev or Gill explaining it. There is no basis here to infer a settlement or a particular legal strategy.
