FTC Case Against Dave: Alleged Misleading Cash-Advance Marketing and Fees

The FTC alleges Dave’s cash-advance advertising and disclosures misled consumers about advance amounts, delivery fees, tips and a monthly membership. Here’s what the case says and where it stands.

The Federal Trade Commission alleges that Dave, Inc. promoted cash advances of “up to $500” while many users received much less or no offer, and that important costs—including an instant-delivery fee—were not clearly disclosed. The case also concerns tips and a monthly membership fee. These are allegations, not findings of liability; the latest cited FTC report says a judge denied the defendants’ motion to dismiss, a procedural step that does not decide whether the claims are true.

What the FTC says Dave advertised

Dave is often described as a neobank, but the FTC’s case materials characterize the company as an online cash-advance firm and a finance mobile app offering short-term advances. The enforcement case centers on how those advances and related charges were presented to consumers.

In its November 5, 2024 announcement, the FTC alleged that Dave prominently advertised advances of “up to $500” and instant access, although many users allegedly received much smaller offers or no offer. The agency also said instant delivery required paying an Express Fee; users who did not pay it allegedly waited two to three business days. The FTC’s announcement describes the allegations.

What fees did the FTC say Dave failed to disclose?

The FTC complaint addressed three kinds of charges or payment prompts. The agency’s claims describe the company’s practices at issue in the case; they should not be read as a statement about every user’s experience or Dave’s current terms.

Charge or payment What the FTC alleged
Express Fee The fee allegedly ranged from $3 to $25 for instant delivery. The FTC said it was disclosed only after sign-up and access to a user’s bank account; without it, users allegedly waited two to three business days. [FTC, November 5, 2024]
Tips The complaint alleged that many users did not knowingly authorize tips, and that the app’s presentation could lead users to believe a tip would fund a corresponding number of meals for children. The FTC said Dave donated 10 cents for each percentage point in the selected tip and kept the remainder; the donation did not cover the cost of providing an actual meal. [FTC, November 5, 2024]
Monthly membership The FTC alleged that the $1 monthly membership fee was not clearly disclosed and was difficult to cancel. [FTC, November 5, 2024]

The FTC’s November 2024 release quoted Bureau of Consumer Protection Director Samuel Levine: “Dave lured in consumers living paycheck-to-paycheck with false claims of big-dollar advances, then reached into their pockets to give itself a so-called ‘tip.’” That is the agency director’s characterization of the allegations, not a court finding.

What the reported tip revenue figure means

The FTC said Dave’s SEC filings reported more than $149 million in tip revenue from 2022 through just the first six months of 2024. This is a figure the FTC attributed to Dave’s filings; it is not a finding that a court made about wrongdoing or liability. The FTC’s December 2024 referral announcement also discusses the case.

Dave case timeline and current status

  1. November 5, 2024: The FTC announced and filed its initial complaint against Dave, Inc. in the U.S. District Court for the Central District of California. The case page identifies the matter as FTC v. Dave, Inc., case 232-3103; that page was last updated December 30, 2024.
  2. December 30, 2024: After the FTC referred the case to the Department of Justice, the United States filed an amended complaint naming Dave CEO Jason Wilk and seeking civil penalties. The FTC described the referral and amended complaint.
  3. September 12, 2025: The FTC’s December 2025 Semiannual Federal Court Litigation Status Report says the court denied the defendants’ motion to dismiss. A denial means the case was not dismissed at that stage; it does not establish that the allegations are true or that Dave or Wilk is liable. See the FTC’s December 2025 litigation report.

The FTC case page still labels the matter “Pending,” but its stated last update is December 30, 2024. The later December 2025 litigation report is the more current primary source cited here. These sources do not establish a settlement or final liability ruling, and they may not reflect any docket activity after the report.
