Freelance Background Checks: What Gig Workers Should Know

Gig-work screening varies by platform. Learn what US FCRA procedures may require, what Uber discloses about its checks, and what to do about a report error.

A freelance or gig-work background check is not one universal process: it depends on the platform or client, the screening company, and the records available where you live. In the United States, when a business obtains a background report from a company that compiles consumer reports, federal Fair Credit Reporting Act (FCRA) procedures may apply. If a platform uses such a report to make an adverse decision, workers may have rights to notice and an opportunity to review or dispute the report.

What happens in a freelance background check?

The client or platform may ask a screening company to prepare a report using records relevant to its decision. The categories, timing, provider, and review process vary; there is no single procedure established for freelance work or all gig apps.

One documented example is Uber’s US driver screening. Uber says it checks drivers before their first trip and at least annually, and uses ongoing technology to identify new criminal charges or convictions. It describes motor vehicle and criminal-history screening, while noting that record availability varies by location. These are Uber’s statements about its own process, not an industry-wide standard. Uber’s help page says Checkr conducts the check, requires the driver’s consent, and does not perform a credit check. Uber says the report can take up to seven business days, with additional time possible for Uber’s review. Its page also says the check is free. These details are specific to Uber and can change, so confirm the current guidance on Uber’s background-check help page.

What notice and rights apply in the United States?

Under Federal Trade Commission (FTC) guidance, when an employer uses a company that compiles background reports, FCRA procedures apply. The FTC describes written disclosure and permission before the report is obtained. If the employer is considering an adverse decision based on the report, it must provide the person a copy of the report and a Summary of Rights before taking that action. Federal nondiscrimination laws also apply to employment decisions using background information, and state or local law may add requirements. See the FTC’s employer guidance on consumer reports.

Gig workers can also have FCRA protections when a platform uses a background screening or another consumer report to take an adverse action, including through an algorithm. The key question is whether the platform relied on a consumer report: a deactivation by itself does not establish that it did. The FTC’s policy statement on gig companies and the FCRA explains that workers are entitled to know when a platform uses such a report for an adverse action.

These are general federal guidelines, not a determination that every platform relationship is legally classified as employment or that every decision follows the same process. State and municipal requirements can differ; the FTC advises employers to check applicable local rules.

Can a gig app deactivate you because of a background check?

A platform may take an adverse action based on a consumer report, but the available evidence does not establish one common set of eligibility rules or appeal steps across gig apps. If a platform’s decision appears to involve a report, ask whether a consumer reporting company supplied information and how to obtain the report and any notices. When FCRA procedures apply, the report and Summary of Rights should be provided before an adverse decision based on it.

Do not assume that every deactivation is a background-check decision. A platform can act for other reasons, and a decision made through an algorithm can still raise FCRA protections if a consumer report was used. Uber’s process is an example of one company’s disclosed screening practice, not a reliable guide to Lyft or other platforms; equivalent current procedures for those services are not established here.

What to do if your background check has a mistake

  1. Request the report and notice. If a platform or client says a consumer report affected its decision, ask for a copy of the report and the applicable Summary of Rights. For an employment decision covered by FTC guidance, those materials are due before the adverse action.
  2. Review each item carefully. Check names, dates, locations, case outcomes, and whether the report has mixed your information with someone else’s. Note the specific entry you believe is inaccurate or incomplete.
  3. Contact the reporting company to dispute it. Identify the entry and provide relevant supporting documents. Keep copies of your dispute and any response. The FTC’s consumer-report guidance for employers describes the role of reporting companies and the FCRA process; follow the dispute instructions supplied with your report.
  4. Tell the platform or client about the dispute. Ask how the review affects your account or application while the information is being checked, and request the company’s current review or appeal instructions. The process is platform-specific.
  5. Check rules where you live. State and local laws may provide additional protections or procedures. The FTC’s federal guidance is not a substitute for checking the rules that apply to your location.

What this means before you apply

  • Look for the platform’s current screening explanation, including the provider, consent process, categories checked, and how to access or dispute a report.
  • Save notices and copies of any report you receive so you can identify a disputed entry precisely.
  • Treat timing estimates as company-specific. For example, Uber’s stated report timeline is up to seven business days, and it says its own review may take additional time.
  • If a decision is unexplained, ask whether it was based on a consumer report rather than assuming that it was.
