Fisker’s $14,000-Per-Ocean Bankruptcy Sale Was a Bulk Fleet Deal, Not a Retail Bargain

Fisker’s reported $14,000-per-Ocean sale was a court-approved bulk fleet transaction with American Lease, not a retail offer. The 3,231 vehicles had tiered prices, mixed conditions, recall holds and limited manufacturer support.

Short answer: No, Fisker was not offering ordinary car shoppers a new Ocean SUV for $14,000. Fisker asked the U.S. Bankruptcy Court for the District of Delaware to approve the bulk sale of up to 3,231 completed Fisker Ocean electric SUVs to New York leasing company American Lease for a maximum of $46.25 million. The court approved the transaction on July 17, 2024.

The frequently reported “$14,000 each” figure is an approximate blended calculation: $46.25 million divided by 3,231 vehicles equals about $14,314 per vehicle. The contract itself used different prices based on condition and title status, including $16,500 for certain vehicles in reasonably good working order, $3,200 for previously titled vehicles, and at least $2,500 for damaged vehicles.

As an Amazon Associate I earn from qualifying purchases.

That distinction matters for EV shoppers, Fisker Ocean owners, creditors and anyone evaluating distressed-vehicle bargains. This was a court-supervised fleet transaction involving mixed-condition inventory, recall obligations, software dependencies and limited manufacturer support—not a public retail promotion.

What Fisker asked the bankruptcy court to approve

Fisker and its affiliates filed a motion on July 2, 2024, asking the Delaware bankruptcy court to authorize a fleet sales agreement with American Lease LLC. The proposed order would allow Fisker to:

  • Sell substantially all of its remaining completed U.S.- and Canada-configured Ocean inventory to American Lease;
  • Transfer the vehicles free and clear of liens, claims, encumbrances and other interests under the court order;
  • Perform the related fleet agreement and arrange delivery; and
  • Complete the transaction quickly enough to fund payroll, taxes, software-provider costs, recall work and other expenses of winding down the Chapter 11 case.

Fisker had filed for Chapter 11 protection in Delaware on June 17 and June 19, 2024, for the company and related affiliates. By the time of the sale motion, production had stopped and Fisker needed cash. The company said an initial batch of roughly 200 vehicles could generate about $2.8 million for immediate expenses. Fisker reported approximately 179 employees during the early July sale process and planned additional reductions.

The original motion and its exhibits are available in the Fisker bankruptcy court filing.

How many Ocean SUVs were involved?

The authoritative figure in the filed fleet-sales agreement and related exhibits is 3,231 vehicles:

  • 3,052 U.S.-configured vehicles;
  • 179 Canada-configured vehicles; and
  • 3,231 total.

Some contemporaneous news reports, including an initial Reuters account, cited 3,321 vehicles. That appears to have been a transposition or reporting error. The court agreement and pricing materials repeatedly identify the fleet as 3,231 vehicles. The filed exhibit showing the U.S., Canadian and total counts is available here.

The inventory was not necessarily a uniform group of brand-new cars sitting in one warehouse. Court materials described vehicles in different locations and stages, including dealer lots, ports, factory-held inventory, engineering vehicles, previously titled vehicles and damaged vehicles. Some vehicles were in the United States and Canada, while others were associated with locations including Austria and Belgium.

The actual pricing schedule

The agreement did not set a $14,000 price for every Ocean. It established separate categories:

Vehicle category Contract price
Vehicle with a manufacturer’s certificate of origin, in reasonably good working order $16,500
Previously titled vehicle $3,200
Damaged vehicle requiring repairs estimated at more than $5,000 At least $2,500
Maximum transaction $46.25 million for up to 3,231 vehicles

Dividing the maximum purchase price by the maximum vehicle count produces the headline figure:

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

$46,250,000 ÷ 3,231 = approximately $14,314 per vehicle.

That is an approximate maximum blended price—not a uniform unit price and not a guaranteed average for the vehicles ultimately delivered. The actual average could vary depending on how many vehicles qualified for each pricing tier and how many were ultimately transferred. One filed reference schedule also showed an illustrative gross amount of approximately $46.277 million, but the agreement’s contractual cap was $46.25 million.

Why was Fisker selling the vehicles so cheaply?

The discount reflected a distressed bulk sale, not a normal comparison with the price of a fully supported retail vehicle.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Fisker had stopped production, accumulated unsold inventory and filed Chapter 11 after earlier efforts failed to resolve its liquidity problems. The company had also:

  • Shifted from an earlier direct-to-consumer strategy toward a dealer-partner model;
  • Cut retail prices deeply without generating enough cash or demand;
  • Encountered logistics, delivery and inventory-location problems; and
  • Struggled to find a buyer willing to accept vehicles without ordinary manufacturer warranty, repair and maintenance commitments.

Fisker told the court that delay could leave it unable to pay vital expenses such as payroll, taxes, software-provider bills and recall-related costs. Electric vehicles can also lose value quickly when production, software support and parts availability are uncertain. A fleet buyer able to take many vehicles at once was therefore more valuable to the bankruptcy estate than waiting for a slower retail liquidation.

Who was American Lease?

American Lease LLC is a New York-based vehicle-leasing company that provides cars to rideshare and for-hire drivers in the New York City area. Its interest in the Ocean was tied to New York City’s requirement that the rideshare fleet move toward zero-emission or wheelchair-accessible vehicles by 2030.

For American Lease, the economics were different from those of an individual buyer. A fleet operator could:

  • Acquire hundreds or thousands of electric SUVs from one seller;
  • Spread vehicle-preparation and administrative costs across a large fleet;
  • Lease qualifying vehicles to drivers who need them for work; and
  • Coordinate repairs, software access and operating support at fleet scale.

That did not make the purchase risk-free. American Lease accepted substantial responsibility for transportation, vehicle preparation, recall compliance and ongoing operation. The agreement required it to arrange transportation to New York through a New York dealer and included restrictions on resale for a specified period.

Why the “$14,000 Ocean” was not a consumer bargain

A prospective buyer could not simply walk into a dealer and buy one of these vehicles for the calculated average. The transaction did not create a public retail channel or guarantee that an individual Ocean would be available for $14,314.

Even if a comparable Ocean later appeared on the market, a buyer would need to separate the acquisition price from the total cost of ownership. The bulk transaction did not include the costs of:

The fleet vehicles were sold largely as is. Under the original agreement, Fisker was not required to provide an express or implied warranty to American Lease, repair or maintain the vehicles after sale, or provide software updates beyond version 2.1. American Lease received access to relevant source code and software elements needed to operate and improve the vehicles, but that was not equivalent to a normal new-car warranty.

Comparisons describing the transaction as an “80% discount” also require caution. The percentage depends on which original retail price is used and whether the vehicle was a good-condition untitled Ocean, a previously titled vehicle or a damaged unit. Those categories were not economically equivalent.

Recall and software problems complicated the deal

The vehicles could not simply be placed into a rideshare fleet without addressing applicable safety recalls and stop-sale holds.

Cabin electric water-pump recall

The most significant campaign was NHTSA Campaign 24V499, involving certain 2023 and 2024 Fisker Oceans. A communication failure involving the cabin electric water pump could trigger a high-voltage battery-management limp mode. The vehicle could then be restricted to roughly 10 to 20 mph, creating a safety risk in traffic. Fisker’s recall notice said the pump would be replaced at no cost. The NHTSA recall notice provides the technical and remedy details.

Fisker’s dealer notice said approximately 11,308 Oceans were affected by the water-pump campaign and placed under a mandatory stop-sale hold until the repair was completed. In practical terms, an affected vehicle could not be operated as part of the fleet until the recall condition was addressed. The dealer notice is available from NHTSA.

Other recalls and software campaigns

The Ocean fleet also faced other safety and software actions, including:

  • A door-handle recall involving doors that could fail to open;
  • A software campaign involving vehicle-control-unit and motor-control-unit calibrations and the possibility of lost motive power; and
  • Additional software and hardware campaigns affecting parts of the Ocean fleet.

One NHTSA/Fisker software campaign affected 7,145 2023 vehicles, according to the campaign filing. The fleet agreement and the court’s sale materials addressed recall-related conditions before American Lease could operate affected vehicles. A court filing on those conditions illustrates why a low purchase price did not eliminate substantial operating costs.

Why creditors and other parties objected

The sale hearing was contentious because the bankruptcy estate had limited cash and many competing claims. The U.S. Trustee, unsecured creditors, vehicle owners and other parties questioned:

  • Whether Fisker had marketed the inventory broadly enough;
  • Whether the valuation supported the proposed prices;
  • Whether the transaction was being rushed before unsecured creditors had meaningful representation;
  • Whether the sale proceeds would benefit unsecured creditors or primarily the secured lender;
  • Whether Fisker could afford to continue in Chapter 11; and
  • Whether conversion to a Chapter 7 liquidation would be more appropriate.

Fisker’s principal secured-creditor interest was associated with Heights Capital Management and CVI Investments. Unsecured creditors were reported to be owed approximately $1 billion, while the proposed sale proceeds were expected to cover only a fraction of the secured debt. That raised a fundamental bankruptcy question: whether the estate should accept a fast, discounted sale now or spend more money and time pursuing alternatives that might produce a higher theoretical recovery.

In supplemental evidence filed before the hearing, Fisker’s restructuring officer said the company had contacted hundreds of potential purchasers, including dealerships, rental-car companies, taxicab operators and rideshare-leasing businesses. According to that evidence, American Lease was effectively the only buyer with a durable, transaction-ready offer on terms the estate could use. The supplemental declaration describes the buyer search.

Why the judge approved the transaction

The court did not approve the sale because $14,000 was established as the normal market value of an Ocean. The central justification was that Fisker was running out of cash, the inventory was depreciating and difficult to sell, and the company had searched for alternatives without finding another credible buyer willing to accept the condition and support obligations.

The court held the sale hearing on July 16, 2024, and approved the transaction in principle. The formal sale order was entered on July 17, 2024. The hearing report and sale order document the outcome.

Approval did not mean all vehicles were immediately delivered or that the full $46.25 million was instantly paid. Fisker still had to locate units, resolve title issues, clear recall holds, coordinate transportation and deliver vehicles under the agreement.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

What happened after the court approved the sale?

  1. June 17 and 19, 2024: Fisker and affiliates filed Chapter 11 petitions in Delaware.
  2. July 2, 2024: Fisker filed the motion seeking authority for the American Lease fleet sale.
  3. July 3, 2024: News coverage described the proposed average of roughly $14,000 per SUV. At this point, the sale was still only a request for court approval.
  4. July 15, 2024: Fisker filed supplemental evidence about its marketing effort and search for buyers.
  5. July 16–17, 2024: The court approved the transaction after the hearing, and the formal sale order was entered the next day.
  6. October 2024: American Lease raised concerns about transferring the cloud data and software infrastructure needed to keep the connected vehicles operating.
  7. October 16–17, 2024: The court approved Fisker’s liquidation plan, which became effective October 17.
  8. By October 2024: A court filing attributed to the estate reported that American Lease had paid approximately $42.5 million at that stage. Later reporting described roughly 2,800 Oceans entering its New York rideshare fleet. Those figures should not be confused with the original maximum of 3,231 vehicles and $46.25 million.

The later cloud arrangement required American Lease to pay an additional $500,000 per calendar year from 2025 through 2029, or $2.5 million over five years, for access to the Fisker Ocean backend operating and development cloud and related software, domains and infrastructure. That arrangement was a later development; it was not part of the original July 3 headline price. The relevant court filing and term sheet describe the arrangement.

Fisker’s liquidation plan also included provisions related to recall labor and owner support. The estate remained responsible for recall-related obligations under the plan, owners who paid for eligible recall labor could submit reimbursement claims, and authorized service centers could perform later recall work and seek reimbursement. A report on the plan explains those later protections.

The bankruptcy case did not simply disappear when the plan became effective. Administration continued through a liquidating trust and post-confirmation reporting. The Verita docket continued to show reports for Fisker entities and related trusts as of July 28, 2026; the case docket is the appropriate source for later filings.

What the sale meant for existing Fisker Ocean owners

Existing owners were in a different position from American Lease. They had already bought vehicles whose warranties, recall repairs, software updates, mobile-app functions, cloud connectivity, diagnostic tools and replacement-parts supply could be affected by Fisker’s bankruptcy.

The Fisker Owners Association conditionally supported the fleet sale while seeking continued access to parts, service information, software and vehicle-support infrastructure. Its court filing shows the tension: selling the inventory could preserve value for the estate, but shutting down the systems supporting existing cars could damage owners and reduce the value of the fleet as well.

The later liquidation-plan arrangements addressed some—but not necessarily every—owner concern. The original fleet agreement’s warranty disclaimers applied to the bulk transaction with American Lease. They should not be treated as a blanket legal conclusion that every existing owner automatically lost every warranty or other claim. Existing-owner rights and recall obligations were handled separately through the bankruptcy process and later plan provisions.

A practical checklist for anyone considering a used Ocean

If an Ocean appears for sale at a price that seems connected to the bankruptcy fleet transaction, treat the vehicle as a high-risk purchase rather than assuming the price is a bargain.

  • Verify the VIN and title: Determine whether the vehicle is untitled, previously titled, damaged, branded or otherwise subject to a title issue.
  • Confirm recall status: Check whether the water-pump, door-handle and software campaigns have been completed and whether any stop-sale hold remains.
  • Ask who is responsible for repairs: Do not assume Fisker will provide normal warranty service or pay for unrelated repairs.
  • Test software and connectivity: Check charging, displays, driver-assistance functions, mobile-app features, over-the-air updates and other cloud-dependent systems.
  • Investigate parts and service access: A low purchase price can be overwhelmed by a difficult-to-source component or a service center that cannot obtain diagnostic access.
  • Price insurance and registration first: A vehicle with unusual title, repair or support history may not have the same insurance or financing options as a conventional used SUV.
  • Get an independent inspection: Especially for vehicles described as damaged, engineering, port-held or previously titled.

These checks are important because a $14,000 headline number says almost nothing about the condition, legal status or long-term operating cost of a specific Ocean.

Bottom line for shoppers, owners and creditors

Fisker’s bankruptcy court transaction involved up to 3,231 Ocean SUVs and a maximum purchase price of $46.25 million. The court approved it on July 17, 2024, and American Lease pursued the vehicles for a New York rideshare-leasing fleet.

The “about $14,000 each” description came from dividing the maximum transaction value by the maximum number of vehicles. It was not a retail price, not a guarantee for each SUV and not a total cost including repairs, taxes, transportation, software or service. The actual agreement ranged from at least $2,500 for certain damaged vehicles to $16,500 for qualifying vehicles in reasonably good working order with a manufacturer’s certificate of origin.

Frequently Asked Questions

Could an individual buy a Fisker Ocean for $14,000 through this bankruptcy sale?

No. The $14,000 figure was an approximate blended price in a bulk fleet transaction with American Lease. It was not a public retail offer or a guaranteed price for an individual vehicle.

Was the fleet 3,231 or 3,321 vehicles?

The filed Fisker fleet agreement and court exhibits identify 3,231 vehicles: 3,052 U.S.-configured and 179 Canada-configured vehicles. Some contemporaneous reports used 3,321, which appears to have been a reporting or transposition error.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Were all of the Fisker Oceans new and in working order?

No. The inventory included vehicles in different conditions and locations, including good-condition vehicles, previously titled vehicles, damaged vehicles and other mixed-condition inventory. The agreement used different prices for those categories.

Did the court approve Fisker’s proposed sale?

Yes. The court held the sale hearing on July 16, 2024, and entered the formal sale order on July 17, 2024.

Did the sale include a normal Fisker warranty?

No, not for American Lease under the original fleet agreement. The vehicles were sold largely as is, without Fisker’s obligation to provide ordinary warranty, repair or maintenance support. Existing-owner warranty and recall issues were addressed separately through the bankruptcy process and later liquidation-plan arrangements.

The Bottom Line

The $14,000 Fisker Ocean was a bankruptcy math headline, not a retail deal. Fisker sold—or agreed to sell—mixed-condition inventory in bulk to American Lease, with tiered prices, recall holds, software dependencies and limited manufacturer support. Anyone evaluating an Ocean today should investigate the specific vehicle’s title, recall history, software access, service options and full ownership cost rather than relying on the fleet’s blended average.
