Usually, yes—net profit from a commercial fishing business is generally subject to federal self-employment (SE) tax when net earnings are at least $400. A crew member’s share of a catch or its sale proceeds is subject to SE tax under a separate IRS rule only if every condition in that rule is met. A Form 1099-MISC box 5 entry reports fishing boat proceeds, but the label alone does not determine the recipient’s tax treatment.
How the answer differs for an operator and a crew member

The threshold concerns net earnings, not simply the gross amount on an information return. Your records and the applicable reporting rules determine the relevant net amount.
Does a crew member’s share of the catch trigger SE tax?
The IRS says a crew member’s earnings are subject to SE tax under the special fishing-crew rule if all of the following conditions apply. Treat these as a conjunctive test: failing one condition means this particular rule does not establish that the earnings are subject to SE tax. It also does not, by itself, settle whether another tax or worker-classification rule applies.
- Pay arrangement: You receive no pay other than a share of the catch or its sale proceeds, subject to a narrow exception for certain extra-duty cash payments.
- You receive a share: Your compensation includes a share of the catch or proceeds from its sale.
- Catch affects your share: The amount of your share depends on the amount of the catch.
- Small operating crew: The boat’s operating crew normally numbers fewer than 10 people. The IRS measures “normally” by averaging crew size on trips over the previous four calendar quarters.
When extra-duty cash can fit the exception
Cash for additional duties does not automatically disqualify a crew member from the special rule. The exception is narrow: the cash must be no more than $100 per trip, paid only if a minimum catch is made, and solely for additional duties for which cash pay is traditional in the fishing industry. If the payment does not meet those requirements, do not assume the exception applies.

If one or more conditions are not met
The special fishing-crew test does not decide the result. Review the actual compensation arrangement and the worker’s role; the IRS information cited here does not determine employee status or resolve every alternative classification. Get advice based on the facts if the arrangement is unclear.
What does “fishing boat proceeds” on Form 1099-MISC mean?
The IRS Form 1099-MISC instructions list fishing boat proceeds among payments reportable in box 5. That is an information-reporting category, not a ruling that every recipient is self-employed or owes SE tax. A box 5 amount does not tell you, on its own, whether you operated a business, meet the crew-member test, or should be treated as an employee under another arrangement. Compare the form with your own records of payments, catch shares, expenses, and the terms of your work. Report income consistently with the underlying facts and the rules that apply to your role; do not treat the gross information-return amount as automatically equal to taxable net earnings.
How do commercial fishermen report income and calculate SE tax?
- Identify your role and business structure. Determine whether you are the operator of a sole-proprietor fishing business, a crew member receiving a share, or earning income through a partnership or corporation.
- For a sole proprietor, calculate business net profit. Track fishing income and allowable business expenses. IRS Topic 416 directs fishing businesses to report income and expenses on Schedule C.
- Check the net-earnings threshold. If net earnings from fishing are $400 or more, Topic 416 directs the taxpayer to use Schedule SE to calculate SE tax. This is a net-earnings threshold, not a gross 1099 amount threshold.
- For crew compensation, apply every part of the special test. Check the pay method, whether the share depends on catch, average operating crew size over the previous four calendar quarters, and any extra-duty cash against the narrow exception.
- Use the instructions for the tax year being filed. Rates and wage bases change; do not carry a prior-year figure forward without confirming it in that year’s IRS guidance.
2025 SE tax rate and Social Security wage base
The IRS Publication 334 figures below are specifically for tax year 2025; they are not 2026 figures. SE tax is calculated on net earnings under the applicable rules, not by multiplying every gross proceeds amount by the headline rate.
