The Fair Work Ombudsman has started Federal Court action against GCH Vic Park Pty Ltd, the former operator of the now-closed Globe Pan & Grill in East Victoria Park, Perth, and the company’s director, Jay Patel. The regulator alleges that 16 workers, cooks and food-and-beverage attendants, were underpaid between December 2021 and July 2023. These are allegations, not court findings. PerthNow reported the action on 17 November 2025.
Who the case names
The respondents are the company and Patel. GCH Vic Park Pty Ltd reportedly operated the Globe Pan & Grill on Albany Highway, East Victoria Park, which has since closed. Patel is named as a director. The Ombudsman alleges that he was involved in the company’s alleged breach of a compliance notice, which is described further below. PerthNow reports that the action arose from a proactive audit of the fast-food, restaurant and cafe sector, so the case was not triggered by a single worker complaint, according to that report.
What the Ombudsman alleges workers were owed
The affected group is 16 workers employed across full-time, part-time and casual roles. The regulator says the shortfalls involved three kinds of entitlement.
Minimum wage rates
The Ombudsman alleges that workers were paid below the minimum wage rates that applied to their roles over the period from December 2021 to July 2023.

Weekend penalty rates
The regulator also alleges that weekend work was not paid at the penalty rates that apply to it. Penalty rates are a loading on ordinary pay for hours worked at certain times, such as weekends, and are set out in the relevant award or agreement.
Accrued annual leave on termination
The third category is accrued but untaken annual leave owed when employment ended. In general terms, unused annual leave is paid out when employment finishes, so an underpayment here means a worker left with less than the leave value they had built up. The Ombudsman alleges that these amounts were not paid in full.

The compliance notice and the alleged non-compliance
According to the report, the Ombudsman issued a compliance notice in August 2023. The notice required the company to work out what each affected worker was owed and to pay it back. The regulator alleges that the company did not comply, and that it had no reasonable excuse for failing to do so. The allegation that Patel was involved in that breach is part of the same claim. The compliance notice is central to the case because the regulator’s requested orders are built around it.
Penalties and orders the regulator is seeking
PerthNow reports that the Ombudsman is seeking maximum penalties against each respondent. The figures are amounts sought, not amounts a court has imposed.

Beyond penalties, the regulator reportedly asks the court to order the company to comply with the original compliance notice and to rectify the outstanding entitlements. That includes superannuation, plus interest. These are remedies sought in the proceeding. The report does not say that any of them have been granted.

- Note the award or agreement you think applies to your role, and the weekend and public-holiday shifts you worked.
- Record your annual leave balance and whether it was paid out when your employment ended.
- Make a note of when you raised the matter with your employer, and how they responded.
A useful distinction for any claim is whether the amount is an underpayment of wages, an unpaid penalty loading, or unpaid leave on termination. Each is calculated differently, and the regulator’s contact point can explain which applies to you.
