The NFL has joined New Jersey in urging the U.S. Supreme Court to review a dispute over whether federal regulators or state authorities can oversee sports event contracts on prediction-market platforms. But as of an October 9, 2026 report by Front Office Sports, the Court had not agreed to hear the case, and the timing remained uncertain.
What is the prediction-markets case about?
The dispute is about who may regulate sports event contracts offered by prediction-market platforms: the federal Commodity Futures Trading Commission (CFTC), which oversees derivatives markets, or state authorities applying sports-betting laws. New Jersey petitioned the Supreme Court after two federal appeals courts reached different results on whether states could apply those laws to prediction-market platforms, creating a split among the courts of appeals.

The NFL filed a brief supporting New Jersey. Its filing does not mean the Supreme Court has accepted the case, nor does it settle which regulator has legal authority. Front Office Sports reported on October 9, 2026, that the Court had been asked to review the dispute—not that it had agreed to do so.

Why does the NFL support state oversight?
The NFL argues that state-level rules provide stronger protections for game integrity and consumers. As summarized by Front Office Sports, the league questioned whether the CFTC’s proposed approach adequately addresses integrity, consumer-protection, and market-manipulation risks, and raised concerns about the agency’s resources. Those are the NFL’s claims, not findings established by the report.

Integrity, safeguards and enforcement
The league’s position is that oversight should be strong enough to address risks to game integrity and the possibility of market manipulation. The NFL brief, as quoted by Front Office Sports, said that if federally regulated exchanges adopted robust safeguards and vigorous oversight similar to those of state and tribal regulators and legalized sportsbooks, there might be less cause for concern. The brief added: “But that is not what is happening.”
Age limits
The NFL also pointed to differences in minimum ages: it said some platforms allow users aged 18 to trade sports contracts, while many state-regulated sportsbooks set a minimum age of 21. This comparison was presented as part of the league’s argument; it does not establish the rules of every platform or sportsbook.

How do the CFTC and platforms respond?
The CFTC and prediction-market platforms have described a different approach, emphasizing federal engagement, surveillance, and the possibility of cooperation. Front Office Sports reported the following positions:
| Actor | Position reported by Front Office Sports |
|---|---|
| NFL | Supports New Jersey’s request and argues that state-level oversight offers stronger integrity and consumer protections. |
| CFTC | A spokesperson said the agency had engaged with the NFL and regretted that the league declined a memorandum of understanding that could have enabled cooperation and information exchange. The spokesperson said: “It’s unfortunate the NFL declined” to sign one. |
| Kalshi | Said market integrity is its top priority, described its surveillance and league-partnership posture, and said the CFTC actively polices sports-related markets. |
| Polymarket | Said it was enhancing surveillance and collaborating with regulators and leagues toward a harmonized federal framework. |
These statements describe the parties’ positions, not an adjudication of whether existing protections are adequate. Front Office Sports also reported that New Jersey’s petition had support from attorneys general for 39 states and the District of Columbia, as well as a coalition of 145 tribal nations and organizations.

Why is the NFL pressing the issue now?
The league’s filing highlighted the scale of sports-related activity on prediction markets. It said more than half of all prediction-market trading volume on the first Sunday of the season—$1.8 billion of $3.3 billion total—related to the NFL. That figure is attributed to the NFL filing as reported by Front Office Sports; it is a single Sunday’s figure, not an independently audited measure or a season-wide total.
An unnamed league source quoted by Front Office Sports said: “Given this volume of trading and the uncertainty around it, it is critical for the Court to act as soon as possible.” That statement expresses the league’s urgency, not a confirmed timetable for the Court.

When might the Supreme Court act?
In its October 9, 2026 report, Front Office Sports said Kalshi’s response to the petition was due November 9, 2026. The report relayed an anonymous Supreme Court expert’s view that January was the earliest possible point for action, while warning that it could take longer. That was a forecast, not a confirmed schedule. The Court had not yet agreed to hear the case in the report’s account.
If the Court takes it up, the dispute could clarify the boundary between federal derivatives oversight and state sports-betting laws for these contracts. The immediate question, however, is narrower: whether the justices will review New Jersey’s petition. The report does not establish what the Court would ultimately decide on the merits.
