The reports say the consignment had an invoice, delivery documents, an active Part-A and a Bharat Petroleum Corporation Limited (BPCL) purchase order. Ltd.’s appeal, quashed the earlier penalty orders and directed the authorities to process a refund of ₹17,02,620 deposited under protest through Form GST DRC-03. The reported direction gave the authorities four weeks from receipt of the tribunal’s order to process the refund. TaxGuru says the penalty was imposed through a Form GST MOV-09 order dated April 2, 2024, and that the first appeal was unsuccessful in an order dated June 14, 2024. The reports describe the dispute as a Section 129 matter under the CGST/KGST framework. They do not establish that every relevant fact—such as whether the goods, vehicle and paperwork matched in every respect—was resolved in the same way in the official order. Can GST impose a penalty when Part-B is not updated?
The reports do not support a universal yes-or-no answer based on the omission alone. In Woodfield’s case, the reported record included an invoice, delivery documents, an active Part-A and a BPCL purchase order, while the reported outcome was to set aside the penalty. The case should therefore be read in light of its documents and procedural history, not as an automatic exemption for any vehicle intercepted with incomplete e-way bill details.

For a particular detention, the relevant questions include what records existed at interception, whether the goods and transport details were consistent with them, what specific discrepancy the officer recorded, whether the order gave reasons, and whether the prescribed detention and penalty process was followed. The Woodfield reports do not resolve every possible combination of those facts.

What does Part-B do, and when does e-way bill validity start?
Part-B records transport information. The Karnataka Commercial Taxes Department’s e-way bill FAQ says validity begins when the first applicable Part-B entry is made: the vehicle entry for road transport, or the first transport-document entry for rail, air or ship. The FAQ also says validity may be extended when exceptional circumstances prevent the goods from reaching their destination within the validity period. What should a business check after an interception?
When reviewing a Section 129 detention or penalty, keep the factual record and the procedural record together. The following checks help identify what needs attention; they are not a prediction of the outcome of a dispute.
- Confirm which e-way bill parts were generated and whether Part-A was active at the time of interception.
- Collect the invoice, purchase order, delivery documents and transport records that existed when the vehicle was stopped.
- Compare the goods, vehicle and documents, and identify any mismatch or other discrepancy recorded by the officer.
- Read the detention and penalty documents for the forms used, the stated grounds and the reasons given. Taxmann’s summary of Woodfield specifically notes a reported issue concerning a speaking order in Form GST MOV-09.
- Keep proof of any amount paid under protest and the payment form, including Form GST DRC-03 where applicable.
- Check the current CGST/KGST provisions and obtain qualified advice on the specific facts before deciding how to challenge an order.
What is established—and what remains unverified?
The Government of India GSTAT portal describes the tribunal’s role as hearing appeals from orders of appellate or revisional authorities under Sections 107 or 108 and corresponding State GST Acts. TaxGuru reports that Woodfield appealed after an unsuccessful first appeal.
