EU Fines Google €2.95 Billion Over Adtech Conduct as Trump Threatens Retaliation

The European Commission fined Google €2.95 billion over adtech conduct, but the remedy and Google’s court challenge remain unresolved.

On September 5, 2025, the European Commission fined Google €2.95 billion over alleged abuses in online advertising technology, finding that the company used its positions on both sides of the ad market to favor its AdX exchange. The decision came amid U.S.–EU trade tensions, but the timing alone does not establish that the Commission ignored or was unaffected by President Donald Trump’s pressure. Google has appealed, and a breakup has not been ordered.

What the EU fined Google for

The case concerns online display-advertising intermediation: the tools that help advertisers buy ad space on websites and help publishers sell it. It is not a case about Google Search rankings, the Play Store, or personalized advertising generally. The Commission’s decision covers conduct from 2014 onward and finds that Google abused a dominant position in specific parts of this adtech chain. The Commission’s decision summary sets out its findings.

Google’s roles in the ad market

  • Publisher ad server: DoubleClick for Publishers, now associated with Google Ad Manager, helps publishers manage and sell ad inventory.
  • Ad exchange: AdX connects buyers and sellers and runs auctions for advertising inventory.
  • Advertiser-side tools: Google Ads and Display & Video 360 help advertisers buy programmatic advertising.

Google operated tools at multiple stages of the transaction. The Commission’s concern was not simply that Google owned several products; it was that the company allegedly used its position across the chain to advantage AdX over competing exchanges.

How the alleged preference worked

The Commission found that Google gave AdX preferential treatment in auctions run through its publisher ad-server business and used its advertiser-side buying tools in ways that favored AdX. It also identified auction rules and information practices that reinforced the exchange’s position. The resulting conflict of interest arose because Google operated buying and selling tools while also running the venue where transactions were matched.

That is narrower than saying Google controlled or monopolized all digital advertising. The decision concerns particular markets and practices in the adtech supply chain, and its legal findings should not be stretched to every Google advertising product.

Who could be affected—and how

Publishers

Publishers sell space on their websites and apps. The Commission’s theory is that weaker competition for inventory can limit publishers’ alternatives and bargaining power, potentially reducing the proceeds they receive. Dependence on a single integrated set of tools can also make switching harder when much of the relevant demand is connected to the same ecosystem.

Advertisers

Advertisers may face less transparent auctions, fewer independent routes to publisher inventory, or higher intermediation costs when buying and selling tools are not competing on equal terms. Those are potential market effects, not a quantified finding that every advertiser paid a particular overcharge.

Rival adtech firms

Competing exchanges and other adtech providers may find it harder to attract buyers, sellers, data, or auction opportunities when an integrated incumbent has advantages across the chain. Whether competitors gain meaningful scale depends on access to inventory and demand as well as on auction rules.

The Commission’s conclusion about abusive conduct is distinct from a calculation of each publisher’s or advertiser’s losses. The decision does not itself set out a precise amount of harm for every business or provide direct refunds to affected customers.

Why the fine is not the same as a remedy

The Commission imposed the €2.95 billion penalty under EU competition law to punish and deter abuse of dominance. It is separate from any future measure intended to change how Google operates. The fine is not automatically compensation for publishers or advertisers, and its amount should not be read as a total estimate of market harm. It is not Google’s largest EU antitrust penalty: the company has previously received larger European penalties, including in the Android case.

The Commission required Google to propose measures within 60 days and warned that behavioral changes might not be enough. It left open a structural remedy, such as selling part of the adtech business, if other measures failed to resolve the conflict of interest.

Possible remedies and their trade-offs

Failure to comply with an eventual binding obligation could also expose Google to periodic penalty payments. No such table entry should be mistaken for an order already requiring a sale: the September 2025 decision did not immediately break up Google’s adtech business.

Google’s response and appeal

Google denied that providing tools to both buyers and sellers is inherently anticompetitive and argued that advertisers and publishers have more alternatives than before. It opposed a disruptive breakup, arguing that publishers and advertisers rely on its tools. In November 2025, Google proposed behavioral and technical changes that did not include a breakup, according to Associated Press reporting. A proposal is not the same as an accepted remedy; the Commission’s assessment remains important.

Google and Alphabet challenged the decision in the EU General Court. The action was lodged on November 20, 2025, as Case T-794/25, and seeks annulment or reduction of the decision and fine. The EUR-Lex case record identifies the proceeding. As of August 18, 2026, no final judgment on the challenge was identified, so the Commission decision has been issued but has not been finally upheld by the EU courts.

What Trump’s threats do—and do not—show

The political context matters, but it needs a careful chronology. The Commission had investigated Google’s adtech conduct for years. Reporting said the decision’s timing became sensitive amid U.S.–EU trade negotiations and that pressure arose to delay it. The Commission announced the fine on September 5, 2025; Trump criticized the penalty after the announcement and threatened possible retaliation against Europe. Reporting on the decision and its timing appeared in the Associated Press, Ars Technica, and Le Monde.

The evidence supports saying that enforcement proceeded amid political pressure and trade sensitivity. It does not, by itself, prove that Trump’s threats had no effect on the timing, or establish a direct causal link between the threats and the Commission’s decision. The EU’s stated basis for the penalty was competition law applied to conduct affecting markets in which it has jurisdiction.

How this differs from the U.S. adtech case

The EU decision is an administrative enforcement action by the European Commission under EU competition law. The U.S. Department of Justice’s separate adtech case is a judicial proceeding with its own evidence, markets, legal standards, and potential remedies. Similar allegations do not make the cases interchangeable, and an outcome or remedy in the United States would not automatically decide what the EU requires.

The distinction matters for businesses with global operations: an adtech change may have effects beyond one region because platforms and advertiser demand operate across borders, but that does not mean an EU decision automatically governs every market worldwide.

What the outcome could mean for advertising businesses

The practical effect will depend more on the remedy than on the fine alone. A stricter separation could give independent exchanges or publisher tools more room to compete, but it could also require publishers, advertisers, and agencies to change integrations or workflows. Behavioral rules may be less disruptive at first, while demanding continued scrutiny of auction mechanics, access, and data. Neither route guarantees lower advertising costs or higher publisher revenue.

Businesses assessing their adtech arrangements should compare options on operational terms rather than assuming that a provider is better merely because it is independent of Google. Relevant considerations include net yield after fees, auction transparency, demand quality, data-sharing and consent practices, contract lock-ins, geographic reach, integration costs, and the ability to use multiple demand sources. A publisher can use multiple exchanges, but that alone does not establish that competition is effective if access to demand or auction pathways remains concentrated.

For publishers, an ad server or sell-side platform is not interchangeable with an advertiser’s demand-side platform. A technically capable alternative can also bring implementation and optimization costs, and changing systems can initially reduce yield or increase operational work. Any benefit from greater choice depends on the specific business, its traffic, its engineering resources, and the terms it can negotiate.

What happens next

  • Court review: The General Court will consider Google and Alphabet’s challenge; the Commission decision remains contested while that case is unresolved.
  • Remedy assessment: The Commission must determine whether Google’s proposed changes adequately address the identified conflict of interest.
  • Possible escalation: If behavioral or operational measures are considered inadequate, the Commission has left structural measures, including a possible sale of part of the business, open.
  • Market adjustment: Publishers, advertisers, and competing adtech firms may respond to any binding changes, but the scale and timing of commercial effects are not yet established.
