What the EU has changed
Council Regulation (EU) 2026/1181 suspends Common Customs Tariff duties on listed fertiliser products using autonomous tariff quotas. Adopted on 22 May 2026 and published in the Official Journal on 29 May, it entered into force the next day and applies until 31 May 2027. Read the regulation.
The Council says the relevant goods previously faced common customs duty rates of 5.5% to 6.5%, and that the change is expected to save €60 million in import duties. Those figures are Council-reported estimates for the measure overall, not savings attributed specifically to U.S. exporters. Council announcement, 22 May 2026.
Which fertilisers are covered?
The regulation lists goods by Combined Nomenclature (CN) codes, including urea, ammonia, certain other nitrogen-based fertilisers, and specified nitrogen-containing mixtures. Its annex assigns separate quota volumes to product codes. The Council highlights 890,000 tonnes for specified urea codes and 300,000 tonnes for specified ammonia codes; these are quota amounts, not guaranteed duty-free allocations for individual suppliers.

Quota volumes are calculated with reference to 2024 EU most-favoured-nation imports, excluding imports from Russia and Belarus and adding a 20% top-up based on those countries’ 2024 volumes. The Commission is to monitor the market and may propose extending or changing the measure.
Is the suspension specific to U.S. fertiliser?
No U.S.-exclusive preference is established by the regulation. It sets out product codes and quota treatment, rather than a tariff reduction limited to goods of U.S. origin. Whether a particular shipment qualifies depends on the exact CN classification, origin rules, quota administration and whether quota remains available.

For a U.S. shipment, an importer should verify the product’s customs code and country-of-origin treatment, then check the applicable quota and remaining balance before calculating the duty. The available official summaries do not provide a product-by-product comparison of U.S. and other exporters’ landed costs.
How this relates to EU-U.S. trade talks
The EU-U.S. Joint Statement of 21 August 2025 established a broader reciprocal trade framework. The European Commission says the framework entered into force on 1 July 2026 after formal approval by the European Parliament and Council. It describes the EU as eliminating tariffs on U.S. industrial goods and improving access for certain non-sensitive agri-food products. Joint Statement and Commission overview.

The Council’s 20 May 2026 account describes implementation of tariff elements as a platform for further engagement to lower tariffs, with economic effects to be monitored. Neither that summary nor the Commission overview identifies fertilisers as a specific U.S. concession. The fertiliser suspension and the broader bilateral framework are therefore related to the wider trade environment, but they are separate measures. Council account, 20 May 2026.

Removing duties within the quotas can reduce the import cost of covered goods while the suspension applies. The Council’s stated aim is better access to affordable, reliable fertiliser supplies; the ministerial statement accompanying its announcement described that as positive for farmers and EU consumers. The €60 million estimate is for import-duty savings across the measure, however, and does not quantify how much any farmer, importer or U.S. exporter will save.

Actual cost effects depend on the shipment’s classification and origin, quota availability, and how import-cost changes flow through commercial pricing. The regulation does not guarantee that a lower customs duty will translate into an equivalent reduction in farm-gate fertiliser prices.
