Estate planning is the process of deciding how your property should be managed and passed on, and who can make financial or health-care decisions if you cannot. A plan commonly combines a will or trust with powers of attorney and advance-care documents. The right documents—and the rules for signing and using them—depend on your state, your assets, and your goals.
What does estate planning cover?
Estate planning is not only about what happens after death. It can also set out who may handle financial matters or make health-care decisions during your lifetime if illness or incapacity prevents you from acting. The National Institute on Aging lists wills, durable financial powers of attorney, living trusts, and advance directives among the documents people may prepare as part of getting their affairs in order.
A plan works best when its documents and practical arrangements fit together: instructions for distributing property, people authorized to act, and a clear record of where important information can be found.
Which documents may belong in a plan?
A will
A will records instructions for distributing property covered by the will after death. Depending on the state and the circumstances, that property may need to go through probate, the court-supervised process for handling an estate. A will does not, by itself, determine what happens to every asset; the way property is owned or otherwise arranged can matter. California Courts provides state-specific information on wills, estates, and probate, but its guidance is not a nationwide rulebook: California Courts: Wills, estates, and probate.

A revocable living trust
A revocable living trust is an arrangement for managing and distributing property that has been placed in the trust. It may help trust-held assets avoid probate, but signing a trust document does not automatically transfer every asset into it. Property left outside the trust is not covered by its terms merely because the trust exists. A durable financial power of attorney
A financial power of attorney (POA) is a legal document that authorizes another person, called an agent, to act on your behalf in financial matters. A POA used for advance planning is generally durable, meaning it can continue to operate if you become incapacitated. Its powers can be significant, so choose someone you trust and understand what the document authorizes. Advance directives and health-care decision documents
Health-care documents address a different role from a financial POA. An advance directive may include a living will, which records preferences about medical care, and a durable health-care power of attorney, which names someone to make health-care decisions if you cannot. States use different document names and forms, so confirm which options are recognized where you live. Will or revocable living trust: how do they differ?

Neither option is automatically right for everyone. A trust is not a guarantee that every asset will avoid probate, and a will or trust should be considered alongside the separate documents for incapacity and health-care decisions.

How to start an estate plan
- List your property and existing arrangements. Record what you own, how it is held, and any existing instructions or documents relevant to its transfer. This helps identify what a will or trust would actually need to address.
- Decide who you trust to act. Consider separately who could handle financial matters and who could make health-care decisions. An agent’s authority depends on the document, so understand its scope before signing.
- Choose the documents that match your goals. Consider a will or, where appropriate, a revocable living trust for property planning; a durable financial POA for financial matters during incapacity; and advance directives for health-care preferences and decision-making.
- Check your state’s requirements before signing. Witness, notarization, form, and probate rules are not uniform across the country. Use official information for your state; the California Courts guide is an example of a jurisdiction-specific resource, not a general U.S. standard.
- Keep documents findable and review them when circumstances change. Tell the people you appoint where to locate relevant documents and information. Revisit the plan after major changes in family circumstances, property, or preferences, and check that it still reflects your intentions.
Do estate taxes mean you need a plan?
Estate planning is useful for decisions about property and incapacity even when federal estate tax is not expected to apply. For people who die during calendar year 2026, the IRS basic exclusion amount is $15 million. That is a federal, year-specific figure—not a substitute for planning, and not a complete answer to whether an estate has a filing obligation or ultimately owes tax. Filing and tax liability are separate questions, and the applicable rules and circumstances matter. Check the IRS’s current guidance for the relevant year: IRS: What’s new—estate and gift tax.
For gifts made in 2026, the federal annual gift-tax exclusion is $19,000 per donee. This does not mean every gift at or below that amount is automatically exempt from reporting in every circumstance; gift type and circumstances can affect the rules.
