Dyed diesel is marked with red dye to identify fuel intended for off-road or other nontaxable use. It can cost less because it is generally sold without the federal and state highway excise taxes applied to on-road diesel, but it is not necessarily free of every tax or fee. In most circumstances, it is not for highway vehicles. A federal action announced October 5, 2026 temporarily changes federal treatment through the end of 2026; it does not establish that every state has changed its taxes or rules.
What is the difference between dyed and regular diesel?
Dyed diesel—often called red diesel or off-road diesel—is diesel fuel with red dye added so it can be identified as fuel intended for nontaxable uses. The color indicates its tax and intended-use status; it does not, by itself, mean the fuel has a different engine-performance grade. The U.S. Energy Information Administration (EIA) describes off-road diesel as fuel marked this way to distinguish it from on-highway diesel. North Carolina likewise describes it as regular diesel with red dye added.
Regular, or clear, diesel sold for highway vehicles is generally taxed at the point of sale. The IRS states: “Diesel is undyed when sold for highway use vehicles and excise tax is collected at the time of sale.” IRS Publication 225 explains the federal distinction.
Is dyed diesel cheaper than regular diesel?
It may be cheaper because the usual price difference reflects highway excise-tax treatment, not a guaranteed difference in the underlying fuel price. EIA says off-road diesel “is not subject to the state and federal excise taxes applied to the retail sale of diesel fuel used in vehicles operated on public roadways.” That statement is about those excise taxes, not every possible tax or charge.

Other taxes and fees can still apply. For example, the IRS’s December 2025 Publication 510 describes a $0.001-per-gallon LUST tax on dyed diesel in the circumstances covered there. North Carolina says retail dyed diesel is subject to sales tax and an inspection tax. These examples are jurisdiction-specific, not a nationwide tax schedule.
EIA does not publish a price series specifically for off-road diesel, so the cited official sources do not establish a national price difference or savings amount. To compare what you would actually pay, request local quotes for the same date, quantity, delivery method, and location. Ask suppliers to itemize the fuel price, excise taxes, sales or use taxes, delivery, and other fees.

Where can dyed diesel be used?
Its ordinary intended use is in equipment and vehicles not usually operated on public roads. EIA gives farms, railways, construction sites, and electric power generation as examples. North Carolina’s examples also include farm and construction equipment, generators, aviation and marine vehicles, and carnival rides. Those examples describe that state’s guidance; they are not a blanket list of permissions for every state or situation.
Can you use dyed diesel in a truck?
Under the ordinary federal rules, dyed fuel purchased for nontaxable use must be used only for that use. The IRS specifically warns against putting it in a farm truck that also travels on the highway, even when the highway trip relates to the farm business; it says to use undyed fuel for that truck. The IRS describes off-highway business use as business or income-producing use that is not in a highway vehicle registered, or required to be registered, for public highways. Under ordinary rules, knowingly using, selling, or altering dyed fuel for a purpose other than nontaxable use can trigger a federal penalty. The 2025 IRS Publication 225 states a penalty of the greater of $1,000 or $10 per gallon; the $1,000 amount increases after the first violation. A temporary federal action announced in October 2026 affects the current context, so do not treat that ordinary-rule summary as a complete statement of how the temporary policy is being administered.

As of October 7, 2026, the White House says an October 5 executive action directs the Treasury to defer federal excise tax on highway use of dyed diesel for the remainder of 2026, without interest or penalties. The White House describes the action as temporarily allowing highway use and says agencies will coordinate with states and encourage corresponding state action. This federal announcement does not prove that state taxes or rules have changed nationwide. For example, North Carolina’s dyed-diesel notice says vendors selling dyed diesel for highway use and bulk end users using it on highways must file the state’s Motor Fuel Backup Tax Return. Before using dyed diesel in a highway vehicle, check current guidance from your state tax agency and any applicable federal instructions. The temporary federal measure is described as lasting through December 31, 2026; do not assume it continues after that date.
Can you get a refund for regular diesel used off-road?
Qualifying users who buy undyed fuel and use it for an eligible nontaxable purpose may be able to claim a credit or refund under IRS rules. Eligibility depends on the use and the applicable requirements; consult IRS Publication 225 for the relevant category and filing details. This can be an alternative to buying dyed fuel where a user qualifies, but it is not an automatic refund for every off-road purchase.
